4. Defendant. Liberty Associates, Is a partnership and the partners of Liberty
Associates are Harmon-Graves Company and Kimba, Inc. Liberty Associates created and
sold residential building lots In the development known as Liberty Woods,
5. The deed conveying Lot #43 to the Kecks was executed by Harry H. Fox, Jr.,
president and secretary of Harmon-Graves Company and Clnda L. Fox, vice president and
assistant secretary of K1mba, Inc.
6. Clnda L. Fox was also a representative of DeRemer and Spencer at the closing
for the property and DeRemer and Spencer was the realtor for Liberty Associates.
7. On May 1. 1995, Cinda L. Fox presented to the Kecks at the real estate
closing, a written report from an engineer directed to Liberty Associates Indicating tbat the
fllllocated on Lot #43 would not effect any structure. Moreover, this report Indicated that
Lot #43 was not Included In those lots which should be tested or which would require
"structural adaptations due to flll..." A copy of this report Is attached hereto as Exhibit "B"
and Is Incorporated herein by reference.
8. The Kecks received the report referenced as Exhibit "B" and reasonably relied
upon the report In going forward and concluding the purchase of the lot.
9. The Defendant was aware that the Kecks were purchasing the lot with the
intention of erecting a dwelling on the property.
10. The Kecks paid the Defendant $24,900,00 for the lot.

17. The representation was false, directly or by innuendo. and was Intended to
deceive the Kecks.
18. These misrepresentations caused the Kecks to Incur the aforementioned extra
costs and expenses in the construction of their residence above and beyond those reasonably
necessary in the construction of a similar residence.
19. These representations caused the Kecks to be lulled into a sense of security
as to the condition of the fill on the lot and the necessity of independent testing or
evaluation of the lot.
20. These representations were intended to and did Induce the Kecks to conclude
the purchase of the lot.
WHEREFORE, plaintiffs demand judgment in their favor and against the defendant
as follows:
1) the extra costs Incurred in the amount of $5,567.75.
2) Interest and costs of this action,
3) such other relief as this court deems just and proper.
COUNT II
21. Plaintiffs Incorporate by reference paragraphs one through twenty as though
set forth at length,
22. The actions of the Defendant are In violation of thl' Unfair Trade Practices
and Consumer Protection Law. 73 P,S, Section 201.1 et seq,

23. The Defendant represented, In writing, that the property had uses or benefits
which It did not have, to wit, the lot could be used for the construction of a residence
without modification or without the expense of costs above and beyond those ordinary In
the trade.
24. The Defendant represented that the property was of a particular grade or
quality which It was not, which representations included, hut were not limited to, stating, in
writing, that the lot could be used for the construction of a residence without modification
or without the expense of costs above and beyond those ordinary in the trade.
25. The Defendant otherwise engaged in frauduh.lt conduct which created a
likelihood of confusion or misunderstanding on the part of the Kecks including, but not
limited to, the aforementioned representations and representing that testing of the lot fill
was not necessary. Moreover, the Defendants presented Exhibit "B" at the real estate
closing for the property along with a purported release form with the intend of deceiving
the Kecks as to the necessity for the release.
26. Said actions and omissions by the Defendant are violative of the Unfair Trade
Practices and Consumer Protection Law including, but not limited to, Sections 201.
2(4)(ii),(Iii),(v),(vl),(vll) and (xvii).
27. Plaintiffs seek an amount not in excess of the compulsory arbitration limits.

WHEREFORE, plaintiffs requestthutjudgment he entered for them and against the
Defendant as follows:
1) recovery of $5,527.75;
2) costs, interest und allorney fees;
3) a trebling of the uctuul dumages; and
4) any other relief that this court deems just and proper.

238, granted and conveyed to Libeny Associates, A Pannership, Grantor herein.
SUBJECT to the following restrictions:
I, All residential structures shall hal'e a minimum of 1100 square feet of finished living
floor area,
2. No mobile homes shall be placed on any lot in this subdivision,
3, No dumping or stockpiling of materials or other items shall be permitted nor the
accumulation of any junk or unlicensed vehicles on any lot within said subdivision,
4. Tree remol'al shall be kept to a minimum 10 permit the construction ofa primary
residence and garage,
5. Lot owners shall be responsible for the installation and maintenance of a sidewalk
along the street frontage of their lot. Sidewalk construction must be completed "';thin one year of
lot purchase, The sidewalk must be constructed as per the specifications of the approved plan of
subdivision.
