AND NOW, comes the Claimant in the above-captioned matter by its attol ney,
William R Bunt, Esquire, and respectfully sets forth as follows:

ANSWER TO MOTION TO STRIKE MECHANICS' LIEN CLAIM FOR
FAILURE TO COMPLY WITH SECTION 1502121 OF THE MECHANICS' L1EN,18YY
2, Owners' paragraph 2 is a conclusion of law and no answer to the same is
required,
3, Admitted in part and denied in part, It is admitted that the Notice 0': Filing
did contain an inadvertent error as to the address of the property, By way of furt:,er
answer, the correct address and deed description was incorporated by referenct! to the
Claim attached to the Notice of Filing, The Mechanics' Lien Claim was served <I the
same time as the Notice of Filing, In addition, the Sheriffs Return indicates tha',

The Notice of Intention to File a Mechanics' Lien Claim was served on October 6, 1995
and included the correct property description,
4, Denied To the contrary, the deed attached to the claim and the claim
itself provided an accurate description of the property in compliance with applicable
law,

5, Owners' paragraph 5 is a conclusion of law and no answer to the !lame is

8. Admitted in part and denied in part, It is admitted that the date of fling is
more than four (4) months after the completion of the work, It is specifically der ied
that the same was defective as a result thereof, By way of further answer, the delay in
filing was a direct result of the Owners' repudiation of an Agreement enterad intr.,
between Claimant and Owrers by and through their Attorney at that time, Michael J,
Hanft, Esquire, Said Agreement was reached on December 5, 1995 and provided for
the payment by the Owners of ten thousand dollars ($10,000,00) in complete
settlement of all claims made by Juniata Lumber and Supply Company, Inc, aga:nst
Owners, Claimant's delay in filing was a direct result of the Settlement Agreement
reached less than two (2) weeks before the expiration of the four (4) month time limit

6, The nature and kind of materials furnished were lumber and building supplies,
7, The amount claimed to be still due and chargeable against the property is
$11,722,53, being the balance owed on the agreed-on contract price, The claimant
has no note or other collateral security for his claim,
8, The first materials were furnished by the claimant on July 19, 1995 and the last
materials were furnished on August 17,1995,
9, Written notice of the intention to file this claim was duly served on the owner on
October 6, 1995 by certified mail, Copies of said Notices are attached hereto,
incorporated herein, and marked as Exhibit .C',
10, This lien is claimed from July 19, 1995, when materials were first delivered, and
against the fee simple interest of the owners in the property,
11, That pursuant to Agreement of counsel for Claimant and Michael J, Hanft
Esquire, counsel for Owners, filing of the within claim was withheld pending ree;'2ipt of
payment of an agreed upon amount
12, Payment of said sum has not been made and, accordingly, the within claim is

PRELIMINARY OBJECTIONS TO THE MECHANIC'S LIEN
CLAIM or JUNIATA LUMBER AND SUPPLY COMPANY. INC.
1. Claimant filed its Mechanic's Lien Claim on or about
January 18, 1996.
MOTION TO STRIKE MECHANIC'S LIEN CLAIM FOR FAILURE
TO COMPLY WITH SECTION 150212\ OF THE MECHANIC'S LIEN LAW
2. section 1502(2) of the Mechanic's Lien Law, among other
things, requires the Claimant to serve written notice of the filing
of its mechanic's lien upon the Owner.
3. The Notice of Filing of Mechanic's Lien Claim served by
the Claimant upon the Owners states that the lien filed is against
the property at 11 Shirley Lane, Boiling Springs, Pennsylvania
17017.
. .
4. The aforesaid description of the property is an
inaccurate description of the property. In fact, improvements were
actually made on a different property. Therefore, Claimant's
Notice of Filing of Mechanic's Lien Claim is defective on its face.
Such a defect renders the attempted notice ineffective. Therefore,
Claimant's Mechanic's Lien Claim is defective for failing to comply
with section 1502(2) of the Mechanic's Lien Law and, as such, it
must be stricken.

5. Saction 1502(a)(1) of the Mechanic's Lien Law requires
the claimant to file its mechanic's lien claim within four (4)
months after the completion of its work.
6. The Mechanic's Lien Claim filed by the Claimant states
that it last furnished materials on August 17, 1995. (See
paragraph 8 of Claim.)
7. Claimant's Notice of Filing of Mechanic's Lien Claim
states that its lien claim was filed on January 18, 1996.
8. The date on which the Claimant filed its lien (January
18, 1996) is more than four (4) months after it completed its work.
Therefore, Claimant's Mechanic's Lien Claim is defective on its

1, Plaintiff, JUNIATA LUMBER AND SUPPLY COMPANY, INC" is a
Pennsylvania corporation with an address at Parker and Juniata Streets, Mifflin, Juniata

respectfully request this Court to dismiss Plaintiff's Complaint.

