3. Defendant Richard M. Singer is, upon information and
belief, the general partner of Defendant Stonehedge Square, Limited
Partnership, which is believed to be a Maryland limited partnership
with a place of business as set forth in the caption.
4. At all times relevant hereto, Defendants Richard M.
Singer and Stone hedge Square, Limited Partnership, owned, operated,
possessed and controlled a shopping center in CarliSle,
Pennsylvania in which Plaintiff was a tenant and was Plaintiff's
landlord, renting a certain commercial property for the use and
occupancy of Plaintiff pursuant to the lease which is attached
hereto and incorporated herein as Exhibit "A."
5. Defendant R. M. Singer' Associates is, upon information
and belief, a corporation organized and existing under the laws of
the State of Maryland with a place of business as set forth in the
caption.
6. At all times relevant hereto, Defendant R. M. Singer'
Associates, operated, managed and controlled the aforementioned
shopping center located in Carlisle, PA in which Plaintiff was a
tenant for the benefit and on behalf of Defendants Richard M.
Singer and Stone hedge Square, Limited Partnership.
7. Defendant R-Gee Contracting, Inc. and Robert G.
Derrickson, Sr. are, upon information and belief, a business
corporation organized and existing under the laws of the

Commonwealth of Pennsylvania and/or a sole proprietorship trading
and doing business as R-Gee Contracting respectively, with
addresses as set forth in the caption.

At all times relevant hereto,
Defendants R-Gee
Contracting, Inc. and Robert G. Derrickson, Sr. operated,
controlled, managed and were engaged in a general construction
business which performed construction work at the aforementioned
shopping center for the benefit of and under contract and agreement
with Defendants Richard M. Singer, Stonehedge Square, Limited
Partnership, and R. M. Singer & Associates.
9. At all times material hereto, each defendant acted by and
through their respective employees, agents, servants, and/or
workman, each of whom was acting in the course of his or her
employment and within the scope of his or her authority, subject to
their control and direction and for the benefit of his or her
principal, and/or employer, the respective defendants herein.
10. Prior to January 17, 1994, Defendants R-Gee Contracting,
Inc. and/or Robert G. Derrickson, Sr. had constructed, improved or
otherwise modified a commercial lease space located in the
aforementioned shopping centel' adjacent to the space leased by
Plaintiff, including, but not specifically limited to, plumbing
work, under agreement and at the request of Defendants Richard M.
Singer, Stone hedge Square, Limited Partnership and/or R. M.
Singer & Associates.

11. On or about January 17, 1994 a water pipe which Defendant
R-Gee Contracting, Inc. and/or Robert G. Derrickson, Sr. had
previously constructed, installed, modified and/or maintained burst
due to freezing conditions in the aforementioned commercial lease
space adjacent to the space leased by Plaintiff from Defendants
Richard M. Singer, Stonehedge Square, Limited Partnership, and
R. M. Singer & Associates.
12. The commercial lease space where the water pipe burst was
unoccupied and unheated and/or the space and pipe were allowed to
be in such a condition that the water pipe burst from freezing, due
to the acts or failure to act of all Defendants.
13. The aforementioned burst water pipe resulted in
substantial damage to Plaintiff's personal property located in
their commercial space and loss of business income.
14. The aforesaid property and other damage was directly and
proximately caused by all Defendants as further and more fully
described below.
COUNT I - NEGLIGENCE
HERMIS , ASSOCIATES, INC., d/b/a KWIK-KOPY PRINTING
v. RICHARD M. SINGER, R.M. SINGER' ASSOCIATES,
and STONEHEDGE SQUARE, LIMITED PARTNERSHIP
15. Paragraphs 1 through 14 are hereby incorporated as though
fully set forth herein.
16. The aforementioned property damage and loss of business
income suffered by Plaintiff was the direct and proximate result of

the negligence, carelessness, recklessness and/or other liability
producing conduct of Defendants Richard M. Singer, R. M. Singer &
Associates and Stonehedge Square, Limited Partnership, by and
through their servants, employees, and/or agents, including
negligent acts and/or omissions, more specifically described as
follows I
(a) Carelessly and negligently failing to exercise
reasonable care in the operation and management of their
property/
(b) carelessly and negligently falling to adequately
instruct their employees as to the proper care, maintenance,
operation and inspection of the subject premises, including
any and all unoccupied or vacant spaces/
(c) Carelessly and negligently failing to observe,
detect, inspect for and warn its tenants of the conditions
which resulted in the burst water pipe and water damage
resulting therefrom/
(d) Carelessly and negligently failing to provide,
establish, implement and/or follow proper and adequate
controls so as to insure the safety and integrity of all water
pipes so as to prevent them from bursting and/or freezing/
(e) Carelessly and negligently failing to maintain its
property in conformity with the prevailing industry and
governmental specifications and standards and violating the

