7, On or aboul, January 26, 1993, Plainlitfs, Mike and Michelc Lebo received a "Termite
Rencwallnvoice" a tmc and correct copy is altached as Exhibit "B."
8. The renewlll invoice specifically stated, "THE GUARANTEE SHOULD BE KEPT
UP IN ORDER FOR YOU TO BE ASSURED THAT YOUR HOME WILL BE UNDER
GUARANTEE TO PREVENT AGAINST ANY FUTURE INFESTATION TO YOUR
PROPERTY,"
9. Plaintiffs paid the Invoice and the inspection of their property was performed on April
27, 1993.
10, On or about January 20, 1994, Plaintiffs rcceived their annual "Termite Renewal
Invoice" from Defendant which slaled, "THE GUARANTEE SHOULD BE KEPT UP IN ORDER
FOR YOU TO BE ASSURED THAT YOUR HOME WILL BE UNDER GUARANTEE TO
PREVENT AGAINST ANY FUTURE INFESTATION TO YOUR PROPERTY."
I \. PlaintitT's paid the Invoice and the inspection of their property was performed on
March II, 1994,
12, During the fall of 1994 Plainliffs became aware of damage to the floor joists, sill
plates and face board of their property caused by termite infestation.
13. On or about, Febmary 19, 1995, Plaintiffs contacted TERMINIX, a pest control

company,lo inspcct said propcrty, which conflnllcd that propcrty damage was the result of termite
infestation, A tntc and exact copy of the cvalulltion is attachcd liS Exhibit "C",
14. On or about, Fehntllry 20, 1995, Plaintifl's contacted J.C. Ehrlich, a pest control
compllny, which IIlso allirmcd that the danll\ge I'laintilTs' property was due to termite infestation. A
tnle and exact copy of the evahmtion is all ached as Exhibit "D",
IS. On or about, March 30, 1995, Plaintiffs Mike and Michele Lcbo consulted with
GJ, RHOADS CONSTRUCTION CO., a Pennsylvania company, who is a contracting business, to
obtain an appraisal for repair of the damage to their property. There was no damage to the property
contents, A tnte and exact copy of the proposal to repair the property for $1,190.00 is attached as
Exhibit "E",
16. Defendant's have breeched their contractual guarantee to. "PREVENT AGAINST
ANY FUTURE INFESTATION" to Plaintitrs property.
WHEREFORE, Plaintifl's demand judgment in favor and against Defendants in the sum of
$1,190.00, plus costs and reasonable allorney fees.
COUNT II
DREACII OF EXPRESS WARRANTY
17. Paragraphs I Ihrough 16 are incorported herein by reference as though set forth at
lenglh.
18, Defendant is a "seller" as deflned by the Pennsylvania Uniform Commercial Code
(hereinafter "UCC"),
19. Defendant, in their offer for renewal contract, promised Plaintiffs that the product

would "PREVENT AGAINST ANY FlJTUltE INFESTATION" to their property,
20, Plaintills Mike and Michele Lebo aver Ihat the Defendants promise was the basis of
Ihe barllaln that induced thcmto renew thcir allrcement.
21. The promise by Ihe Defendants and the reliance on that promise by the Plaintiffs has
created an eKpress wllrrnnty under the lJCC
22. Dcfendants have brellched their CKpress warranty and arc responsible for incidental
and consequenlial damallcs,
WHEREFORE, Plainliffs demand judllment in favor and allainst Defendants in the sum of
51.190.00, plus costs and reasonable attorney fees.

Defendants did not eKclude or modify the implied warranlies lluaranteed by the UCr.
26. Defendants have breached their implied warranties of merchantability and fitness and
are responsible for incidental and consequential damalles,

Defendants hereby move this Honorable Court to grant their
Preliminary Objections and dismiss Plaintiffs' claims against
Defendants, and in support of such avers as follows:
I, PRILIMINARY OBJlCTION TO PLAINTlrFS' RIQUlST

1, Plaintiffs filed a Complaint against Defendants on or
about February 9, 1996,
2, Plaintiffs' Complaint contains three claims against
Defendants allegedly arising out of their termite treatment of
the Plaintiffs' residence,
3, The three claims against Defendants are entitled:
breach of contract, breach of express warranty, and breach of
implied warranty,
4, In all three of the Wherefore Clauses, Plaintiffs
request "reasonable attorney fees,"
5, Pennsylvania does not recogni2e the granting of
attorney fees unless under statute or if such has been expressly
agreed upon,
6, In the case at hand, Plaintiffs do not cl~im that their
request for attorney fees derive from a statute or an agreement
with the parties, as the two scenarios do not exist in this case,
7, Pa,R,C,P, 1028(a) (2), states that a preliminary
objection may be filed by any party to any pleading and are
limited to the following grounds "", (2) failure of a pleading
to conform to law or rule of court or inclusion of scandalous or
impertinent matter,"
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objection and strike Plaintiffs'
request for reasonable attorney fees in all of the three
Wherefore clauses in Plaintiffs' Complaint,
II, PRILINIHARY OBJICTION IN Tnl NATURI OF A DINURRIR
AS TO COUNT I
8, Defendants incorporate Paragraphs 1 through 7 of their
Preliminary Objections by reference as if set forth herein at
length,
9, Plaintiffs allege a breach of contract in Count I,
10, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of contract,
11, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of contract,
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objections in the nature of a

