Information pertaining to the proof of the allegation is within the exclusive control of Plaintiff. Proof is demanded. Further denied that the work was done pursuant to the contract. To the contrary, the second Item 2 of the Agreement specifies that, "all work to be performed by consultant for client will be approved by client prior to performance. II Further, Item 4 of the terms and conditions specifically states that consultant will bill client on a weekly basis. Plaintiff failed to comply with either of these conditions. It is further denied that Exhibit B has anything to do with the claim alleged by Plaintiff. 6. Admitted and denied. Admitted that on or about June 19, 1995, Plaintiff and Defendant met, Denied that Plaintiff presented any reasonable work product and in particular, any reasonable work product for the price charged. Plaintiff was presented with a one page letter and photocopies of technical data sheets issued by various manufacturers of products to be used in making a charger. At or about the time of this meeting, Defendant told Plaintiff that he did not perform the service he represented, he did not even have preliminary plans for making such a device, and he had no type of definite plan for developing one. At this time, Defendant told Plaintiff to cease all work. 7. Admi tted and denied. Admitted that Defendant has refused to pay. Denied that Plaintiff is entitled to any money because: a. Plaintiff did not comply with terms of the contract calling for "all work to be performed .. will be approved by client prior to performance. In particular, Defendant was never informed that Plaintiff was so ill versed on the subject matter that he had to do an admitted "fishing expedition" in the literature in order for Plaintiff to become familiar with the area. Plaintiff was hired as an electrical engineer and not as a researcher. b. Plaintiff did not bill client at weekly intervals. Had Plaintiff billed at weekly intervals according to the terms of the contract, Plaintiff would have discovered sooner the fact that Defendant was on a general fishing expedition for background at Defendant's expense and would have stopped the project then and there. Plaintiff is Bertram C. Defendant, Jeffrey S. Rose, is an adult individual trading and doing business as Photography By Jeffrey Rose, a sole proprietorship, with his principal plac. of businsss at 3710 Market st. Camp Hill, Cumberland County, Pennsylvania, 17011. The defendant's residence addre.. is unknown. 3. On May 9, 1995 the Plaintiff and the Defendant entered into a contract, a true and correct copy of which b attached hereto as Exhibit "A" and made a part hereof, 4. The said contract provided for the rendering of technical consulting services by the Plaintiff to the Defendant specifically as set forth in the said contract, with the initial contract thrust to design and develop a battery conditioner expressly for Nickel Cadmium batteries that will, when a NiCad battery is connected to it, will first discharge the battery to its optimum discharge level, and then recharge it to its full potential, thus eliminating the well-known "memory effect" exhibited by this type of battery, and thereafter, contract work to develop capabilities within the conditioner for multiple voltages, multiple current capabilities, and multiple charging ports. 5. The Plaintiff rendered technical services and purchased materials pursuant to this contract as d.tailed in the invoice for $1,665.55 submitted by the Plaintiff to Defendant, said invoice with attached job work .heet., dated, June 19, 1995, number 500396, a true and correct copy of which is attached hereto as Exhibit "B" and made a part hereof. The work performed by the Plaintiff included contacting a number of battery manufactures and battery charger manufacturers on Defendant's behalf, receiving, reading and analyzing this information provided by the.e manufacturers, and obtaining, reviewing and analyzing other technical literature to forward the project for the Defendant, expending money for supplies and the assessment of late charges as detailed in Exhibit "B" attached hereto. 6. On or about June 19,1995 the Plaintiff and Defendant .et to di.cu.. the project, the work that plaintiff had performed to date, the recommendations of the Plaintiff, possible next steps. The Plaintiff also pre.ented the .aid invoice, attached hereto as Exhibit "A" to the Defendant at this meeting, and the Defendant accepted and agreed to pay the initial billing as set forth in the invoice attached hereto as Exhibit "A". The plaintiff at thi. meeting stated that he wanted to consider to puraue the project and Plaintiff's work to be done under the contract and either at this meeting or .hortly thereafter decided not to pursue the project but reaffirmed hi. agreement to pay the initial billing. 7. The Defendant has neglected and still neglect. to pay for the balance due on the said invoice or any part thereof, although Plaintiff has made frequent demand. upon him so to do, including a letter sent by regi.tered return receipt, refused by the Defendant, and the commencement of a District Justice action wherein the Plaintiff obtained a judgment against the Defendant for the sum of $1,734.55 on December 22, 1995, by and before District Justice Glen R. Cynthia and I visited the West Shore Public Library and photocopied a number of pages from the Thomas Register for Battery, NICad, and Battery, Chargers, From these pages we selected the largest ones and called them, Myself, about NiCad batteries, and Cynthia, about battery chargers, We requested IIteraturc be scnt and a grcat deal of It was recclved, This was the first fishing expedition, and was Intended to gain technlcallnformntlon about nlcads and nlcad chargcrs. While the survcy was not exhaustive, neither of us gained any Information about a device similar to the one we talked about, I.e" a really amw charger, There are a few people who have come up with "smart" charging chips, but each requires that the chip be set for a certain numbcr of cclls, and leavcs scveral opUons open to the user, The best two that I uncovered was the Sanyo SI 101, and the Benchmarq series, At first (and second) reads, I believe that the Sanyo is thc best bet for us, It appears to be the smartest and most versatile of the available alles, and It's cheap ($8,00 In lots 500), The device I believe you had In mind could be a processor controlling one Sanyo for each charging port, with the central control detcrmlnlng the voltage of the battery to be charged, setUng the port Sanyo for the proper voltage, and turning the charging routine over to the Sanyo while checking on other ports, The proposed steps are: 1, To pursue the original goal, protot}'pe II charger with two ports, and try It out on a wide rllnge of batteries, To Ilccompllsh this the (ollowlng needs to be done, a, A rigorous dellnellUon of the goals to be accomplished, and the limitations we are willing to accept.. b, Overall design of the charging system, Including the logic flow of the processor, Input/output circuitry, voltage Ilnd current measuring circuitry, provision of enough memory to retalnlllstrucllons nnd perUnent data during each charging cycle, c, "Brelldboard" the circuity, Including parts procurement, d, Try It out, debug where necessary, try It outll8aln, evaluate results, 2, Prudence would Indicate a more thorough check of battery charger manufacturcrs to Insure a more poslUve knowledge of what the compeUtlon docs and docs not offer, ~ '1"/',<1 ,- 11\ _~.
