4. Petitioner filed a Petition for Modification of Custody Order on May 12,
1999. A conciliation conference I. IK1heduled with Michael Oanal, Esquire on June 23,
1999 at 11:00.
5. On June 2, 1999, Respondent filed a Custody Co~lalnt In Wilson, North
Carolina. An Emeraency Custody Order was entered ex parle on Juno 3, 1999 in Wilson,
North Carolina. Said order wa. entered contr.ry to the Uniform Child Custody
Jurisdiction Act, 23 Pa.C.S,A. 0 5347, In that tho COUIt failed to cont.ct the Honorable
Kevin A. Heu concernina hi. order of March 29, 1996. Said Order rOltrlcted the
removal of the child from tho jurliidlctlon of Wilson County. Said order is in direct
contr.dlctlon of the Penn.ylvanis Order of March 29, 1996, which provides for Petltioaer
to have cUltody of the child for tho BUmmer beainnina ono week from the end of IK1hool.
Petitioner mould have bad CUltody of the c:hild beainnlna May 28, 1999 (Altbouah the
parties had apeed to beain BUmmer c:ultody with Petitioner on June 5, 1999 10 that the

This cause was heard before the undersigned District Court Judge, and Plaintiff
tiled a verified complaint and motion in this matter;
The Court, having read the said complaint and motion and made such investigation
and inquiry as it deems sufficient, THEREFORE FINDS THE FOLLOWING FACTS:
I. This is an action seeking, inter alia, custody ofBrittni R. Carey, a minor child.
2. There exist facts justifying this Court to assert jurisdiction over the parties and
the subject matter.
3. There is another proceeding concerning fhe custody of this child pending in the
Court of Common Pleas of Cumberland County, Pennsylvania; however, the appropriate
forum for a full hearing on the merits has as yet not been detennined pursuant to the
Unifonn Child Custody Jurisdiction Act, North Carolina General Statutes ~ 50A-1 et. seq.
4. Plaintiff has moved, through Pennsylvania counsel, to stay any further
proceedings in the Court of Common Pleas of Cumberland County, Pennsylvania pending
resolution of the jurisdictional issues in this matter.
5. There is a substantial risk that thc child may be abducted or rcmoved from this
state to evade the jurisdiction of the North Carolina courts.
6. This Court should exercise its jurisdiction and does assume jurisdiction over thc
subjcct Illatter.
7. It appears that thc child will suffcr immediate irreparnblc injury unlcss Plaintiff
is grantcd telllporary custody, and Plaintiff is a fit and propcr pcrson for this rolc.

Petitioner, Michelle Kuhn, Is the Defendant In the above referenced custody action.

By Order of Court dated March 29, 1996, after a custody hearing, this Court awarded
Petitioner legal and physical custody of Brlnnl R. Carey, born January 18, 1990.

Respondent, Raymond Carey, on May 12, 1999 filed a petition for modification of the
March 29, 1996 Custody Order. A copy of said petition Is attached hereto and marked
Exhibit "A".

A custody conciliation conference Is scheduled on the petition for modification of custody
order before Michael Bangs, Esquire on June 24, 1999 at 2:00 p.m.
D. It appears that the state of North Carolina would have lurlsdlctlon over the
custody of the mentioned minor child because the child resides In that state,
the child has resided In North Carolina for approximately 10 months, and
there 15 substantial evidence concerning the care and protection of the child
available In North Carolina that would not be available In Pennsylvania.

Most of the allegations raised by the father In his petition for modification of the March
29, 1996 custody order relate to circumstances and events which took place In North
Carolina. Accordingly, substantial evidence concerning the child exists In North Carolina
and North Carolina clearly has a closer connection with the child and her mother that
would suaaest that Pennsylvania 15 an Inconvenient forum pursuant to 23 Pa.C.S. S5348.

This Court has authority pursuant to 23 Pa.C.S. S5347(c) to stay the proceedlnp In
Pennsylvania pending communication with the North Carolina courts.

Pursuant to 23 Pa.C.S. S5348(a), this Court has the authority to decline to exercise

By Order of Court dated March 29, 1996, after a custody hearlns, this Court awarded
Petitioner leaal and physical custody of Brlttnl R. Carey, born January 18, 1990.

