NCM, T1IEffi:FOIlE, in consideration of this Postnuptial Agrce-
IOOnt, and of the mutual prOOlises, covenants, and undertakings set
forth herein, the parties hereto, each intending to be le<Jally bound,
hereby agree as follows:
1. Personal Property,
Husband and Wife aCJree that their personal property, includ-
ing their household furnishings, has been divided to the satisfaction
of both parties, and that Husband and l'life shall each retain as their
sole and separate property such personal property as they now possess.
Husband and l'life each agree to sign, upon request ilnd after execution
of this Agreement, any titlea or other docurronts reasonably necessary
to give effect to this Section.
2. Real Property.
Husband and l'life ~n jointly the marital residence, cur-
rently occupied by l'life and the parties' minor child, and located at
3026 Logan Street, Camp Hill, Cumberland County, Pennsylvania.
Husband and l'life aCJrCle that, upon the pilrties' e.,<ecution of
this Agreement, the marital residence, including specifiClllly but
without limitation all of the p<lrties I equity therein, shall becaro
the sole property of wHe alone, and l'life shall assurro sole reflpon-
sibility for the pilyrnent of the mortgag<! on the

5. CUstody /lntl Visitation.
'rhe p.lrtillS are the parents of one minor child, Tess
Caroline f'rancos Hiller, born June 19, 1994 ("Child" herein). The
Child currontly ronidos with I~if(!. l~ifo shall have primary physical
cu!ltody of tho Child, and Husband nhall have p.lrtial physical custody
of the Child for the purpose of visitation. Husband and Wife shall
share joint legal custody of the Child.
Thll parties ackn~~ledge and agree that it is in the Child's
best interest to maintain regular and close contact \~ith Husband.
Husband 5hall hav,) physical custody of the Child at such
times as Husband and I~ife mutually agree, but not less than one
evening a week and every other weekend.
Husband and Wife agree to provide each other with their
current address and hane and employment telephone numbers, and to
advise each other of any change thereof at least ten (10) days prior
to the effective date of such change.
In the event that the Child is ever seriously ill, the party
then having physical custody of the Child shall inn1e<liately notify the
other party of both the fact that the Child is ill and the nature of
her illness. During the period of her illness, each party shall have
the right to visit tlle Child as often as he or she desires, consistent
with her proper medical card.
'rhe parties ackn~~ledge and il<Jree that when Tess is of
school age she will attend the schools operated and maintained by or
on behalf of the Roman Catllolic Church.

6. (II) SuPPOrt of I'/i fo.
HusbiUld agrees to pay I~ife alimony in the ilIllOunt of $400.00
per rronth each rronth for four years, b..."ginning on the date of this
lIgreellEnt and terminating in September :WOO. Husll<lnd shall pay the
rronthly alirrony pilYfOOnt on or before the 1st day of each rronth.
Husband's obligation to pay \~ife alirrony will terminate upon tho death
of either Husband or Wife, or the remarriage of Wife.
6. (B) Support of Child.
Each of the pilrties agrees to provide support for the Child
in accordance with the requireroonts of Pennsylvania law and the
guidelines set forth in the PennsylviUlia Rules of Civil Procedure,
taking into consideration the financial ability of each pilrty, the
Child's needs, and the extent to which the Child is self-supporting.
Husband and Wife agree that Husband will pay I~ife $350.00
per rronth for child support until September 2000. Husband shall pay
the rronthly child support payment on or before the 15th day of each
month. Starting in October 2000, Husband will pay child support as
required by the guidelines set forth in the Pennsylvania Rules of
Civil Procedure.
Husband and Wife olgree that l~ife shall be entitled to claim
the Child as a dependent for federoll, stolte, and local incaoo tax
pUrposes for 1996 and all future years, for so long as IUfe retains
primary physical custody of the Child.
HusbiUld shall provide health insurance coverage for the
Child.