dismiss County I with prejudice,
III, PRILIMINARY OBJICTION IN TOI NATURI OF A DIMURRIR
AS TO COUNT II
12, Defendants incorporate Paragraphs 1 through 11 of their
Preliminary Objections by reference as if set forth herein at
length,
13, Plaintiffs allege a breach of express warranty in
County II of their Complaint,
14, To support this allegation, Plaintiffs state that
"Defendant is a "seller" as defined by the Pennsylvania Uniform
Commercial Code, ,. and that the Droduct would PREVENT AGAINST ANY
FUTURE INFESTATION to their property," (emphasis added)
15, In order to state a cause of action for breach of an
express warranty, there must be a warranty,
16, In this situation, Defendants did not provide a
warranty to Plaintiffs with regard to future damage or repairs
thereto, which Plaintiffs have acknowledged in Paragraph 6 of
their Complaint.
17, Moreover, Defendants did not provide any "product" to
Plaintiffs.
18, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of express warranty,

19, Instead, they attempt by, mere generalization of the
Pennsylvania Uniform Commercial Code, to state a claim for breach
of express warranty,
20, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of express warranty,
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objections in the nature of a
demurrer with regard to Count II of Plaintiffs' Complaint and
dismiss Count II, with prejudice,
IV, PRILINIHARY OBJlCTION IN Tnl HATURI OF A VIMURRIR
AS TO COUNT III
21, Defendants incorporate Paragraphs 1 through 20 of their
Preliminary Objections by reference as if set forth herein at
length,
22, Plaintiffs allege a breach of implied warranty in
County III of their Complaint,
23, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of implied warranty.
24, Instead, they attempt, by mere generalization of the
Pennsylvania Uniform Commercial Code, to state a claim for breach
of implied warranty.
25, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of implied warranty,

demurrer with regard to Count III of Plaintiffs' Complaint and

V, PRILIMINARY OBJICTION TO STRIKI IXHIBITS ATTACHID TO
PLAINTIJ'J'S' COMPLAINT
26, Defendants incorporate Paragraphs 1 through 25 of their
Preliminary Objections by reference as if set forth herein at
length,
27, Plaintiffs attach various exhibits to their Complaint,
in particular alleged estimates and documents relating to
damages, such as estimates and reports from Terminix, Erhlich,
and G,L, Rhoades Construction Co.
28, Pa,R,C,P, l028(a) (2), states that a preliminary
objection may be filed by any party to any pleading and are
limited to the following grounds "", (2) failure of a pleading
to conform to law or rule of court or inclusion of scandalous or
impertinent matter."
29, These aforementioned exhibits attached to Plaintiffs'
Complaint clearly demonstrate the inclusion of scandalous or
impertinent matter, which Pa,R,C,P, l028(a) (2) prohibits.
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objection and strike all of

BREACH OF CONTRACT
4, Paragraphs I through 3 are incoporated by reference as though set forth at length,
5. On or about September 23, 1992, PlaintitTs Mike and Michele Lebo, assumed the
termite re,treatment warranty and agreement between Bowers Pest Control and Greg Wire, the
previous owner of the Lebo's property located at 41 Sussex Road, Camp Hill. A true and correct
copy of the Igreement & warranty received by the Lebo's is attached as EKhlblt "A",
5, EKhibit "A" specillcally stated lhat the agreement, "does nol guarantee for the control
of present or future damage to property contents nor provide for repairs or cDmpensalion thereof."
6. On or about, Janull/)' 26, 1993, PlalntllTs, Mike and Michele Lebo received I "Termite
Renewal Invoice" a true and correct copy is attached as EKhibit "B,"
7, The renewal invoice specillcally stated, "THE GUARANTEE SHOULD BE KEPT
UP IN ORDER FOR YOU TO BE ASSURED THAT YOUR HOME WILL BE UNDER
GUARANTEE TO PREVENT AGAINST ANY FUTURE INFESTATION TO YOUR
PROPERTY,"
8, PlaintiIrs paid the Invoice and the inspection of their property wu performed on April
27, 1993.
9, On or about January 20, 1994, PlaintiIrs received their annual "Termite Renewal
Invoice" from Defendant which stated, "THE GUARANTEE SHOULD BE KEPT UP IN ORDER
FOR YOU TO BE ASSURED THAT YOUR HOME WILL BE UNDER GUARANTEE TO
PREVENT AGAINST ANY FUTURE INFESTATION TO YOUR PROPERTY,"
10. Plaintitrs paid the Invoice and the inspection of their property was performed on
March II, 1994,
II, During the fall of 1994 PlalntiIr s became aware of damage to the floor joists, sill
plates and face board of their property caused by termite infestation,
12, On or about, February 19, 1995, PlaintilTs contacted TERMINIX, a pest control
company, to inspect said property, which conllrmed that property damage was the result of termite

