You have been sued in court. If you wish to defend against the claims set forth in the
following pages, you must take prompt action. You are warned that if you fail to do so, the case
may proceed without you and a decree of divorce or annulment may be entered against you by the
Court. A judgment may also be entered against you for any other claim or relief requested in these
papers by the Plaintiff. You may lose money or property or other rights important to you, including
custody or visitation of your children.
When the ground for the divorce is indignities or irretrievable breakdown of the marriage,
you may request marriage counseling. A list of marriage counselors is available at the Domestic
Relations Office, 13 North Hanover Street, Carlisle, Pa. You are advised that this list is kept as a
convenience to you and you are not bound to choose a counselor from the list. All necessary
arrangements and the cost of counseling sessions are to be borne by you and your spouse. If you
desire to pursue counseling, you must make your request for counseling within twenty (20) days of
the date on which you receive this notice. Failure to do so will constitute a waiver of your right to
request counseling.

COUNT I
I. Plaintiff is Catherine Anne Stone, who currently resides at 1562 Boiling Springs
Road, Boiling Springs, Cumberland County, Pennsylvania, 17007.
2. Defendant is John Douglas Stone, who currently resides at 272 South West Street,
Carlisle, Cumberland County, Pennsylvania \7013.
3. Plaintiff and Defendant have been bona fide residents in the Commonwealth of
Pennsylvania for at least six months immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on December I, 1984 in Carlisle,
Cumberland County, Pennsylvania.
5. There have been no prior actions of divorce or for annulment between the parties.
6. The Plaintiff avers as the grounds on which the action is based:
a. The marriage is irretrievably broken, or in the alternative;
b. That the Defendant has offered such indignities to the person of the
Plaintiff, the innocent and injured spouse, as to render her condition intolerable and
life burdensome, and this action is not collusive.
7. Plaintiff has been advised that counseling is available and that Plaintiff may have the
right to request that the court require the parties to participate in counseling.
8. Plaintiff requests the Court to enter a decree of divorce.
COUNT II
CLAIM FOR EO! JlT ABLE DISTRIBUTION OF MARITAL PROPERTY
UNDER SECTION 3502 OF THE DIVORCE CODE
9. Plaintiff and Defendant are the joint owners as tenants by the entireties of certain real
estate which is subject to equitable distribution by this Court.
10. Plaintiff and Defendant are the owners of various items of personal property,
furniture and household furnishings acquired during their marriage which are subject to equitable
distribution by this Court.
II. Plaintiff and Defendant are the owners of various motor vehicles and bank accounts
acquired during their marriage which are subject to equitable distribution by this Court.
COUNT III
CLAIM FOR ALIMONY tINDER SECTION 3701 OF THE DIVORCE CODE
12. Plaintiff requests your Honorable Court to allow alimony as it deems reasonable
pursuant to Section 370 I of the Pennsylvania Divorce Code.

CLAtM FOR AI.IMONY PENDENTE UTE COUNSEL FEES AND EXPENSES
tINDER SECTION 3702 OF THE DIVORCE CODE
13. Plaintiff requests your Honorable Court to allow her alimony pendente lite,
reasonable counsel fees and expenses pursuant to Section 3702 of the Pennsylvania Divorce Code.

Dear Mr. Williams and Ms. Male:
By order of Court of President Judge Harold E. Sheely
dated December 31, 1996, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on January 23, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage and indignities. The complaint also raised the
economic issues of equitable distribution, alimony, alimony
pendente lite, and counsel fees and expenses.
I am unable to tell whether or not grounds for divorce
are an issue in the case but I am going to assume that the
parties will sign affidavits of consent. If that is not
correct, and the parties have not been separated for a period in
excess of two years, please advise and I will immediately
schedule a hearing on the alternative grounds for divorce of
indignities.
Based on my assumption that grounds for divorce are not
an issue, I am directing Mr. Williams, counsel for the
Plaintiff, and Mr. Stone, who is representing himself, to each
file a pre-trial statement in accordance with P.R.C.P.
1920.33(b) on or before Friday, January 24, 1997. Upon receipt
of the pre-trial statements, I will immediately schedule a
pre-hearing conference with Mr. Williams and Mr. Stone, to

January 16, 1997, indicating that she is going to enter her
appearance on behalf of Mr. Stone. The request for an extension
of time to file pre-trial statements is apparently agreed upon
between counsel. Therefore, the directive to file pre-trial
statements on or before January 24, 1997, is withdrawn. Counsel
are directed to each file a pre-trial statement in accordance

I am writing in response to Mr. Williams' letter of March
3, 1997, indicating that counsel are working toward a resolution
of the issues in the above referenced divorce proceedings. Mr.
Williams requested that the parties not be put to the expense of
filing a memoranda during negotiations. consequently, the
directive to file pre-trial statements on or before February 28,
1997, is withdrawn. No new directives will be issued unless the
Master is advised by counsel that the case is not settled.
If the case is settled I request that counsel provide me
with a copy of the signed agreement after which I will prepare
an order vacating my appointment.