Husband and I~ifl.! a'.lroo to share equally any medical, dental,
and/or eye care expenses for the Child not cove roo by insurance.
Husb.lnd and \~ifu agree that Husband will muintain life
insurance cuverage on his own lifu in tJ1Q annunt of at least two
hundred fifty thousand dollars ($250,000.00), designating as the
beneficiary thereof '1'ess Caroline I.'rances ~liller or a trust estab-
lished for her benefit, at least until '1't."!l3S attains the age of t~nty-
one (21) years. 'l'he life insurance purchased by Husband pursuant to
this paragraph shall be the kind of life insurance that accumulates a
cash value over time. l'illen Tess attains the age of twenty-one (21)
years, Husband shall cash in the life insurance ,lnd givo the full
iII110unt of the proceeds to '1'oss. Husband shall assume sole respon-
sibility for any tilXes due on the proceeds received fran cashing in
the life insurance, and for any gift t~~ liability that may arise f~
giving the full iII110unt of the proceoos to 'l'ess. Husband shall pur-
chase the afororrentioned lif.! insurance coverage on or before December
31, 2000.
7. Husband's Release.
Husmnd does hereby release, remise, quitclaim, and forever
discharge \~ife itnd the Estate of \~ife from any and all claims that he
now has or may hereafter have against Wife, or in, to, or against her
Estate or any part thereof, whether urising out of any fomer con-
tracts, agreem3nts, enga<Janents, or liabilities of l~ife, or by way of
dower or claim in the n,lture of d()\'lUr, spouse' 0 right or under any
intestato laws or the l"ight to take a'lainst \~ife' s
Will, or for

divorce proceeding or support procet.>ding, and specifically agree thilt
the provisions of this Agreement relilting to the division of marital
property constitute an equituble distribution of said property as
contemplated by the Pennsylvania Divorce Code.
13. Disclosure of Assets.
Husband and Ivife each acknowledge that under the Pennsyl-
vania Divorce Code tllOY were entitlL>d to obtain discovery and disclo-
sure fran the other spouse of all of that spouse's assets and liabil-
ities, and inCOloo and expenses, and that they havo voluntarily waived
this disclosure in entering into this Agrcoel1l\.)nt.
14. Representation by Attorneys.
Husband and Ivife both acknowledge that they have had the
opportunity to have an attorney of their choice explain the Pennsyl-
vania Divorce Code to them, and explain to tllen1 the looaning and
ramifications of each of the Paragraphs herein, and that, by executing
this Agreement, both parties ar~ executing this document of their own
free will and without pr~ssuro frClTl their attorneys, the other party,
or anyone else.
15. Lm~ of Agreanont.
'l'his Agreemnt shall be construed according to the laws of
the Carrnonwoilltll of Pennsy1v'lnia.

16. ~bdification
No rrodification of this Postnuptial IIgrcement shall be
effective unless emI:xxlied in a written instnunent executed bl' the
parties hereto. 'l'his Po"ltnuptial Agreement 9hall not be deemed to
constitute a condonation by either party of any act on the part of the
other, whether occurring prior or "lubsequent to the parties I sepa-
ration fran each other or execution of this Postnuptial IIgreanent.
17. Incorporation and Non-Mdrger of Agrcerrcnt.
'l'his Agreement shall be sul:xnitted to the Court having
jurisdiction over the divorce action between Husband and Wife, with
the request that this Agreement be incorporated into any decree of
divorce issued by said Court, and be made part of said decree and ,lny
judgment thereon, with jurisdiction remaining in the Court to see that
the terms hereof are canplied with, it being understood that the
IIgreement will survive the decree of divorce and not be merged into
it. The parties agree and intend that incorporation is for the
purpose of enforcement only, and not for any modification of the terms
hereof.
lB. Entire AgreelOOnt.
This Postnuptial AgreelllJnt constitutes the entire under-
standing of the parties, and there are no terms, coven,lnts, con-
ditions, representations or agreslOOnts, oral or written, of any
nature, other than those herein contained.

19. Invalid Provisions.
If any term, condition, clause or proviRion of this Post-
nuptial Agreement shall be detennin(!(! or declared to be void or
invalid in law or otherwise, then only that tcm, condition, clause or
provision shall be atricken frCln the Agrcement, and in all other
respects the !\greerrent shall bc valid and continue in full force,
effect and operation. Likewine, the failurc of any party to lneat his
or her obligations under anyone or more of the paragraphs herein,
\~ith the exception of the satisfaction of the conditions precedent,
shall in no way void or alter the remaining obligations of the
parties.
20. Captions.
The captions, paragraph munbers, and index appenring in this
Postnuptial Agreement ,1m inserted only as a matter of convenience and
in no way define, limit, construe, or describe the scope or intent of
such paragraphs, nor in any way affect this instrlll11ent.
