COMPLAINT IN MORTGAGB PORBCL08URB
1. The Plaintiff, Vivian L. Greene, a single woman, brings
this action to foreclose a Mortgage dated November 30, 1987,
between Marvin Berger and Karla F. Berger, his wife, Mortgagors,
and Vivian L. Greene, Mortgagee, which is recorded in the
cumberland County Recorder of Deeds Office in Mortgage Book 888,
Page 852.
2. The Defendants, Marvin Berger and Karla F. Berger, who
are real owners of the land subject to the Mortgage and their
addresses are:

3. The land subject to the Mortgage is known as 4004 Trindle
Road, Lots 7, 8 and 9 of Oakwood Park, situate in Hampden Township,
Cumberland County, Pennsylvania.
The legal description Of the
property subject to the Mortgage is set forth in the Mortgage which
is incorporated herein by reference and attached hereto as Exhibit
A.
4. On or about November 30, 1987, in consideration of a loan
of One Hundred Thousand Dollars ($100,000.00) to Defendants, made
by Plaintiff, the Defendants executed and delivered to Plaintiff a
Bond secured by a Mortgage with the Defendants as Mortgagors and
Plaintiff as Mortgagee, which Mortgage was recorded on December 3,
1987, in the Cumberland County Recorder of Deeds Office and indexed
in Mortgage Book 888, Page 852. The said Mortgage is incorporated
herein by reference and attached hereto as Exhibit B.
5. On or about April 26, 1993, the parties entered into a
Modification of Mortgage Bond providing for modifications and
confirming a then current balance of $88,700.00. Said Modification
is incorporated herein by reference and attached hereto as Exhibit
C.
6. Said Mortgage provides, inter alia:
And it is further agreed and understood, that in case
default be made at any time in the payment of the
principal debt or any installment of principal debt or
interest, or any part thereof, or of any taxes, municipal
assessments, charges or premiums of insurance aforesaid,
for thirty (30) days after the same falls due as
aforesaid, the whole of the said debt and interest and
additions thereto as aforesaid shall, at the option of

the party of the second part, her heirs, executors,
administrator or assigns, become due and payable
forthwith; and thereupon an action of mortgage
foreclosure as now provided by Pennsylvania Procedural
Rules 1141 to 1148, both inclusive, or other appropriate
proceedings, now or hereafter prescribed by law, may
forthwith be commenced and prosecuted to judgment,
execution and sale, for the collection of the whole
amount of the said debt and interest remaining unpaid,
together with all premiums of insurance, and all taxes,
municipal assessments and charges, and all fees, costs
and expenses of such proceedings, including attorney's
commission of five percent of the principal sum. And all
errors in said proceedings, together with all stay of or
exemption from execution, or extension of time of payment
which may be given by any Act or Acts of Assembly now in
force, or which may be enacted hereafter, are hereby
forever waived and released.
7. The mortgage is in default because the Defendants have
failed to make mortgage payments from June 1, 1995, to the present,
as required by the terms of the Mortgage.
8. In accordance with the within Mortgage, Plaintiff is
entitled to attorney's fees, interest, costs and late fees.
9. The following amounts are due on the Mortgage:
A. Principal balance $82,451. 26
B. Late charges 338.75
c. Interest to 1/20/96 5,873.24
O. Attorneys' fees
(5% of the principal
balance) 4.122.57
E. TOTAL $92,785.82

THIS ~GRBBJIDlT made this day by and between ICARVIH BERGER and
KARLA P. BBRGER, his vife, of Cumberland county Pennsylvania
(hereinafter "Obligors") and
VIVIAN L. GRBENB, a sinqle person, of Cumberland County,
pennsylvania (hereinafter "Obligee").
WBERBAS, the Obligors by their Mortgage Bond (hereinafter
"Bond") dated November 30, 1987, are held and firmly bound unto
Obligee in the penal sum of Two Hundred Thousand Dollars
($200,000.00), lawful money of the United states of America, in the
event of failure to pay on an obligation of One Hundred Thousand
Dollars ($100,000.00) with interest at the rate of ten percent
(lOt) per annum payable in equal consecutive monthly installments
of Nine Hundred sixty-Five Dollars and Two Cents ($965.02)
commencing December 30, 1987, until November 30, 1992, at which
time the final principal balance together with any accrued or
unpaid interest shall be paid in full. The said Bond is secured by
a mortgage dated November 30, 1987, and recorded on December 3,
1987, in Mortgage Book 888, Page 852 in the Recorder of Deeds
Office of Cumberland County, Pennsylvania, on real estate located
in Hampden Township, Cumberland county, Pennsylvania, as more fUlly
described in said mortgage; and

WBBRBAS, the parties agree to modifY certain terms of the said
Bond to provide for an extension of the final due date to November
30, 1997~ and

NOW, THBRErORB, the parties hereto agree as follows:
1. The Bond shall be amended to provide that final payment
is due on or before November 30, 1997, at which time the then
remaining principal together with any accrued and unpaid interest
shall be paid in full.
2. All payments received later than five (5) days after its
due date shall be subject to an additional charge of five percent
(5%) of the said payment which shall be immediately due.
3. Except as herein modified or inconsistent herewith, all
other terms and conditions of the said Bond shall remain in full
force and effect as originally set forth therein.
IN WITNESS WBEREOr, with intent to be legally bound hereby,
the undersigned have executed and sealed this Modification as of
the day and year first above written.
