CARL LORI AND MARGARET LORI, Husband and Wife Defendants MOTION FOR SANCTIONS AND NOW comes Plaintiffs, Mark and Angela Kofalt, t/d/b/a Rainbow Painting, by and through their attorney, GREGORY J. KATSHIR, ESQUIRE, with the following Motion for Sanctions, and avers as follows: 1. Plaintiff filed a civil Complaint against Defendant on April 17,1995 to recover amounts owed for services rendered. 2. On January 18, 1996, Judgment was entered against Defendants in the amount of $598.00, plus interest and costs. Judgment was entered due to a failure of Defendants to timely appeal a District Justice Judgment issued on November 29, 1995. 3. On January 24, 1996, Plaintiffs served Interrogatories in Aid of Execution/Garnishment upon the Defendants, pursuant to the Pennsylvania Rules of civil Procedure. 4. Defendants have not answered the Interrogatories served upon them as is required under Rule 4006 of the Pennsylvania Rules of civil Procedure. 5. Defendants' conduct exhibits bad faith and exposes them to liability for sanctions under Rule 4019 of the Pennsylvania Rules of Civil Procedure. WHEREFORE, Plaintiffs respectfully requests that this Honorable Court enter an Order requiring Defendants to answer the Interrogatories in Aid of Execution/Garnishment within ten (10) days and to pay to Plaintiffs' counsel reasonable counsel fees incurred in the preparation and prosecution of this Motion, or in the alternative, issue a Rule to Show Cause upon Defendants to show cause why Defendants should not be required to answer the Interrogatories in Aid of Execution/Gnrnishment and why sanctions should not be imposed for Defendants' failure to answer said Interrogatories.
