1. Plaintiff, Franklin Credit Management corporation
(hereinafter "Plaintiff") / is a corporation organized and existing
under the laws of the State of Delaware and having its principal
place of business at six Harrison Streett New York, NY 10013.
2. Defendantsf Randy L. Deckman and Tina M. Deckmanf husband
and wife (hereinafter "Defendants"), are individuals and real
owners of the premises hereinafter described, who reside at 21 West
Green Street, Shiremanstown, PA 17011.
3. On December 16/ 1985/ Defendants made, executed and
delivered a mortgage upon the premises hereinafter described, to
Homestead Savings Association, which mortgage was recorded in the
Office of the Recorder of Deeds of Cumberland County/ Pennsylvania
on December 19f 1985 in Mortgage Book Volume 799f pages 557 etc.
(hereinafter the "Mortgage").
4. The Mortgage secures the Defendant I s promissory note
dated Decernber 16f 1985f in the original principal amount of
$40fOOO.00, payable to Homestead Savings Association in monthly
installments with interest at the rate of 9.25\ per annum
(hereinafter the "Note"). A copy of the Note is attached hereto as
Exhibit "A" and incorporated herein by reference.
5. On November 10f 1994, the Resolution Trust Corporationf
as Receiver for Carteret Savings Bank assigned the Note and the
Mortgage to Plaintiff by written assignment which was recorded in
the Office of the Recorder of Deeds of Cumberland CountYf
Pennsylvania. There has been no further assignment of said
Mortgage.
6. The premises subject to the Mortgage is described as
follows:
All that certain tract or parcel of land and premisesf situatef
lying and being in the Borough of Shiremanstown in the County of
Cumberland and Commonwealth of Pennsylvania, more particularly
described as follows:
BEGINNING at an iron pin on the North side of Green Street at the
corner of lands now or late of Walter E. Hartman, et ux; thence
along lands now or late of Walter Hartman, et UX'f North 9 degrees
West, a distance of 197.6 feet more or lessf to an iron pipe on the
South side of Courtland Alley; thence by the South side of
Courtland AlleYf South 77 degrees 45 minutes West, a distance of
50 feet, more or less, to an iron pipe; thence along lands now or
late of Herman E. Price, et UX., South 9 degrees Eastf a distance
of 197.6 feetf more or less, to a stake on the North side of Green
Street; thence by the North side of Green Street, North 81 degrees
15 minutes Eastf a distance of 50 feet to an iron pin, the Place
of BEGINNING.
HAVING THEREON ERECTED a single one and one-half story frame
dwelling known as No. 21 West Green Streetf Shiremanstown,
Pennsylvania.
which has the address of 21 West Green Streetf Shiremanstownf
Pennsylvania 17011.
7. The Mortgage is in default because of the Defendants I
failure to make the payments due since April 1f 1992 and the
following amounts are due on the Mortgage:

Interest from 5/1/92 through 8/25/95
at $9.55 per day
Late charges from 5/1/92 through 8/25/95
at $13.16 per month
Attorney's fees (10\ of balance due)

the sum of $54,731.84.

to the Complaint.

dated December 16, 1985 and that the original principal amount was
$40,000.00 and that monthly installments were payable to Homestead
Savings Association, Denied that the interest rate on the note was
9,25' per annum, Rather the note was an adjustable rate note,
Admitted that a copy of the Note was attached as Exhibit "A",
5, Denied, After reasonable investigation the defendants
are without knowledge or information sufficient to form a belief as
to the truth of this averment, By way of further answer if an
assignment did occur the defendants were not given proper notice as
required by law,

7, Denied that defendants are in default, It is denied that
defendants owe attorney fees, late charges or interest on the
Mortgage,
After reasonable investigation the defendants are
without knowledge or information sufficient to form a belief as to
the truth of the averment that they owe $54,731,84, By way of
further answer defendants were notified by Homestead Savings or an
agent thereof to cease monthly payments and were never notified by
Plaintiff or any other party to resume payments, No notice of
default was ever given as contemplated by the note,

8, At no time since Homestead Savings last contact were
defendants advised as to where to forward their monthly payments,
9. Since Homestead Savings last contact Defendants have not
been notified of the annually adjusted interest rate or the
properly calculated monthly obligation,
10, Defendants remain willing and able to resume their
monthly obligations if they are advised as to the proper payee, the
correct amount and an address to forward their monthly payment,
WHEREFORE, the plaintiff's complaint should be dismissed,