Respondent, Raymond Carey, on May 12, 1999 filed a petition for modification of the
March 29, 1996 Custody Order. A copy of said petition Is attached hereto and marked
Exhibit "A".

A custody conciliation conference Is scheduled on the petition for modification of custody
order before Michael Banas, Esquire on June 24, 1 999 at 2:00 p.m.

Petitioner resides In North Carolina, and has resided there since Auaust of 1998. Prior to
that time, Petitioner resided In Kansas from March of 1996 throullh Auaust of 1998.
Prior to that time, Petitioner resided In Carlisle, Pennsylvania. At all times, the mentioned
minor child has resided with the Petitioner.

On June 2, 1999, Petitioner filed a complaint for custody In Wilson County, North
Carolina Court at Docket No. 99 CVO 975 by which the Petitioner has asked the North
Carolina Court to assume Jurisdiction over the custody Issues Involvlnll the mentioned
minor child. A copy of said complaint Is attached hereto and marked Exhibit "B".

Punuant to 23 PA.C.S. ~5344, the Cumberland County Court does NOT have
Jurisdiction over the custody of Brlttnl R. Carey for the followlna reasons:
A. Pennsylvania was not the home state of the minor child at the time the
petition for modification was filed.
B. Pennsylvania had not been the home state of the minor child within 6
months prior to the commencement of the petition for modillcatlon.
C. Since entry of this Court's prior Order In March of 1996, the minor child
has not had any slllnlflcant connection with the Commonwealth except for
summer vacation with the child's father and some periodic visit with the
child's father durlnll the school year.
D. It appears that the state of North Carolina would have lurlsdlctlon over the
custody of the mentioned minor child because the child resides In that state,
the child has resided In North Carolina for approximately 1 0 months, and
there Is substantial evidence concerning the care and protection of the child
available in North Carolina that would not be available In Pennsylvania.

Most of the allegations raised by the father In his petition for modification of the March
29, 1996 custody order relate to circumstances and evenU which took place In North
Carolina. Accordingly, substantial evidence concerning the child exlsu In North Carolina
and North Carolina clearly has a closer connection with the child and her mother that
would sugest that Pennsylvania Is an Inconvenient forum pursuant to 23 Pa.C.S. ~S348.

This Coun has authority pursuant to 23 Pa.C.S. ~5347(c) to stay the proceedings In
Pennsylvania pending communication with the North Carolina couru.

and it is ordered as followsl
1. Legal custody of the minor child, Brittni R. Carey, DOB
1/18/90, shall be shared by the parties,
Both parties shall
consult with one another in the major decisions affecting the minor
child's life. The Defendant shall make available to the Plaintiff
copies of the minor child's school records including report cards,
medical records, and all other records concerning the minor child
that are available to the Defendant upon reasonable request of the
Plaintiff .
2. Primary physical custody of the minor child shall remain with
the Defendant subject to periods of partial custody with the
Plaintiff as follows I
A. The Plaintiff shall have custody of the minor child during
the summer from one week following the end of school in June of

the parties may agree.
3. Both parties shall be permitted regular, uninterrupted, and
unimpeded telephone aooess to the minor ohild while in their
respeotive times of oustody, and both parties ehall encourage
oontinued contaot by mail, and otherwise respect the non-cuetodial
parent.
4, The Defendant shall pay the cost of transportation to and from
Kansas City, Missouri, to Harrisburg, Pennsylvania, for the periods
of partial oustody being exeroised by the Plaintiff during the
Bummer and Christmas vaoations only. The Plaintiff and Defendant
shall oooperate with one another in arranging the times of transfer
of custody, determining the looation of the transfer, and making
the burden of transfer as little as possible upon the minor child.

Petitions for Emsrgsncy Relief, which have been consolidated by
this Court's Order of January 24, 1996.
Raymond b the former husband of Michelle M. Kuhn (hereinafter
referred to a. "Michelle"), and these parties are the parents of
Brittni R. Carey, D,O,B. January 18, 1990 (hereinafter referred to
aa "Brittni "), Raymond seeks physical custody of Brittni.
Louise is the former wife of Harry B. Kuhn, III (hereinafter
referred to as "Har.ry"), and these parties are the parents of Ryan
M, Kuhn, D.O,B. December 24, 1988 (hereinafter referred to as
"Ryan"). Loube seeks legal and physical custody of Ryan.

