COMPLAINT IN MORTGAGE FORECLOSURE
AND NOW, comes the Plaintiff by its attorneys, Louis P. Vitti and Associates, P.C.
and Louis P. Vitti, Esquire, and pursuant to the Pennsylvania Rules of Civil Procedure
Numbers 1141 through 1150, for its Complaint in Mortgage Foreclosure, sets forth the
following:
1. The Plaintiff is a corporation duly authorized to conduct business within
the laws of the Commonwealth of Pennsylvania, having a principal place of business located
at 405 S.W. 5th Street, Des Moines, lA,
2. The Defendant(s) is/are individuals residing at 708 Shaffer Street, Enola, PA
17025. The property address is the same as above and is the subject of this action.
3. On the 18th day of January, 1993, in consideration of a loan of Sixty Six
Thousand Four Hundred Fifty and 00/100 ($66,450,00) Dollars made by First Advantage
Mortgage Corp" a MD corporation, to Defendants, the said Defendants executed and
delivered to First Advantage Mortgage Corp" a MD corporation, a "Note" secured by a
Mortgage with the Defendants as mortgagors and First Advantage Mortgage Corp" as
mortgagee, which mortgage was recorded on the 19th day of January, 1993, in the Office
of the Recorder of Deeds of Cumberland County, in Mortgage Book Volume 1113, page
1195. The said mortgage is incorporated herein by reference thereto as though the same

5, On the 26th day of March, 1993/ First Advantage Mortgage Corp" a MD
corporation, assigned to the Plaintiff, Norwest Mortgage, Inc" the said mortgage, that
assignment being recorded in the Office of the Recorder of Deeds of Cumberland County
on the 26th day of March, 1993/ in Mortgage Book Volume 440, page 654, The said
assignment is incorporated herein by reference,
6, Said mortgage provides, inter alia:
"that when as soon ,15 the prindpal debt secured shall become due and
payable, or in case deiault shall be made in the payment or any installment

of principal and interest, or any monthly payment, keeping and performance
by the mortgagor of any of the terms, conditions or covenants of the mortgage
or note, it shall be lawful for mortgagee to bring an Action of Mortgage
Foreclosure, or other proceedings upon the mortgage, of principal debt,
interest and all other recoverable sums, together with allorney's fees."
7. Since May 1/ 1995, the mortgage has been in default by reason, Inter alia,
of the failure of the mortgagor to make payments provided for in the said mortgage
(including principal and interest) and, under the term~ of the mortgage, the entire principal
sum Is due and payable,
8, In accordance with the appropriate Pennsylvania Acts of Assembly and the
Pennsylvania Rules of Civil Procedure, the mortgagor has been advised In writing of the
mortgagees intention to foreclose. The appropriate time period has elapsed since the Notice
of Intention to Foreclose has been served upon the mortgagor,
9, The amount due on said mortgage is itemized on the allached schedule,
10. Plaintiff does hereby release the personal representative, heir and/or
devisee of the mortgagor from liability for the debt secured by the mortgage,
WHEREFORE, pursuant to Pennsylvania Rule of Civil Procedure Number
1147(6)/ Plaintiff demands judgment for the amount due of Seventy Five Thousand Three
Hundred Eighty Six and 59/100 Dollars ($75,386,59) with interest and costs,

TO THE HONORABLE JUDGES OF SAID COURT:
AND NOW, comes the Defendant, MARIA E, SWEENEY, by and
through her aUorney, Erich M. Diehl, Esq., and raises the following Preliminary
Objections to the Complaint under Pa. R. Civ. P 1028 (a)(5) and avers as
follows:
1, PLAINTIFF LACKS THE CAPACIT'i TO SUE THE DEFENDANT
a. The mortgage identified in the Complaint is a Federal Housing
Authority mortgage. It is governed by U,S. Department of Housing and Urban
Development (HUD) Regulations. In December of 1995, the defendant applied
to HUD for mortgage assistance, Under the HUD Mortgage Assignment Plan, 24
CFR 203,659, the Plaintiff was barred from taking any action to foreclose on the
defendant's mortgage once the defendant applied for mortgage assistance. The
Plaintiff was advised of this HUD regulation on January 17, 1996. Attached
hereto and marked as Exhibit "A" is a letter to the Plaintiff from HUD advising the
Plaintiff that it is precluded by federal law from initiating a mortgage foreclosure
action against the defendant.
WHEREFORE, the defendant, Maria E. Sweeney, respectfully requests
that this Honorable Court will dismiss the Plaintiffs Complaint.