Paragraphs one (1) through five (5)
above are
incorporated herein by reference as if fully set forth.
7. It is believed, and therefore averred, that not all
materials set forth in the invoices of Plaintiff and charged to
Defendants were actually used in the construction of Defendants'
home.
8. It is believed, and therefore averred, that many of the
materials set forth in Plaintiff's invoices and charged to
Defendants were actually used and incorporated into homes other
than Defendants'.
9. Under the Mechanics' Lien Law, the Plaintiff was required
to file its Mechanics' Lien Claim on or before the expiration of

four months from the date on which it last supplied materials to
the project.
10. The Plaintiff has failed to file its Mechanics' Lien
Claim within four months from the date on which it last supplied
materials to the Defendants.
11. Plaintiff's Complaint and underlying Mechanics' Lien
Claim is barred by the four month statute of limitations set forth
in the Mechanics' Lien Law.
12. The Logans did not prevent the Plaintiff in any way !rom
filing its Mechanics' Lien Claim within the four month limitation.
13. Plaintiff's Complaint fails to set forth a cause of
action upon which relief can be granted.
14. It is believed, and therefore averred, that Plaintiff has
received payment for at least a portion of what it currently claims
from the Defendants.
15. It is believed, and therefore averred, that Plaintiff
supplied the last of its materials to the Logans before August 17,
1995.
16. Plaintiff has failed to mitigate its damages.
17. It is believed, and therefore averred, that Plaintiff
failed to properly credit all payments received from Sherman

Hostler, or Hoetler Homes, which would reduce the amount claimed by
Plaintiff to be owed by Defendants.
18. Defendants are entitled to set-off amounts paid to
Juniata but not properly credited by Juniata.

20. The Mechanics' Lien Claim of Juniata, the Preliminary
Objections of the Logans thereto and the Answer of Juniata to the
Preliminary Objections of the Logana are incorporated herein by
reference as if fully set forth.
21. Juniata filed its Mechanics' Lien Claim on or about
January 18, 1996, a date more than four months after Juniata
supplied the last of its materials to the Logans' home.
22. The Lagans filed preliminary Objections to the Mechanica'
Lien Claim alleging, among other things, that Juniata's Mechanics'

Lien Claim should be stricken/dismissed because it was filed
untimely (i.e. beyond the four month limitation .et forth in the
Mechanics' Lien Law).
23. Juniata, through its counsel, alleged in its Answer to
the Logans' Prel iminary Obj ections that an agreement to settle
Juniata's claim was entered into between its counsel and the
Logan's previous attorney, Michael J. Hanft, Esquire (hereinafter
"Attorney Hanft").
24. As a result of the alleged settlement agreement, Juniata
now claims that it should be excused from its untimely filing of
the Mechanics' Lien Claim and that the Logans should be estopped
from asserting the untimely filing of Juniata's Mechanics' Lien
Claim.
25. No settlement agreement was entered into between Juniata
and the Logans.
26. Attorney Hanft was never authorized by the Logans to
settle the claim asserted by Juniata.
27. No written agreement exists between the Logans and
Juniata regarding settlement of Juniata's claim.
28. Attorney Hanft failed to obtain authority from the Logana
before offering to settle Juniata's claim against the Logans.

29. Any and all alleged sectlement agreements between the
Logans and Juniata are invalid and not binding as to the Logans.
30. As the Logans I attorney at the time of the alleged
settlement agreement, Attorney Hanft owed the Logans a duty not to
make offers to settle claims against them without prior
authorization from the Logans.
31. Attorney Hanft breached his duty to the Logans not to
make offers to settle claims against them without obtaining prior
authorization from the Logans.
32. The above actions of Attorney Hanft constitute
professional negligence.
33. The above actions of Attorney Hanft constitute a
violation of Rule 1.4 of the Rules of Professional Conduct.
34. consequently, Attorney Hanft is either:
(a) solely or primarily liable to Juniata on all or part
of its claim asserted in the Complaint of Juniata;
(b) jointly or severally liable with the Logans on all
or part of the claims asserted in the Complaint of Juniata;
(c) liable over to the Logans by way of contribution
and/or indemnification for all or part of the amount of such

9, Denied, The within action was filed In a timely manner.
10. Admitted in part and denied in part. It is admitted that the date of filing is more
than four (4) months after the completion of the work. It is specifically denied that the filing of
the same was defective as a result thereof. By way of further answer, the delay in filing was a
direct result of the Defendants' repudiation of an Agreement entered into between Plaintiff and
Defendants, by and through their Attorney at that time, Michael J. Hanft, Esquire. Said
Agreement was reached on December 5, 1995 and provided for the payment by the
Defendants often thousand dollars ($10,000.00) in complete settlement of all claims made by
Juniata Lumber and Supply Company, Inc. against Defendants. Plaintiffs delay in filing was
a direct result of the Settlement Agreement reached less than two (2) weeks before the
expiration of the four (4) month time limit. Defendants never notified Plaintiff of their intent to
repudiate the Agreement and Plaintiff never received the sum of then thousand dollars
($10,000.00) offered in full satisfaction by Defendants of the Plaintiffs claim. Defendants
should not now benefit from their bad faith.
11. Denied. Plaintiffs Answer to Paragraph 10 above is incorporated herein by
reference thereto.
12. Denied. Plaintiff was induced to forebear filing of the Mechanics' Lien Claim
based upon Defendants' ongoing settlement negotiations beginning with notification of