In oonjunotion with the filing of the Petitione for Bmergenoy
Relief, both Louiee and Raymond have filed Complainte for Cuetody
and ouetody conoiliation conferenoee have been echeduled on
Raymond 'e Complaint for March 7, 1996, at 1100 P,M., before Miohael
L. Bange, Bequire, and on Louiee' e Complaint before the elUlle
Conoiliator on April 25, 1996, at 9100 A.M,
What prompted the filing of the petitione for Bmergency Relief
wae the faot that Miohelle and Harry intend to relocate to Xaneae
City, Xaneae, the fir.t week of March 1996.
Miohelle ie employed with Sprint United Telephone-Seetern,
having be.n eo employed einoe Maroh 20, 1989, Miohelle wae hired
ae a Service Repreeentetive in the bueineee offioe at a etarting
ealary of $539 bi-weekly and remained in that podtion until
January 6, 1992. At that time, Michelle wae promoted to an
Adminietrative Seoretary in the Information Syeteme Department. On
April 18, 1994, Michelle wae promoted into management ae a Help
Deek Analyet at a bi-weekly rate of $1,034. On October 1995,
Sprint announoed a reetructuring of the Finance and Network
organizatione reeulting in a loss of jobe during 1996 and 1997.
Miohelle wae notified that her position would be eliminated and
that thoee functione would be transferred to the Xansa. City,
Xaneae faoility. In order for Michelle to maintain her

employment with sprint and to expand her career opportunities, she
was qiven an opportunity to apply for a Client Support Center
Analyst II position in Kansas City with said transfer to become
effective March 8, 1996, at a bi-week1y rate of $1,165.97.
Harry had been employed by Smith's Appliance Center since
1985, In addition, he had been employed as a .print race car
driver. Harry had been earninq approximately $400 weekly from his
former elDployment, As a result of Michelle's employment
opportunities in Kansas City, Harry souqht employment in Kansas
City and has been hired by Weld Racinq, Inc., as the Oval Track
Direotor. In this new position, Harry i. earninq $730.77 per week.
Both Michelle and Harry have hiqh school deqrees, If Michelle
had not taken the position with Sprint, there are no quarantee.
that any continued employment would be available at Sprint and it
would be extremely difficult for Michelle as a re.u1t of her high
school education to obtain Bimilar employment in the Carlisle area.
Harry could have continued in his former employment, however, it is
obvious as a result of his new employment in Kansas City, that
Harry'. finanoial Bituation has qreatly improved.
Michelle and Raymond had been married in September of 1990,
separated in Mayor June of 1991, and were divorced by the end of
1991, Both Michelle and Raymond are from the Carlisle area.

Michelle' e parente remain married and live in Carlide,
Michelle hae a brother who livee in South carolina and grandfathere
who reeide in Carliele. Michelle'e parente are very eupportive of
her relooation deepite the obvioue fact that they will not be able
to eee their granddaughter or daughter quite ae often ae they ueed
to.
Raymond I e parente are divorced and they both live in the
Carliele area. Raymond's father is eupportive of Michelle' e
poeition and her relocation to Kaneae city. Brittni ie cloee with
her paternal grandmother,
Raymond and Michelle currently operate under an Order dated
Auguet 12, 1992, which providee that Michelle hae primary phyeical
cuetody and Raymond hae liberal partial cuetody. The partiee have,
over the yeare, worked out an alternating weekend echedule.
Michelle hae made an extra effort to involve Raymond in Brittni'e
activitiee.
Raymond ie currently residing with Debra Evane, living in
Bloeerville in a trailer park. Raymond has utilized his mother to
provide moet of the transportation involving Brittni. Raymond hae
had little involvement with Brittni 's daycare providers and echool,
Debra Evans and Raymond are engaged and Debra Evans holds herself
out as Brittni's "stepmother." Raymond is currently employed ae a
dock worker for Giant,

