COMPLAINT
AND NOW, comes Plaintiff York Federal Savings and Loan Association, by and through its
attorney, Benjamin F, Riggs, Jr., and complains of Defendants, Eddie G. Chamberlin and Mary Jo
Chamberlin, as follows:
Parties
1. The Plaintiff is the YORK FEDERAL SAVINGS AND LOAN ASSOCIATION, a corporation
organized and existing under the laws of the United States of America, and it is registered to do business
in Pennsylvania, with offices for the purpose of doing business at 101 South George Street, York,
Pennsylvania.
2. The Defendants are Eddie G. Chamberlin and Mary Jo Chamberlin, who are husband and
wife and are adult individuals residing in the Mortgaged Premises at 311 Skyport Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055, and they are the mortgagors and real owners of said
Mortgaged Premises herein described, having acquired title by Deed dated March 25, 1988, and
recorded on March 28, 1988, in the Cumberland County, Pennsylvania, Recorder's Office in Record
Book G33, Page 36.
3. The UNITED STATES OF AMERICA is named as a Defendant in this action by reason of
privilege granted in an Act of Congress of the United States of America, pursuant to the provisions of 28
U.S.C. ~ 2410 and 26 U,S.C. ~ 7425, as amended.
Federal Tax Liens
4. The names and address of the taxpayers whose liability created federal tax liens on said
Mortgaged Premises are as follows: Eddie G. Chamberlin, 311 Skyport Road, Mechanicsburg, PA
17055.

5. The nature of any interests and tax liens of the United States of America is based on the
Notices of Liens duly filed by Defendant United States of America through the District Director of Internal
Revenue in Philadelphia, Pennsylvania, as follows:
(a) Lien Notice No. 239414943 dated November 4, 1994 filed in the Cumberland
County, Pennsylvania, Prothonotary's Office, Cumberland County Court House, Carlisle,
Pennsylvania, on December 29,1994 to Docket Number 1994-072.43, in the amount of
$44,952,68, together with interest to date, which lien is filed against taxpayer "Chamberlin
& Sons, a Partnership, and Eddie G. Chamberlin, General Partner".
(b) Lien Notice No. (illegible) dated March 6, 1995 filed in the Cumberland County,
Pennsylvania, Prothonotary's Office, Cumberland County Court House, Carlisle,
Pennsylvania, on March 24, 1995 to Docket Number 1995-01547, in the amount of
$14,810.89, together with interest to date, which lien is filed against taxpayer "Chamberlin
& Sons, a Partnership, Eddie G. Chamberlin, Robert L. Chamberlin, Rodney N.
Chamberlin, General Partners". ( A copy of this Lien is attached but parts are difficult to
read, )
(c) Lien Notice No. 239506862 dated May 19,1995 filed in the Cumberland County,
Pennsylvania, Prothonotary's Office, Cumberland County Court House, Carlisle,
Pennsylvania, on June 15, 1995 to Docket Number 1995-03216, in the amount of
$8,171.29, together with interest to date, which lien is filed against taxpayer "Chamberlin
& Sons, a Partnership, Eddie G. Chamberlin, General Partner."
True and correct copies of said Federal Tax Lien Notices are attached hereto, made a part
hereof, incorporated herein by reference, and marked "EXHIBIT A".
6. The liens of Defendant United States of America referred to in paragraph Sa, band c
above, having been filed respectively on December 29,1994, March 24,1995 and June 15,1995, are
subordinate in priority to the lien of the herein described Mortgage, which Mortgage was recorded in the
Cumberland County, Pennsylvania, Recorder's Office on February 27, 1991, as more fully hereinafter
described; and by filing this Action, Plaintiff, York Federal Savings and Loan Association seeks a judicial
sale of said Mortgage Premises herein described.

7. On or about February 22, 1991, Defendants made, executed, and delivered to Plaintiff a
mortgage upon premises therein described, which Mortgage contains a description of the premises
subject to said Mortgage and was recorded on February 27, 1991 in the Cumberland County,
Pennsylvania, Recorder's Office in Mortgage Book 1003, Page 993. A true and correct copy of said
Mortgage is attached hereto, made a part hereof, incorporated herein by reference, and marked
"EXHIBIT B".

8, There have been no assignments of said Mortgage.
Default
9. Said Mortgage Is in default because Defendants have failed to make the monthly payments
of principal and interest due and owing on their loan from May 1, 1995 through the date of filing this
Complaint as required by the terms of the Mortgage. Any payments that may have been made during
this period were applied to the delinquency balance due and owing prior to May 1, 1995,
10. Plaintiff hereby exercises its option to declare the entire amount owing upon said Mortgage
immediately due and payable in accordance with its terms and provisions.
11. By reason of the default, the following amounts are due in accordance with the terms of
said Mortgage:

Compliance With Homeowners' Emeroency Assistance Act
12. Notice of Defendants rights under Pennsylvania's Homeowner's Emergency Assistance
Act, Act of December 23,1983, P.L. 385, No. 91 (35 P.S. 9 1680.401cm ~.), as amended, was sent
in accordance with said Act to Defendants, Eddie G. Chamberlin and Mary Jo Chamberlin on July 10,
1995; and Defendants failed to exercise their rights under said Act. A true and correct copy of said
Notice is attached hereto, made a part hereof, incorporated herein by reference, and marked "EXHIBIT
C".
Inapplicability of Loan Interest and Protection Law
13. This Action is not subject to the provisions of Pennsylvania's Loan Interest and Protection
Law, Act of January 30, 1974, P.L. 13, No.6 (41 P.S. 9 101 m ~.), as amended, nor are notices
required to be sent to Defendants pursuant to said Act, because said Mortgage is not a "residential
mortgage" within the meaning of said Act.