I. Plaintiff is Catherine Anne Stone, an adult individual currently residing at 1562 Boiling
Springs Road, Boiling Springs, Cumberland County, Pennsylvania.
2. Defendant is John Douglas Stone, an adult individual currently residing at 272 South
West Street, Carlisle, Cumberland County, Pennsylvania.
3. Plaintiff seeks custody of their children Evan Allan Stone, who was born on August 9,
1988, and Elizabeth Anne Stone, who was born October 10, 1990.
The children were not bom out ofwedlock,
Since the children's births, the children have resided with the following persons at the
following addresses for the following periods of time:
The children have lived 81 Defendant's address for their entire lives, except from September
IS, 1995 through November 4, 1995, when the children lived there with Plaintiff only. After
November 4, 1995 and until January 18, 1996, the children lived there with both Plaintiff and
Defendant. As of January 18, 1996, the children moved with Plaintiff to her present address and live
there with Plaintiff and her mother, Josephine Evans,
The natural mother of the children is Plaintiff, Catherine Anne Stone, who resides as
aforesaid, She is married and living separately.
The natural father of the child is Defendant, John Douglas Stone, who resides as aforesaid,
He is married and living separately,
4, The relationship of the Plainliff to the children is thaI of mother. The Plaintiff currently

MOTION TO REAPPOINT CUSTODY CONCILIATOR
AND NOW, comes Plaintiff, Catherine A. Stone, by and through her attorneys, MARTSON,
DEARDORFF, WILLIAMS & OTTO, and avers as follows:
I. A Complaint to Confirm Custody was filed on January 30, 1996, a copy of which is
attached hereto as Exhibit "A".
2, Pursuant to that Complainl, the Court appointed Hubert X. Gilroy, Esquire as
Conciliator by Order dated February 8, 1996, a copy of which is attached hereto and marked as
Exhibit "B".
3. A conciliation conference was scheduled for February 29, 1996. It was continued
several times while the parties negotiated, and was finally canceled when the parties thought they
had an agreement regarding custody.
4. The Custody Conciliator relinquished jurisdiction on April 29, 1996 based on
representation from the parties that they had a cuslody agreement.
5. Unfortunalely, it seems the parties did nol have an agreement; consequently, it is
necessary to reappoint the Custody Conciliator.
6. As of the date hereof, counsel for the Defendant has not yet relurned a telephone call
to counsel for the Plaintiff, and so the Defendant's position on this Motion is unknown.

Pennsylvania.
3. Respondent filed a Complaint in Divorce on January 31,
1996.
4. Respondent alleges irretrievable breakdown under 3301 (c) ,
or alternatively, indignities as grounds for the divorce.
5. Petitioner desires to attempt reconciliation under the
provisions of the Divorce Code.

\. Plaintiff is Catherine Anne Stone, an adult individual currently residing at 1562 Boiling
Springs Road. Boiling Springs, Cumberland County, PeMsylvania.
2. Defendant is John Douglas Stone. an adult individual currently residing at 272 South
West Street, Carlisle, Cumberland County, PeMsylvania.
3. Plaintiff seeks custody of their children Evan Allan Stone, who was bom on August 9,
1988, and E1izabeth Anne Stone, who was born October 10, 1990.
The children were not bom out of wedlock.
Since Ihe children's births, the children have resided with the following persons at the
following addresses for the following periods of lime:
The children have lived at Defendant's address for their entire lives, except from September
15, 1995 through November 4, 1995. when the children lived there with Plaintiff only. After \
November 4, 1995 and until January 18, 1996, the children lived there with both Plaintiff and
Defendant. As ofJanuary 18, 1996. the children moved with Plaintiff to her present address and live
Ihere with Plaintiff and her mother, Josephine Evans.
The natural mother of the children is Plaintiff. Catherine Anne Stone, who resides as
aforesaid. She is married and living separalely,
The natural falher of the child is Defendant, John Douglas Stone, who resides as aforesaid.
He is married and living separately.
4. The relationship of the Plainlifflo the children is Ihat of mother. The Plaintiff currently

for leave to withdraw as counsel on behalf of Defendant in the
above-captioned custody proceeding as follows:
1. On or about February 12, 1996, Defendant retained
Petitioner to represent him in this action.
2. Professional considerations require termination of the
representation.
3. Defendant has failed substantially to fulfill an
obligation to Petitioner regarding Petitioner's services and has
been given reasonable warning that Petitioner will withdraw unless
the obligation is fulfilled.
4. Petitioner's representation of Defendant has been
rendered unreasonably difficult by Defendant.

AND NOW, comes Plaintiff, Catherine A. Stone, by her attorneys, MARTSON,

I. A Complaint in Divorce was filed on January 22, 1996 and served on the Defendant
on January 30, 1996.
2. Defendant has been continuously represented throughout this case.
3. Interrogatories were served on Defendant's counsel on October 16, 1996, a copy of
which is attached hereto and marked as Exhibit "A."
4. On March II, 1997, Defendant's counsel was requested to provided pension
information for evaluation by Plaintiff's counsel. A copy of that letter is attached hereto and
marked as Exhibit "B."
S. On March 17, 1997, Defendant's counsel was reminded that answers to the
interrogatories were overdue. A copy of that letter is attached hereto and marked as Exhibit "C."
6. As of this date, no answers to interrogatories have been served, nor has any
information been provided with regard to Defendant's pension.
WHEREFORE, Plaintiff requests Your Honorable Court to order and direct Defendant to
provide answers to the Plaintiff's interrogatories and the information regarding his pension to