standards of care prescribed by statutes, rules, regulations,
ordinances, codes and industry customs applicable to this
actionl
(f) carelessly and negligently failing to design,
construct, fabricate, install, inspect and/or maintain the
subject water pipe so as to prevent it from bursting and/or
freezingl and
(g) Carelessly and negligently failing to properly hire
competent agents, servants and/or employees to design,
construct, fabricate, install, inspect or maintain the subject
water pipe.
17. As a direct and proximate result of the aforesaid
negligence and/or other liability producing conduct of Defendants
Richard M. singer, Stonehedge Square, Limited Partnership, and
R. M. Singer & Associates, Plaintiff sustained damage to its
personal property and loss of business income in the amount of
$33,922.38.
WHEREFORE, Plaintiff demands judgment in its favor and against
Defendants Richard M. singer, stonehedge Square, Limited
Partnership, and R. M. singer & Associates, in the amount of
$33,922.38, plus interest, costs of suit and delay damages as
allowable by law.

COUNT II - BREACH OF CONTRACT

18. Paragraphs 1 through 17 are hereby incorporated as though
fully set forth herein.
19. By reason of the foregoing conduct of Defendants
Richard M. Singer, Stone hedge Square, Limited Partnership, and
R. M. Singer & Associates in causing Plaintiff to suffer the
aforementioned damages, Defendants Richard M. Singer, Stonehedge
Square, Limited Partnership, and R. M. Singer & Associates breached
their lease contract with Plaintiff.
20. As a result of the aforementioned breach of contract,
Plaintiff has suffered the damages as previously set forth.
21. Plaintiff had and has performed all conditions precedent
to recovery based upon the aforementioned breach of contract.
WHEREFORE, Plaintiff demands judgment in its favor and against
Defendants Richard M. Singer, Stonehedge square, Limited
Partnership, and R. M. Singer & Associates, in the amount of
$33,922.38, plus interest, costs of suit and delay damages as
allowable by law.
COUNT III - NEGLIGENCE

23. The aforementioned property damage and loss of business
income suffered by Plaintiff was the direct and proximate result of
the negligence, carelessness, recklessness and/or other liability
producing conduct of Defendants R-Gee Contracting, Inc. and
Robert G. Derrickson, sr., by and through their servants,
employees, and/or agents, including negligent acts and/or
omissions, more specifically described as follows:
(a) Carelessly and negligently failing to design,
construct, fabricate, install, inspect, test and/or maintain
the aforementioned water pipe and/or components thereof in
conformity with prevailing industry and governmental
specifications and standards and violating the standards of
care prescribed by statutes, rules, regulations, ordinances,
codes and industry customs applicable to this actionl
(b) Carelessly and negligently failing to design,
construct, fabricate, install, inspect and/or maintain the
subject water pipe and/or components thereof so as to prevent
it from bursting and/or freezingl and
(c) Carelessly and negligently failing to properly hire
competent agents, servants and/or employees to design,
construct, fabricate, install, inspect or maintain the subject
water pipe.
24. As a direct and proximate result of the aforesaid

R-Gee Contracting, Inc. and Robert G. Derrickson, Sr., plaintiff
sUrJtained damage to its personal property and loss of business
income, and other additional expenses in the amount of $33,922.38.
WHEREFORE, plaintiff demands judgment in its favor and against
Defendants R-Gee contracting, Inc. and Robert G. Derrickson, Sr.,
in the amount of $33,922.38, plus interest, costs of suit and delay
damages as allowable by law.
COUNT IV - BREACH OF CONTRACT/THIRD PARTY BENEFICIARY
HERMIS' ASSOCIATES, INC., d/b/a KWIK-KOPY PRINTING
v. R-GEE CONTRACTING, INC. and ROBERT G. DERRICKSON, SR.
25. paragraphs 1 through 24 are hereby incorporated as though
fully set forth herein.
26. plaintiff was a third party beneficiary of a contract
between the owners and managers of the subject property, Richard M.
Singer, Stonehedge square, Limited Partnership and R. M. Singer &
Associates, and their contractor, R-Gee contracting, Inc. and/or
Robert G. Derrickson, Sr., for the design, construction,
fabrication, installation, inspection and maintenance of the
subject water pipe.
27. As a result of the aforesaid actions and failures to act,
Defendants R-Gee Contracting, Inc. and/or Robert G. Derrickson,
Sr., have breached their contract with the remaining Defendants.
28. As a result of the aforementioned breach of contract,

Preliminary Objections to the Complaint of Hermis & Associates for
the reasons set forth below:
1. Attached hereto is a true and correct copy of the Writ of
Summons which was served upon the answering Defendants by the Sheriff
of Cumberl~nd County. The Writ is addressed to the non-answering
Defendants, not to the answering Defendants. The answering
Defendants have never been served with original service of process.
Therefore, this Court lacks subject matter jurisdiction over this
matter.
2. The Plaintiff's Complaint is not verified by Plaintiff. It
is instead verified by an attorney verification. In Pennsylvania,
Complaints must be verified by a party and an attorney verification
is not adequate as a substitute.