Termination of Automatic Bankruptcy StaY
14. On or about August 18, 1995 Defendants, Eddie G. Chamberlin and Mary Jo Chamberlin,
filed Chapter 13 bankruptcy with United States Bankruptcy for the Middle District of Pennsylvania, which
bankruptcy case was docketed to Case No. 95-01613RJW.
15. On December 1, 1995, said Bankruptcy Court entered an Order term inating the automatic
stay arising from virtue of 11 U.S.C. !} 362(a) with respect to Plaintiff, and permitting Plaintiff to bring this
action to foreclose said Mortgage. A true and correct copy of said Order is attached hereto, made a part
hereof, incorporated herein by reference, and marked "EXHIBIT E".
WHEREFORE, Plaintiff, York Federal Savings and Loan Association, prays for the fOllowing:
A. Judgment in its favor and against Defendants, Eddie G. Chamberlin and Mary Jo
chamberlin, in the amount of Two Hundred Thirty Thousand Eighty-Five and 76/100 Dollars
($230,085.76), with interest thereon until paid at such rate or rates as established by Plaintiff pursuant
to the terms of the Adjustable Rate Note, currently 53.3382 per diem, from 1/18/96, late charges at 5%
of the monthly payment amount, currently $88.63 per month from 1/18/96, escrow charges, currently
$310.11 per month from 1/18/96, attorney's fees, costs of suit, and other charges collectible under the
Mortgage; for the foreclosure and sale of the mortgaged premises; and for any and all other relief as the
Court deems appropriate; and
B. Judgment against Defendant United States of America in order that said Federal Tax Liens
of the United States of America be discharged, and that the sale on said Mortgage may have the effect
of a judicial sale as provided in 28 U.S.C, !} 2410, as amended; but said jUdgment against Defendant
United States of America is to be without liability for costs.

STIPULATION
It is hereby stipulated and agreed by and between counsel for plaintiff, and
the defendant, United States of America, as follows:
1. That the premises referred to in the Complaint is owned by the defendants.
2. That the Federal tax liens referred to in paragraph "5" of the plaintiffs
Complaint in the amounts of $44,952.68, $14,810.89 and $8,171.29 are junior in time to the
plaintiffs mortgage set forth in paragraph "7" of said Complaint.
3. That the defendant, United States of America, agrees to the entry in this
action ofajudgment in favor of the plaintiff and against the United States of America for foreclosure
and sale of the mortgaged property.
4. That the Defendant, United States of America, is not indebted to the
Plaintiff.
5. That the aforesaid premises shall be sold at ajudicial sale, notice of which

shall be served on the defendant, United States of America.
6. That the judicial sale of said property shall discharge the Federal Tax Liens
referred to in paragraph "5" of Plaintiffs Complaint.
7. That the proceeds of sale shall be divided and distributed as the parties may
be entitled and any funds due the United States shall be sent to the Financial Litigation Unit, United
States Attorney's office, Suite 309, Federal Building, Scranton, Pennsylvania 1850 I.
8. That the defendant, United States of America, preserves its right of
redemption as provided in Title 28, United States Code, Section 241O(c).
9. The parties to this Stipulation shall bear their own respective costs in this
proceeding.

AND NOW, comes the Plaintiff, York Federal Savings and Loan
Association by its attorney, Benjamin F. Riggs, Jr., moves this Honorable Court
as follows:
1. On January 24, 1996, Plaintiff filed its Complaint initiating an action
in mortgage foreclosure with the Prothonotary of the Cumberland County Court
of Common Pleas regarding property located at311 Skyport Road,
Mechanicsburg, (Hampden Township, Cumberland County) Pennsylvania
17055.
2. Plaintiff was unable to get a mailing address for the lien creditor,
Shettel & Sons, Inc., who has a fourth and fifth mortgage on the foreclosed
property listed in number 1 above.
3. Plaintiff has made various attempts to ascertain a new address for
the lien creditor, Shellel & Sons, Inc., at which a notice of sheriffs sale could be
mailed, said attempts being set forth in an affidavit attached hereto and made a
part hereof as Exhibit "A".

4. Plaintiff, pursuant to Rules 430 and 3129.2 of the Pennsylvania
Rules of Civil Procedure, desires to obtain a special order directing the method
of service of the Notice of Sheriffs Sale upon Lien Creditor Shellel & Sons, Inc.
WHEREFORE, Plaintiff moves this Honorable Court for an Order
authorizing service of Plaintiffs Notice of Sheriffs Sale on lien creditor Shettel &
Sons, Inc, by advertising notice of sheriffs sale one time only in The Patriot