infeltatlDn. A true and eKact copy of the evaluation Is attached al Exhibit "C",
13. On or about, February 20, 1995, PlalntilTs contacted J,C. Ehrlich, a pest control
company, which also affirmed that the damage PlaintllTs' property was due to termite Infeltatlon. A
true and eKact copy of the evaluation Is attached al Exhibit "D",
14. On or about, March 30, 1995, PlaintllTs Mike and Michele Lebo consulted with
PAGE BROTHERS, INC" a Pennsylvania corporation, who are a contracting business, to obtain an
appraisal for repair of the damage to their property, A true and eKact copy of the proposal to repair
the property for $1, 190,00 is attached as Exhibit "E",
15, Defendant's have breached their contractual guarantee to, "PREVENT AGAINST

DEPENDANTS' PRELIMINARY OBJECTIONS
Defendants hereby move this Honorable Court to grant their
Preliminary Objections and dismiss Plaintiffs' claims against
Defendants, and in support of such avers as follows:
1, Plaintiffs filed a Complaint against Defendants on or
about February 9, 1996,
2, On February 29, 1996, Defendants filed Preliminary
Objections to Plaintiffs' Complaint,
3, On March 19, 1996, Plaintiffs filed an Amended
Complaint, which Defendants received on or about March 20, 1996,
4, Plaintiffs' Amended Complaint contains three claims
against Defendants allegedly arising out of their termite
treatment of the Plaintiffs' residence,
5, The three claims against Defendants are entitled:
breach of contract, breach of express warranty, and breach of
implied warranty,

6, Defendants incorporate Paragraphs 1 through 5 of their
Preliminary Objections by reference as if set forth herein at
length,
7, Plaintiffs allege a breach of contract in Count I,
8, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of contract.
9, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of contract,
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objections in the nature of a
demurrer with regard to Count I of Plaintiffs' Complaint, and
dismiss County I with prejudice,
II. PR.LIIlINARY OB~CTION IN TH. NATtJR. OF A DDCUJtR.R
AS TO COtlN'l' II
10, Defendants incorporate Paragraphs 1 through 9 of their
Preliminary Objections by reference as if set forth herein at
length,
11, Plaintiffs allege a breach of express warranty in
County II of their Complaint,
12, To support this allegation, Plaintiffs state that
"Defendant is a "seller" as defined by the Pennsylvania Uniform

Commercial Code", and that the product would PREVENT AGAINST ANY
FUTURE INFESTATION to their property." (emphasis added)
13, In order to state a cause of action for breach of an
express warranty, there must be a warranty,
14, In this situation, Defendants did not provide a
warranty to Plaintiffs with regard to future damage or repairs
thereto, which Plaintiffs have acknowledged in Paragraph 6 of
their Complaint,
15, Moreover, Defendants did not provide any "product" to
Plaintiffs,
16, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of express warranty,
17, Instead, they attempt by, mere generalization of the
Pennsylvania Uniform Commercial Code, to state a claim for breach
of express warranty,
18, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of express warranty,
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objections in the nature of a
demurrer with regard to Count II of Plaintiffs' Complaint and
dismiss Count II, with prejudice,

III, PRILININARY OBJICTION IN THI NATURI or A DIMURRIR
AS TO COUNT III
19, Defendants incorporate Paragraphs 1 through 18 of their
Preliminary Objections by reference as if set forth herein at
length.
20, Plaintiffs allege a breach of implied warranty in
County III of their Complaint,
21, Plaintiffs have failed to plead the requisite facts to
support their allegations of breach of implied warranty,
22, Instead, they attempt, by mere generalization of the
Pennsylvania Uniform Commercial Code, to state a claim for breach
of implied warranty.
23, As such, Plaintiffs have failed to plead a cause of
action against Defendants for breach of implied warranty,
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objections in the nature of a
demurrer with regard to Count III of Plaintiffs' Complaint and
dismiss Count III, with prejudice,
IV, PRILININARY OBJICTION TO STRIKE EXHIBITS ATTACHED TO
PLAINTIFrS' COMPLAINT
24, Defendants incorporate Paragraphs 1 through 23 of their
Preliminary Objections by reference as if set forth herein at
length,

25, Plaintiffs attach various exhibits to their Complaint,
in particular alleged estimates and documents relating to
damages, such as estimates and reports from Terminix, Erhlich,
and G,L, Rhoades Construction Co,
26, Pa,R,C,P. 1028(a) (2), states that a preliminary
objection may be filed by any party to any pleading and are
limited to the following grounds "." (2) failure of a pleading
to conform to law or rule of court or inclusion of scandalous or
impertinent matter,"
27, These aforementioned exhibits attached to Plaintiffs'
Complaint clearly demonstrate the inclusion of scandalous or
impertinent matter, which Pa,R,C.P, 1028(a) (2) prohibits.
WHEREFORE, Defendants hereby request that this Honorable
Court grant their Preliminary Objection and strike all of
Plaintiffs' exhibits concerning estimates and reports of damages,
which are attached to their Complaint,
