The Plaintiff is First Deposit National Bank, a national bank with a place of business located at 219 Main Street, Tilton, NH. 2. The Defendant is Rosalie Piper A/k/a Rinehart, an individual with a place of residence located at 104 West Big Spring Avenue, Newville, PA 17241-1609. 3. At the request of the Defendant, Plaintiff issued to Defendant a VISA credit card, account number 4428002770200923 and at all times relevant hereto, Defendant was the holder of said card issued through Plaintiff's credit facilities. A true and correct copy of Defendant's application is attached hereto, made a part hereof and marked Exhibit "A". 4. Under the terms and conditions of Exhibit "A", Defendant, upon acceptance of Plaintiff's credit card, agreed to be bound by the terms and conditions of Plaintiff's revolving credit plan agreement. A true and correct copy of said agreement is attached hereto, made a part hereof and marked Exhibit "B". 5. The Defendant subsequently received a cash advance from Plaintiff and incurred additional obligations in the sum of 10,252.33, no part of which has been paid since 13 NOV 199~ although duly demanded. A true and correct copy of a statement of account in connection with said credit card is attached hereto, made a part hereof and marked Exhibit "C". 6. Notwithstanding the frequent demands by Plaintiff for payment of the amount due, there has been a failure and refusal by the Defendant to pay the same or any part thereof. 7. In accordance with the terms of Exhibit "B", Defendant agreed to pay the Plaintiff a finance charge on all sums due at an annual percentage rate of 21.90% and Plaintiff is entitled to additional finance charges from 28 OCT 1995. 8. In accordance with the terms of Exhibit "B", Defendant agreed to pay to plaintiff a reasonable attorney's fee if the account was referred to an attorney for collection, and Plaintiff will incur an attorney's fee in the amount of 2,050.00. WHEREFORE, Plaintiff demands judgment against the Defendant in the sum of $10,252.33 plus interest from 28 OCT 1995 plus attorney's fees of 2,050.00 less payment of .00 and costs of this action.
