COMPLAINT
AND NOW, comes the Plaintiff, Beneficial Consumer Discount
Company, d/b/a Beneficial Mortgage Co. of Pennsylvania by and
through its attorneys, Saidis, Guido, Shuff & Masland and
respectfully avers the following:
1. The Plaintiff is Beneficial Consumer Discount Company,
d/b/a Beneficial Mortgage Co. of Pennsylvania, doing business
at 1 South Hanover Street, Carlisle, Cumberland County,
Pennsylvania 17013.
2. The Defendants are Helena Davis, widow, and Sharon
Alice Davis, adult individuals residing at 151 W. North Street,
Carlisle, Cumberland County, Pennsylvania 17013.
3. The Plaintiff bringB this action to foreclose on a
mortgage dated August 26, 1994 by and between the Plaintiff and
Richard Davis, deceased, (date of death August 13, 1995) and
Helena Davis, his wife, and Sharon Alice Davis, Defendants
named herein, in the principal amount of Thirty-six Thousand
Dollars ($36,000.00); a copy of said Mortgage is attached
hereto and made a part hereof marked as Exhibit "A".
4. Said mortgage is and containB a lien against that
certain premises Bituate in the Borough of Carlisle, County of
CUmberland and Commonwealth of PennBylvania known and numbered
as 151 West North Street, Carlisle, Pennsylvania.
5. Pursuant to the terme of Baid Mortgage, the Plaintiff
advanced to the Defendant the Bum of Thirty-six Thousand
Dollars ($36,000.00).
6. Defendant defaulted under the terms of said loan by
failing to make the monthly payment for the month of October
31, 1991 and subsequent installments.
7. The Plaintiff has given to the Defendants a written
Notice of Intention to Foreclose on said Mortgage as required
by law under the Act 6, dated December 14, 1995; a copy of said
Notice is attached hereto and made a part hereof marked as
Exhibit "B".
8. The Plaintiff has given to the Defendants a written
Notice of Homeowners' Emergency Mortgage AssiBtance Act of
1983, the Act 91, dated December 14, 1995; a copy of Baid
Notice is attached hereto and made a part hereof marked aB
Exhibit "C".
9. To the best knowledge, information and belief of the
Plaintiff, the Defendants have not received financial

AND NOW COMES, the Plaintiff, Beneficial Consumer Discount
Company d/b/a Beneficial Mortgage Co. of Pennsylvania by and

respectfully answers the new matter as follows:
11. Denied; it is specifically denied that the attorney's
fees sought by the Plaintiff in the amount of $1,781.08 are
unreasonable. To plead further, the amount sought in the
Complaint repreBents 5% of the principal balance, which such
fixed percentage has not deemed to be per Be unreasonable.
Union Bankinq and Trust Company of DuBois v. Johnston, 28 D&C
3243 (1983). In the alternative, the $1,781.08 sought as part
of the attorney's fees will be in line with actual expenBes
incurred by the Plaintiff in order to bring the Foreclosure
Complaint againet these debtors.
12. Denied; it is specifically denied that the attorney's
fees Bought by the Plaintiff are unconBcionable. As stated
previouBly, the amount of $1,781.08 is a reasonable fee to be
charged for Defendants' breach of the mortgage agreement, and
for the Plaintiff to bring the subsequent mortgage foreclosure
action.
