I, Plaintiff. Darbura Ann Alexander. is un adult individual residing utthe address in the ahove
caption,
2. Pluil1liff, Dawn Cochran, is un udult individuul residing utthe uddress in the uhove caption,
3. Defendunts, Louis II. Rounds and Jon W, Rounds, ure individuals who reside at the
address in the ahove cuption,
4, Atulltimes material hereto. Plaintiff. Darham Ann Alexander, was the operator of a 1987
Ford Tempo owned hy Lorriane Alexander.
5. At all times material hereto, Defendants. Louise H. Rounds and Jon W. Rounds were the
owners of a t989 Toyota Cmnry.
6. On or about February 4, 1994 at approx. 6:50 p.m., Plaintiff. Darhara Ann Alexander was
operating a vehicle with Plaintiff. Dawn Cochmn as a passenger traveling eastbound on 1-76 at the same
time and place Defendant, Louise H. Rounds was allempling to make an illegal u-turn and struck
Plaintiffs vehicle causing Plaintiffs severe personal injuries and property damage. all as hereinafter more
fully set forth,
COUNT I
Plaintiff, Darbara Ann Alexander v. Defendants
7, The averments of paragraphs I through 6 inclusive, arc incorpomted herein and made a
part hereof.
8. The negligence, recklessness, and carelessness of Defendant(s) consisted, illll!r alia, of the
following:
(a) opemting said motor vehicle at an excessive speed under the circumstances;
.
(b) failing to huve suid motor vehicle undcr propcr and adcquatc contrulut thc timc;
(c) failing to stop for tramc;
(d) operating said motor vchicle in a reckless manncr without regard for the rights and
safety of those luwfully upon the highwuy;
(e) failing to exercise due and proper cure;
(I) failing 10 give proper and sufficient warning of the approach of said motor vehiclc;
(g) fuiling 10 observc truffic und traflic conditions; and
(h) violution of Counly ordinunces and Ihc statules of Pennsylvania pertaining to thc
operution of motor vehiclcs.
9. Due loull thc foregoing. Pluintiff. Barbaru Ann Alexander. suffered severe and permancnt
injuries to her hcud, ncck, buck. shoulders, arms, Icgs und body, bones. musclcs, tendons, Iigamenls,
ncrvcs und tissucs of hcr hcad, ncck, buck, poslcrior thighs, urms, Icgs. body, loss of bodily functions,
including bUI not limited to fracturc of right anterior maxilary sinus, fructure of righl mediul malleolus,
fracture of right talus, righl sided intranasal laceration between the turbinate and lateral nasal wall, and
nervous shock and aggravation and/or exaccrbation of all known and unknown pre-exisling medical
conditions, internal injuries of :\11 unknown nature, severe aches, pains, mentalunxiety and anguish and
a scverc shock to hcr entire ncrvous system and olhcr injurics, the full extent of which is nOI yet known,
She has in the past. and will in Ihe future, undergo severe pain and suffering as a result of which shc hus
bcen in thc past and will in the future be unablc to attend to her usual dUlies. all to her great financiul
delriment and loss.

10. Due to all the foregoing, Plaintiff has been compelled, in order to effectuUle II cure for Ihe
aforesaid injuries, to expend large sums of money for medicine lInd medical allentioJ\ lInd may he
required 10 expend lIddilional sums for the same purpose in the fUlure.

12. As a result of all the foregoing, Plaintiff has suffered physical pain, mcntalllnguish, loss
of Iifc's pleasurcs lInd humililllion, and she may continuc to suffcr slime for an indclinite period of time
in the future.
WHEREFORE, PllIintiff, BlIrham Ann Ah:xander claim 1111 legally recoveruhle dmnages from the
Defendanl(s) in an amount in excess of Fifty Thousand ($SO,OQO,OQ) Dollars, together with the costs and
disbursemcnts of this action and dclay damages,

14. The negligcnce, recklessness, and carelessncss of Defendant(s) consisted, illler alia, of the
following:

IS, Due to ,.11 the foregoing, Plaintiff, Dawn Cochran, suffered severe and pernmnent injuries
to her head, neck, back, shoulders, anns, legs and body, bones, muscles, tendons, ligaments, nerves and
tissues of her head, neck, back, posterior thighs, anns, legs, body, loss of bodily functions, including
but not limited to multiple contusions, damage to tooth # 26, and nervous shock and aggravation and/or
exacerbation of all known and unknown pre-existing medical conditions, internal injuries of an unknown
nature, severe aches, pains, mental anxiety and anguish and a severe shock to her entire nervous system
and other injuries, the full extent of which is not yet known, She has in the past, and will in the future,
undergo severe pain and suffering as a result of which she has been in the past and will in the future be
unable to attend to her usual duties, all to her great financial detriment and loss,
16, Due to all the foregoing, Plaintiffs have been compelled, in order to efl'cctu,lle a cure for
the aforesaid injuries, to expend large sums of money for medicine and medical attention and may be
required to expend additional sums for the same purpose in the future,
17. As a result of all the foregoing, Plaintiffs have been prevented from attending to his/her
usual and daily activities and duties and may he so prevented for an indefinite period of time in the
future. all to their great detriment and loss and has sustained a loss of earnings capacity in this regard.
18, As a result of all the foregoing, Plaintiff has suffered physical pain, menlalnnguish, loss
of life's plensures nnd humilintion, and he/she may continue to suffer same for nn indel1nite period of
time in th;: future.
WHEREFORE, I'lnintiff, Dawn Cochmn c1nim nil legnlly recoverable dam:lges from the
Defendant(s) in nn amount in excess of Fifty Thousand ($50,000,00) Dollars, together with the costs nnd

the Plaintiff Barbara Ann Alexander is an adult individual. It is
believed, however, that the Plaintiff resides at 369 Springhouse
Road.

on February 4, 1994 at approximately 6:50 p.m. Plaintiff Barbara
Ann Alexander was operating a vehicle eastbound on 1-76 and that
Plaintiff Dawn Cochran was riding as a passenger in said vehicle.
It is further admitted that at the same time and place Defendant
Louise H. Rounds attempted to make a U-turn from the berm of the
eastbound lane. As a result of said action Plaintiff's vehicle
struck Defendants' vehicle. Defendants are without knowledge or
information sufficient to form a belief as to the nature and extent
of the injuries, if any, sustained by Plaintiffs or the property
damage resulting from the accident. The remaining averments in
paragraph 6 state legal conclusions to which no answer is required.