Harry and Loui.e were married in Augu.t of 1988 and .eparated
in December 1991 when Loui.e abandoned Ryan and Harry. Loui.e ha.
lived in a number of location. .ince her .eparation from Harry,
She ha. now remarried and re.ide. in the New Cumberland area, For
approximately .ix month. after Harry and Louhe had .eparated,
Loui.e had made no contact with Ryan.
Harry'. parent. are divorced and live in the Carli.le area,
Harry al.o ha. a brother and grandmother. who live here, a. well.
Harry'. family h .upportive of hh relocation to Kan.a. City.
Loui.e i. from the York area and ha. a .on, Bryan Carl, who i.
approximately one year old. Louiee currently exerci.e. period. of
partial cu.tody pur.uant to an Agreement entered into at the time
of the divorce on alternating weekend., and the partie. alternate
holiday., a. well, Harry ha. made an extra effort to involve
Loui.e in Ryan'. activitie.. Louiee ha. had an erratic employment
hhtory.
Harry and Michelle have been reeiding together approximately
four year.. They married on December 9, 1994. Brittni and Ryan
are ju.t like brother and sieter. They have bonded. Both Michelle
and Harry take an active role in parenting the children. In
addition, Michelle and Harry have initiated college .aving. fund.
for both children and eee the financial opportunitie. from the move
to Kan.a. City a. nothing but beneficial for the children.

Michelle and Harry have offered a substitute partial custody
arrangement to the respective non-custodial parents which would
provide that Ryan and Brittni would spend almost the entire summer
vacation with the non-custodial parent. In addition to that, they
have offered the Christmas vacation and such other times as the
parties can agree. Michelle and Harry have offered to share in the
cost of transportation, however, if this is an issue, they are more
than willing to assume the full cost of the transportation,

The law in Pennsylvania regarding relocation cases has been
summarized by Judge Oler in Beth Ann Kruzen v Kurt R. Kruzen, 44
Cumbo 314 (1995), as follows,
In Pennsylvania, custody and visitation matters are
decided on the basis of the 'best interest of the child'
standard, considering all factors which legitimately have
an effect upon a child's physical, intellectual, moral
and spiritual well-being." tfbite y tfbite, 437 Pa.
Superior Ct. 446, 450, 650 A.2d 100, 112-13 (1994).
"[Tlhe best interests of the child are more closely
all ed with the interests and quality of life of the
custodial parent and cannot, therefore, be determined
without reference to those interests, In the context of
relocation cases this principle translates into an
understanding that when relocation 18 likely to result in

a substantially enhanced quality of life for a custodial
parent, often the child's be.t interests will be

One of the factors to be considered in a child custody
case, such as the pre.ent one, is who has been
the primary caretaker. Franke' Gale, Penn.ylvania
Family Practice Manual 59.02(8)(2), at 334 (1990),
"[W]here two natural parents are both fit, and the child
is of tender years, the trial court must give positive
conBideration to the parent who has been the primary
caretaker, Not to do so ignores the benefits likely to
flow to the child from maintaining day to day contact
with the parent on whom the child has depended for
satisfying his basis physical and psychological needs."

With respect to child custody, "relocation" cases present
special difficulties for the court., lee Gnber y
Gruber, supra. "[l]n every relocation dispute the
following interests must be accommodated as nearly as
posBible, the custodial parent's desire to exerohe
autonomy over basio decisions that will directly affect
his or her life and that of the [child], a ohild's strong
interest in maintaining and developing a meaningful
relationship with the non-custodial parent, the interest
of the non-oustodial parent in sharing in the love and
rearing of his or her children, and, finally, the state's
interest in protecting the best interests of the
children." Id. at 184, 583 A.2d at 438-39. The
Pennsylvania Superior Court has stated the resultant rule
in relocation oases as follows I
[I] n order to justify a relocation of [a .......::
child] by the custodial parent, the.custodial ~
-1irent must demonstrate (1) that the move is ~
kely to s1gnificantly improve the quality of /'"
life for the parent and the [child]) (2) that
the move is not motivated simply by a desire

brother and eister, Even though they are not blood related, they
have resided together for most of their lives, They are, for all
praotical purposee, brother and sister. The oourts have looked
with disfavor on the eeparation of siblinge, even of the half-blood

