Plaintift is Kingsbury Associates, a Pennsylvania general partnership, with its principal place ot business located at 2920 Dickinson Avenue, Camp Hill, Pennsylvania 17011. 2. Detendant is Charles Connor, an adult individual, residing at Lot NO.5, Kingsbury Mobile Home Park, 5169 East Trindle Road, Mechanicsburg, Pennsylvania 17055. 3. Plaintift, Kingsbury Asaociates, is the record legal owner ot certain real eatate being improved with a mobile home park, being known a. Kingsbury Mobile Home Park, same being situate in Hampden Township, CUlIIberland County, Pennsylvania, having been acquired by Deed dated August 10, 1992 and recorded September 11, 1992 in the Cumberland County Recorder ot Deeds office in Deed Book "Wit, Volume 35, Page 610, same being bounded and described as follows I ALL THAT CERTAIN TRACT ot ground situate in Hampden Township, CUmberland County, Pennsylvania, bounded and described in accordance with a survey dated August 17, 1992, Survey Book No. 1007, ot Hartman and Associates, Inc., as follows: BEGINNING at a point in the center line of the Trindle Road, at the line ot land now or late of Marlin Bretz, said point being located 200 f..t more or lees North East of the center line of Shssly Lan., th.nc. from said Point of Beqinninq, by land now or late of Marlin Br.tz, land now or late of William D. Hornberqer, land now or lat. of Wilson A. Ebert, and land now or late of Monroe J. SAID PREMISES havinq thereon erected a two (2) story frame dwellinq and garaqe and beinq known and numbered as 5169 Trindle Road, Mechanicsburq, Pennsylvania, and a thirty-two (32) pad mobile home park. A copy of the Deed is attached hereto, marked Exhibit "A" and incorporat.d herein. 4. Plaintiff, Kinqsbury Associates, acquired an immediate riqht to po.....ion of the premises by virtue of the August 10, 1992 deed a. r.ferred to in Paragraph No. 3 hereinabove, said being recorded in the CUIIb.rland County Recorder of Deads office in Deed Book "W", Volume 35, Page 609. 5. Defendant, Charles Connor, currently resides in a mobile home located on Lot No.5, Kingsbury Mobile Home Park, said lot being situated on Plaintiff's real property as described in Exhibit "A". 6. Defendant, Charles Connor, is currently the equitable and/or legal owner of the mobile home located on Lot No.5, KingSbury Mobile 2 Ho.. P.rk, .aid lot being .Uuated on P1aintift I s real property a. de.crib.d in Exhibit "A". 7. Detendant, Charle. Connor, was provided with a written 1.... .gr....nt, park ru1.. and regulations by P1aintitt as more particularly d..crib.d in Exhibit "8". 8. Det.ndant, Char1e. Ccnnor, has continuously and periodically b..n lat. in paying hia rent in the amount ot $220.00 per month in accordanc. with the 1.a.e agreement and park rules and regulations, CO~ I. .VICTIO~ 9. Paragraphs 1 - 8 are hereby incorporated by reference. 10. On or about November 30, 1995, P1aintitf sent Defendant Char1.. Connor an .viction notice by certitied mail advising Detendant ot vio1.tion. of Park Ru1.. No. 3 tor failing to pay rent payment. in a ti.ely fa.hion in accordance with the lease agreement, and turth.r advi.ing Detendant that eviction proceedings would be initiated in the eVent the r.nt was not paid within thirty (30) days. A copy ot the 1.tt.r i. attached hereto aa Exhibit "C". 11. On or about November 30, 1995, Plaintiff sent Defendant Char1e. Connor a letter by certitied mail advising Defendant ot violations ot Park Rul.. No. 35 and 36 tor tailing to abide by park rules pertaining to the k.eping and registration of pets in the mobile home park, turther advi.ing Detendant that eviction proceedings would be initiated in the 3 .v.nt the violation. w.re not corrected within thirty (30) day.. A copy of the l.tt.r is attached hereto as Exhibit "C". 12. Defendant accepted service of the November 30, 1995 certifi.d l.tt.r on or about December 4, 1995. 13. Defendant haa repeatedly and continuously refused to pay rent to Pl.intiff in a timely fashion and to properly register and maintain p.t. in the mobile home park. 14. Defendant was previously advised of violation of Park Rul.. No. 3 conc.rning the late payment of rent. 15. Defendant did not pay Plaintiff for rent in accordance with the 1.... and park rul.. and regulations from November 1995 through the pr...nt date and continues to fail to pay rent in timely a faahion, WHEREFORE, Plaintiff respectfully requests that this Honorable Court .vict Def.ndant from the mobile home park, enter jud9lllent again.t Def.ndant and in favor of Plaintiff, and direct that Def.ndant i...di.t.ly vacat. the trailer located at Lot No. 5 and award Plaintiff .on.y damag.. and loat profits in an amount in excess of seven hundr.d fifty ($750.00) dollar. for late rent. WHEREFORE, Plaintiff respectfully requests that this Honorable Court, enter judqment against Defendant and in favor of Plaintiff, and direct that Defendant immediately vacate the trailer located at Lot No. 5 and award Plaintiff money damages and lost profits in an amount in exce.. of .aven hundred ($750.00) dollara for late rent. A. a result of maintaining a mobile home on Plaintiff'. pr.mi... as s.t forth herein, Defendant has deprived Plaintiff, Kingabury A..ociat.., of the profits derived from the reasonable use and rental of Plaintiff'. property. 22. Plaintiff has notified Defendant to vacate the property for failing to pay rent in timely fashion. 5 WHEREFORE, plaintiff, King.bury Associates, requeat. that this Honorabl. Court enter judgment against Defendant and in favor of Plaintiff, dir.ct that D.fendant immediately vacate the trailer locat.d at Lot No. 5 and award Plaintiff money damages and lost profits in an a.ount in .xces. of .even hundred fifty ($750.00) dollars. Defendant has not executed a new lease over that portion of Plaintiff's property described as Lot No, 5 in the Kingsbury Mobile Hom. In addition, Kinqsbury Associates submitted an eviction notice to Detendant Connor tor non-paymsnt of rent in July ot 1995. 5. As set torth in paraqraphe 8, 13, 15, and 18 of Defendant '.