Third party Defendant, Michael J. Hanft, Esquire, by his attorneys,
Broujos, Gilroy & Houston, P.C., sets forth the followingl

Defendants in the above action, Alfred R. Logan and Irene J. Logan,
have attempted to join Third Party Defendant, Michael J. Hanft,
Esquire, by filing within their Answer and New Matter to the
Plaintiff's Complaint pleadings entitled "Third Party Complaint" as
set forth in Paragraphs 19 through 34 of Defendant's Answer to
Plaintiff's Complaint.

The method employed by Defendants in their attempt to join the
Third Party Defendant is not a Complaint in the manner and form
required of the initial pleading of the Plaintiff in this action
and is, therefore, a violation of Pennsylvania Rule of Civil
Procedure 22S2(b) (2).

Defendants have not provided Third Party Defendant with copies of
Plaintiff's original Mechanic's Lien Claim, Preliminary Objections
filed by Defendants to the said Mechanic's Lien, Answer of
Plaintiffs to said Preliminary Objections, and Plaintiff's
Complaint filed on said Mechanic's Lien. Failure of Defendants to
attach copies of all pleadings to a complaint against Third Party
Defendant is a violation of Pennsylvania Rule of Civil Procedure
425(a).

Defendants have failed to state a claim against Third Party
Defendant for the following reasons:
A. Plaintiff's cause of action asserts a claim baaed upon
materials furnished to real estate of the Defendants and
does not assert a claim based upon any alleged settlement
agreement which Third Party Defendant reached with the
Plaintiff's on behalf of the Defendants.
B. Defendants are not in any way prejudiced nor do
Defendants suffer any damage in this case based upon the
actions of the Third Party Defendant. All defenses
available to the Defendants to the merits of Plaintiff's
claim remain available to the Defendants despite any
action alleged to have been taken by the Third Party
Defendant.

Additional Defendant, Michael J. Hanft, Esquire, by his attorneys,

The initial pleading of the Plaintiff in this case was a Mechanic's
Lien claim filed by Plaintiff against Defendants, which was filed
on January 18, 1996.
The first initial pleadings against
Additional Defendant were filed by the Defendants on or about
December 17, 1996.
Defendants attempt to join the Additional
Defendant as a party to this action was filed more than sixty (60)
days after service upon the Defendants of the initial pleading of
the Plaintiff and is a violation of Pennsylvania Rule of Civil
Procedure 2253.

3, On or about March 21, 1996, Juniata filed an Answer to DeCendants'
Preliminary Objections, A true and correct copy oC Juniata's Answer to Preliminary
Objections is attached hereto as "Exhibit C",
4, Juniata, filed a Complaint against the DeCendants on or about
November 20, 19!i6 seeking to enCorce the aforementioned Mechanic's Lien Claim, A
true and correct copy of Juniata's Complaint is attached hereto as "Exhibit 1)",
5, On or about December 16, 1996, the DeCendants filed an Answer to the
Complaint with New Matter and a Third Party Complaint against Michael J, Hanft,
Esquire,
6, On or about January 3, 1997, Third Party DeCendant Hanft filed

1. Claimant tiled its Mechanic's Lien Claim on or:
January 18, 1996.
MOTION TO STRIKE MECHl\.NIC'S LIEN CLAIM FOR Fl\.ILURE
TO COMPLY 1nTH SECTION 1502 f21 OF THE MECHl\.NIC'S LIEN Ll\.W
2. Section 1502(2) of the Mechanic's Lien Law, among other
things, requires the Claimant to serve written notice of the filing
of its mechani~'s lien upon the Owner.
J. The Notice of Filing of Mechanic's Lien Claim served by
the Claimant upon the Owners states that the lien filed is against
the property at 11 Shirley Lane, Boiling springs, Pennsylvania
17017.
4. The atoresaid description ot the property is an
inaccurate description ot the property. In tact, improvements were
actually made on a different property. Therefore, claimant's
Notice of Filing of Mechanic's Lien Claim is detective on its face.
Such a defect renders the attempted notice ineffective. Therefore,
Claimant's Mechanic's Lien Claim is defective for failing to comply
with section 1502(2) of the Mechanic's Lien Law and, as such, it
must be stricken.

5. section 1502(a) (1) of the Mechanic's Lien Law requires

months after the completion of its work.
6. The Mechanic's Lien Claim filed by the Claimant state.s
that it last furnished materials on August 17, 1995. (See
paragraph 8 of Claim.)
7. Claimant's Notice of Filing of Mechanic's Lien Claim
states that its lien claim was filed on January 18, 1996.
8. The date on which the Claimant filed its lien (January
18, 1996) is more than four (4) months after it completed its work.