that they are entitled to maintain pr~mary cu.tody in relocating.
Applying the .tandard. in relocation ca.es in conjunction with the
obvious attachment between Ryan and Brittni, can lead to but one
ooncludon and that b that Harry and Michelle .hould be given
permi..ion to relocate and maintain primary cu.tody.
Brittni and Ryan are both the products of divorces. The only
real .tability that they have had in their life i. the fact that
they have lived under one roof together with two very loving
parent.. They live in comfortable surroundings and live with two
parent. who are financially .ecure. Michelle and Harry are looking
to the future, a. evidenced by initiating college saving. fund. for
the ohildren, In order for Miohelle and Harry to obtain their
financial .ecurity and, hence, the family'. financial .ecurity,
there i. no question but that the move will significantly improve
the quality of life for the parent. aDd the children. The propo.ed
re.idential area in which the family would be moving to in Kan.a.
City i. obviously very appealing and there are good school. and all
of the nece..ary faoilities in olose proximity to this area.
On the other hand, if primary custody i. given to Louise and
Raymond, there is no assurance that the quality of life of these
children will be better. These two children who have grown so
close to each other would be separated from each other. There ia

no assurance that Louise and Raymond will make an effort to have
these two children continue to visit with each other on a regular
bads. The hhtory has been such that Louhe and Raymond have
shown little intere.t in the past, except for perhaps the very
recent past, to get these two children together. Even though Ryan
has a half-brother residing here in Pennsylvania there is not the
seme type of bonding that has occurred with Brittni. Moreover,
with the proposed schedule of partial custody being offered to his
mother, he will be able to spend quality time with his half-brother
in the .ummer months. In that Louise and Raymond now recognize the
bonding between Ryan and Brittni, it is hoped that during the
summer months that they will make an effort to get the children
together a. often as possible.
It is clear that this move is not motivated simply by a desire
to frustrate the visitation rights of Loui.e and Raymond with their
children. There is no question but that Michelle and Harry have
made an effort to have the non-custodial parent. involved as much
as possible in the children's activities. with no history in the
past of Michelle's and Harry's efforts to deprive the non-custodial
parents with visitation, there is no question that visitation
rights will not be frustrated in the future. If one looks at the
total number of days that the non-custodial parents have had the

children on an annual basiB, it iB evident that the propoBed
schedule provides for as much, if not more, contact for the non-
custodial parents with the children.
Due to the diBtance involved, it i. obviouBly not posBible for
the non-custodial parents to maintain their current alternating
weekend schedule or for their even to be a monthly visitation
schedule.
With, however, the proposed schedule of the non-
custodial parent having the children for almost three months of
each year on a regular, continuing and sustained basis, it is
submitted that along with regular telephone contact, visitation at
Christmas, and, hopefully, visitations at other times of the year,
that a continuing, loving, and meaningful relationship between the
non-custodial parents and the children will continue,
Bach relocation case mu.t stand on its own facts. These are
not easy decisions for any Court to make.
It is SUbmitted,
however, that Michelle and Harry have met the Btandards as
enunciated in Gruber, supra and, conBequently, have met their
burden of proving that relocation iB JUBtified.

Louise Carl remarried. She married Bryan Carlon December 24,
1992. They became the parents of a son, Bryan Skylar, on July 29,
1994. Skylar and Ryan are half brothers and share a close
relationship together. Skylar views Ryan as a source of love and
affection and seeks to emulate his every action. Mrs. Carl is also
expecting another child in May 1996. Louise and her husband,
Bryan, enjoy an active and close relationship with Ryan
participating in soccer and T-ball among other activities. Ryan
deeply loves his mother and stepfather and views both as a source
of love and affection. They reside at 314 Reno Avenue, New
Cumberland where Ryan has many friends. Both parents are employed
outside of the household. If Ryan is permitted to remain with his
mother and stepfather, he will attend school at Hillside Elementary
School within sight of his home in New Cumberland and with
established friends. He will also have the opportunity to share in
the birth of his new brother or sister.
Raymond Evans and Deborah Evans are planning a wedding for
October 1996. They also enjoy a close and active relationship with
Brittni. Brittni is close to both parties and enjoys a very
special relationship with Deborah to whom she refers as "Momma-
Deb." She views both parties as a source of love and affection.
Brittni attends kindergarten at Hamilton Elementary School.
Raymond and Deborah reside at Newville and Britnni has many friends
there. Both parties are employed outside of the household, If

