COMPLAINT
AND NOW, comes Farmers Trust Company, through its attorney,
William A, Duncan, Esquire, and files this Complaint in
Mortgage Foreclosure, of which the following is a statement:
1. Plaintiff is Farmers Trust Company, a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with its main office and principal place of
business located at 1 West High Street, Carlisle, Cumberland
County, Pennsylvania 17013.
2. Defendants, DAVID R. RICCIO and DENEEN C. RICCIO,
husband and wife, residing at 4 Gunpowder Road Mechanicsburg,
Pennsylvania 17055.
3. On or about April 14, 1994, Defendants made and
delivered to Plaintiff a note and a real estate mortgage
finanoing ONE HUNDRED EIGHTY THOUSAND DOLLARS and 00/100
Dollars ($180,000.00), a copy of said note and said real estate
mortgage being attached hereto as Exhibits "A" and "B",
respectively, and are incorporated herein by reference as
though fully set forth.
4. Said note and said real estate mortgage have not been
assigned.
5. DAVID R. RICCIO and DENEEN C. RICCIO are the sole
record owners in fee simple of premises located at Lot # 128
"The pennisula", Mechanicsburg, Pennsylvania and subject to
said mortgage, by virtue of a Deed dated and recorded on March
14, 1994, and recorded in the Cumberland County Recorder's
Office in Deed Book "102", Page 730, more specifically set
forth in Exhibit "C", attached hereto and made a part hereof by
reference.
6. Said note and real estate mortgage are in default
because Defendant herein has failed to pay the payments that
were due and owing for the months of payments as follows: 9/95
$1,409.17, 10/95 $1,425.00, 11/95 $1,472.50, 12/95 $1,425.00
and December 30, 1995 $1,140.00.
7. By Reason of the aforesaid default, the entire
principal balance of ONE HUNDRED NINTY SIX THOUSAND FIVE
HUNDRED SEVENTY TWO DOLLARS and 28/100, ($196,572.28), with
interest thereon at the rate of 9.50' percent per annum
computed from December 28, 1995, accruing insurance premiums,
attorney's fees in the amount of NINE THOUSAND THREE HUNDRED
FORTY THREE DOLLARS and 58/100, ($9,342.58) are now due and
payable.
8. The Defendants are liable to the Plaintiff for the
following on said mortgage loan:

due through December 30,1995:

at 39.67:
C. Attorney's Collection fee,
WHEREFORE, Plaintiff prays the Court to enter judgment in
favor of Plaintiff and to order the foreclosure and sale of the
mortgaged property and for the amount of ONE HUNDRED NINTY SIX
THOUSAND FIVE HUNDRED SEVENTY TWO DOLLARS and 28/00,
($196,572.28) together with interest thereon, costs and all
other amounts advanced by Plaintiff.
