Plaintiff was inBtructed by his superior to expend his own monies for equipment ~nd supplies necessary to perform Defendant's contracts when no petty cash was available. 8. Plaintiff was orally promised that the monies expended on behalf of Defendant would be repaid upon receipt of the petty cash checks from Defendant. 9. Based upon the oral representation made to him by Defendant, Plaintiff expended $1,068.57 of his own monies for equipment and supplies necessary to fulfill Defendant's contracts SOlely for the benefit of Defendant. 10. A petty cash check, number 7005, was issued on June 22, 1995, in the amount of $468.95 payable to cash, drawn on Defendant's account with Meridian Bank. 11. Plaintiff cashed Baid check which was returned due to non-sufficient funds in Defendant's account. Plaintiff was required to "buy back" the check and charqed an additional $20.00 return check fee which Plaintiff paid with his own funds. 12. Defendant, by and throuqh Plaintiff's superiors, orally promised Defendant 13. Plaintiff has not been reimbursed for funds expended for the benefit of Defendant. CIVIL ACTION - LAW GOLD BOND MANAGEMENT SERVICES, INC. Defendant DEFENDANT'S ANSWER AND NEW HATTER TO PLAINTIFF'S COMPLAINT Defendant Gold Bond Management Services, Inc. ("Gold Bond"), by its undersigned attorney, hereby *esponds to the plaintiff's Complaint, as follows: 1. Denied. Gold Bond lacks knowledge or information sufficient to form a belief as to the truth of the allegation concerning the plaintiff's present whereabouts, denies same, and demands strict proof thereOf, if relevant, at trial. 2. Denied. Gold Bond denies that it is a Pennsylvania corporation that transacts a sub.tantial amount of busine.s at the alleged address, and avers to the contrary that it is a Maryland corporation that does not transact any business at that address. 3. Denied. Gold Bond denies that plaintiff was employed as a service manager by Gold Bond during the period alleged, and avers to the contrary that plaintiff has never been employed by Gold Bond. 4. Gold Bond incorporates herein by reference its responaes to paragraphs 1-3 of plaintiff's Complaint. 5. Denied. Gold Bond denies that plaintiff was required to expend monies on behalf of Gold Bond, and avera to the contrary that plaintiff never expended money on behalf of Gold Bond. By way of further answer, upon information and belief, at various times plaintiff expended monies ~rom a petty cash fund on behalf of his formar employer, Gold Bond Management Services, CPA, Inc. ("CPA"). By way of further answer, upon information and belief, plainti~f took monies from the CPA petty cash fund without accounting for those monies. 6-9. Denied. Gold Bond denies the allegations in paragraphs 6-9 of plaintiff's Complaint, and incorporates herein by reference its answers to paragraphs 1-5 of plaintiff'S Complaint. - 2 - 10. Denied. To the contrary, it is clear on the tace at the alleged check that it is a CPA check, not a Gold Bond check. 11. Denied. Gold Bond denies that the alleged check was a Gold Bond check, and incorporates herein by reterence its answer to paraoraph 10 of plaintiff's Complaint. Gold Bond lacks knowledge or information sufficient to to~ a beliet as to the truth of the remaining allegations in paragraph 11 of plaintiff's Complaint, denies same, and demands strict proof thereof, if relevant, at the time at trial. 12. Cenied. This allegation is incomprehensible, and theretore Gold Bond denies same. 13. Denied. Gold Bond denies that plaintitt has not been reimbursed tor tunds expended for the benefit of Gold Bond, and incorporates herein by reterence its answer to paragraphs 1-13 of plaintiff's complaint.