Brittni is permitted to remain with her father and soon-to-be
stepmother, she will attend school in Newville with her friends.
The bus stops near her house and her father would ensure that she
safely boards the bus.
Joey Kuhn and Michelle Kuhn were married on December 9, 1994.
They presently maintain primary physical custody of Ryan and
Brittni, who are stepbrother and stepsister. They reside at 263 F
Street, Carlisle. Ryan attends Hamil ton Elementary School in
Carlisle. Mr. Kuhn has been employed locally for the last several
years in Carlisle by Smith's Appliances. Mrs. Kuhn is employed by
Sprint Telephone Company in Carlisle. However, in December, Mrs.
Kuhn accepted a transfer to Kansas City. Because of his wife's
transfer, Mr. Kuhn has sought and obtained employment in the Kansas
City area, They seek to relocate to Kansas City.
All of the children's extended family reside within a seventy-
five (75) mile radius of Cumberland County. Both children are
attached to their extended families and enjoy frequent contact with
the various members of this group. Moreover, all of the children's
activities are located within minutes of their homes. Mrs. Carl
and Mr. Carey, along with their spouses, respectively, oppose the
relocation of their children to Kansas City. Accordingly, they
respectfully request that this Honorable make a determination based
upon the best interests of the minor children.

II, ISSUE
IT IS NOT IN THE BEST INTERESTS OF THE MINOR CHILDREN, RYAN
AND BRITTNI, THAT THEY BE RELOCATED TO KANSAS CITY, MISSOURI, AND
AWAY FROM ALL OF THEIR FAMILY, EXTENDED FAMILY, AND FRIENDS IN
PENNSYLVANIA WHEN THEY HAVE NO FAMILY AND FRIENDS IN MISSOURI.
The controlling case in a relocation case such as the matter
sub judice is Grubber v. Grubber, 400 Pa. Super. 174, 583 A,2d 434
(1990) . When a custodial parent seeks to relocate at a
geographical distance and the non-custodial parent challenges the
move, the custodial parent bears the heavy burden of establishing
that the move is likely to significantly improve the quality of
life for that parent and the child. Additionally, each party bears
the burden of establishing the integrity of his or her motives in
either desiring the move or opposing it.
A trial court must consider three factors in determining the
appropriateness of permitting relocation of a minor child at a
geographical distance from the non-custodial parent. Cognosce v.
Cognosce, 413 Pa. Super. 173, 604 A.2d 1075 (1992); Grubber, supra.
Initially, a trial court "must assess the potential advantages
of the proposed move and the likelihood that the move vlould
substantially improve the quality of life for the custodial parent
and the child [] . " Grubber, 583 A. 2d at 439. In determining the
prospective advantages of a move, a trial court should consider
various benefits, including "a desire to return to a network of
family or friends, or to pursue educational opportunities, or seek
an improved physical environment in which to live and raise the
children." Id,
Next, a trial court must consider the integrity of the motives
of the parent seeking to move and the parent opposing the move.
Id. A trial court must be satisfied that the custodial parent is
not motivated by a desire to frustrate the visitation rights of the
non-custodial parent. Additionally, a trial court must also assure
itself that the non-custodial parent is appropriately motivated by
only a legitimate desire to continue and deepen the parent-child
relationship, Id,
Lastly, a trial court must consider the "availability of
realistic, substitute visitation arrangements which will foster an
ongoing relationship between the child and the non-custodial
parent." Id.
With respect to the initial factor, the only advantage
advanced by the respective Defendants is that Mrs. Kuhn will have
employment in Kansas City. Accordingly, the sole basis for the
move is for Mrs. Kuhn to accept employment in Kansas City and for
Mr, Kuhn to follow his wife. Given these facts, it cannot be
established with any certainty that the move will substantially
improve the quality of life for Mr. Kuhn and Ryan or Mrs. Kuhn and
Brittni. In fact, it may be stated that the move to Kansas only
serves to seriously disadvantage the children by separating them
from their families and friends and the familiarity of Cumberland
County.
As was previously discussed, a trial court is required to
assess various benefits of a move. In applying these potential
benefits to the instant case, one finds that these benefits are
absent. In fact, a move to Kansas City would only serve to remove
the minor children from a secure and involved network of family and
friends and isolate them in a distant location removed from a
network of support, Such a move would be emotionally devastating
to these young children and remove them from their friends and
activities that they have known their entire lives. Therefore, the
Defendants have not sustained their burden of establishing that the
move will substantially improve the quality of life for the minor
children.
With respect to the second factor, the Plaintiffs do not
question the motivation of the Defendants. Rather the Plaintiffs'
sole motivation is the best interests of the children. A child
should not have to move during his/her developmental years away
from the comforting, nurturing, and supporting hand of familiar
family and friends when realistic options e~:ist. Each of the
Plaintiffs seeks to strengthen his/her relationship with his/her
child. A move away from this environment would only serve to
hinder emotional and intellectual development of the children. In
examining the motivation of this move, the Plaintiffs respectfully
request that this Honorable Court consider the fact that the
proposed move is requested solely for the purpose of accommodating
Mrs. Kuhn's career.
With respect to the last Gruber factor to be considered, the
~laintiffs submit that the distance between ~ennsylvania and Kansas
dictates a drastically restricted visitation schedule. A move to
Kansas City would restrict visitation by the ~laintiffs with the
minor children to perhaps a few major holidays and time during the
summer.
The children's ongoing life with their families and
activities would be curtailed.
The ~laintiffs recognize that the spouse
in Gruber was
permitted to relocate.
HO~lever, the facts of that case are
diametrically opposed to the facts in the instant case. In Gruber,
the Court determined that the father's right to visitation was
outweighed by the mother's desire to move away from an isolated and
confrontational environment so that she could relocate to Illinois
where she would be surrounded by family and friends. However, in
this case, mother seeks to relocate and father seeks to join her
and remove the children from an environment and network of support,
love, and nurturing care all in an effort to advance mother's
career. The proposed relocation would remove the children from
family and friends and a nurturing environment.
The ~laintiffs
respectfully submit that the children's best interests outweigh
Mrs. Kuhn's choice to advance her career.
III. CONCLUSION
Wherefore, based upon all of the foregoing reasons, the
Plaintiffs Louise Carl and Raymond Carey respectfully request that
this Honorable Court award them primary physical custody of their
respective minor children.

B. The Plaintiff shall have custody of the minor child during
the Christmas vacation, beginning the day after Christmas vacation
begins until the day prior to the end of Christmas vacation except
that Defendant shall in even numbered years retain custody of the
minor child for Christmas Eve and in odd numbered years on
Christmas Day, if the Defendant celebrates Christmas in
Pennsylvania.
C. The Plaintiff shall have partial custody of the minor
child during the week of spring break, beginning from the day after

any is necessary.
9, Other matters or comments: The Court is intimately
familiar with this case in that there is a jurisdictional dispute
that is occurr.ing between Pennsylvania and North Carolina. This
Court had scheduled a hearing on Father's Petition for Contempt
related to the Mother's failure to return the child in accordance
with the existing Order in Pennsylvania, Apparently, there is some
Order in North Carolina as well,
Should the outcome of the jurisdictional issue result in this
Court retaining jurisdiction of the case, it makes the most sense
for this Court to entertain the contempt issue and the request for
modification at the same time if the Court schedule permits, The
conciliator suggests that the counsel contact the Court to try to
arrange a time to have this modification hearing at or about the
time of the other hearing. The contempt issue certainly should not
take much time for the Court to decide so that the bulk of any time

I. The heuring scheduled on July 13, IlJ99 is postponed.
2. By agreement of the purties, this court will retain jurisdiction on the custody
issues in the above euse.
3. The purties will procc,,'Cl with a custody evaluution done by a professional agreed
upon by counsel for the parties. This shull be un independent evaluation with the
professionul having the ability to share the results of the evaluation with both
parties and legal counsel for both purties. Costs of the evaluation shalll:e shared
equally by the purties.
4. The minor child, Brinni R. Curey, shull be delivered from the Fathcr to the
Moth"... on August I after which the Mother may take the child back to North
Carolina for school.
S. The Mother will muke uITungements to trnnsport the minor child to Pennsylvania
in order for the child to spend the weekend of August 21 and the Labor Day
weekend with the Father.
6. The Mother will provide a school calendar to the Father.
7. Upon the conclusion of the mentioned evaluation and in the event the parties at
that time desire a hearing, counsel lor either purty may petition the court to have
this case again scheduled for a hearing on the Petition for Modification of
Custody filed by the Father and on the Father's Petition tor Contempt.
