COMPLAINT
The Plaintiff, Angela K. Welcomer ("Ms. Welcomer"), by her
attorneys, Thomas, Thomas & Hafer, files this Complaint against the
Defendants.
1. Ms. Welcomer is an adult individual who resides at
2116 Cedar Run Drive, Camp Hill, Cumberland County, Pennsylvania
17011.
2. The Defendant, CB Realty Partners, is a partnership which
does business at 26 North Ninth Street, Lemoyne, Cumberland County,
Pennsylvania 17043.
3. The Defendants, Robert L. Creason, Donald R. Kingsbury,
James D. Pace and Jean R. Stielper, are adult individuals,
residents of Pennsylvania, who are partners in CB Realty Partners.
CB Realty Partners and those individuals shall be referred to
hereinafter collectively as "CB Realty."
4. At all times relevant hereto, CB Realty owned, possessed
and controlled premises known as 26 North Ninth Street, Lemoyne,
Pennsylvania 17043, including the offices rented by Lord & Co., and
the parking lot adjacent thereto.
5 . On January 28, 1994, Ms. Welcomer was an employee of Lord
& Co.
6. At approximately 1:00 p.m. on January 28, 1994,
Ms. Welcomer was injured when she slipped on ice or snow in said
parking lot and fell.
7. At the time, said lot, or parts thereof, was covered by
ice and snow, including hills, ridges and ruts.
8. On said date, Ms. Welcomer, a business invitee, did slip,
stumble and/or trip and fall as a result of coming into contact
with hills, ridges and ruts of ice and/or snow as a result of which
she sustained serious personal injuries and damages described
herein.
9. The Defendants knew or should have known of the condition
of the parking lot, including the presence of hills, ridges and
ruts of ice and snow, a sufficient time prior to the incident in
which to have taken appropriate corrective measures.
10. Ms. Welcomer's injuries and damages were caused by the
negligence of the Defendants.
11. The negligence of the Defendants included the following:

(a) failing to properly clean and maintain the
parking lot and premises;
(b) failing to properly salt and/or take other
necessary measures to remove the ice, snow, hills, ridges
and ruts;
(c) failing to properly inspect the premises;
(d) allowing the parking lot and premises to be,
become and remain in a dangerous, non-safe condition;
(e) failing to use reasonable and prudent care to
keep the parking lot and premises in a safe condition;
(f) violating local ordinances relating to the
removal or treatment of ice and snow.
12. As a direct result of the negligence of the Defendants,
Ms. Welcomer sustained serious and permanent personal injuries
including but not limited to a bilateral sacroiliac sprain, sprain
or strain of her lower back, a severe shock to her nerves and
nervous system, and other injuries and conditions that may be
established, all of which have caused and will continue to cause
her great pain and suffering and have limited or prevented her and
will continue to limit or prevent her in the future from attending
to her daily duties, activities and pleasures.
13. Further, by reason of the aforesaid, Ms. Welcomer has
been obliged to expend various sums of money for medicine and

medical attention in the treatment of her injuries and may be
obliged to expend additional sums of money for the same purposes in
the future, all to her great financial damage and loss.
14. As a further result of the aforesaid, Ms. Welcomer may
suffer a loss of earnings and/or an impairment of earning capacity.
WHEREFORE, the Plaintiff, Angela Welcomer, demands judgment in
her favor and against the Defendants for damages in excess of
$25,000, plus costs and interest.

A pretrial conference was held in the chambers of
Judge Oler in the above-captioned caso on Wednesday, August 26,
1998. Present on behalf of the Defendants was William P.
Douglas, Esquire, who had previously submitted a pretrial
memorandum. Plaintiff, who is pro se, did not appear at the
pretrial conference and did not submit a pretrial memorandum.
This is a negligence action for personal injuries
arising out of an alleged slip and fall on ice or snow in a
parking lot. The accident allegedly occurred on January 28,
1994.
By separate Order of Court, the complaint in this
matter is being di~missed because of Plaintiff's failure to
attend the pretrial conference and failure to submit a pretrial
memorandum.

PETITION FOR PERMISSION
TO WITHDRAW AS COUNSEL
1. The Plaintiff, Angela Welcomer, made a claim for workers'
compensation benefits from Mutual Benefit Insurance Company as a
result of the accident in question.
2. Mutual Benefit retained the law firm of Thomas, Thomas &
Hafer, to pursue a subrogation action for recovery of such
benefits.
3. Angela Welcomer was invited to join in that action for
recovery of any additional losses, and she chose to do so.
4. Mutual Benefit subsequently decided that it did not wish
to pursue this matter and concurs in this Petition.
5. A fundamental disagreement as to the handling of this
action has arisen between the Plaintiff, Angela Welcomer, on the
one part, and Peter J. Speaker and law firm of Thomas, Thomas &
Hafer on the other part, such that it is appropriate for Peter J.
Speaker and the law firm of Thomas, Thomas & Hafer to withdraw as
counsel in this matter.
6. Upon withdrawal, the entire file will be made available
to the Plaintiff, Angela Welcomer, and she will be free to obtain
other counsel if she chooses to continue with the action.
WHEREFORE, Peter J. Speaker and the law firm of Thomas, Thomas
& Hafer, respectfully petition the Court to grant them permission
to withdraw as counsel in this matter.

1. On or about December 31, 1997, Peter J. Speaker, Esquire,
and the law firm of Thomas, Thomas & Hafer, LLP, filed a Petition
"Exhibit A" is a true and correct copy of said Petition.
2. On or about January 5, 1998, counsel for Defendants filed
a Response to the Petition, agreeing to the request to withdraw as
counsel for Plaintiff. Attached hereto as "Exhibit B" is a true
and correct copy of Defendants' Response.
3. On January 6, 1998, the Court issued a Rule to Show
Cause, if any, why said Petition should not be granted. The Rule
was returnable within fifteen (15) days of service thereof.

1. The Plaintiff, Angela Welcomer, made a claim for workers'
compensation benefits from Mutual Benefit Insurance Company as a
result of the accident in question,
2. Mutual Benefit retained the law firm of Thomas, Thomas &
Hafer, to pursue a subrogation action for recovery of such
benefits.
3. Angela Welcomer was invited to join in that action for
recovery of any additional losses, and she chose to do so.
4. Mutual Benefit subsequently decided that it did not wish
to pursue this matter and concurs in this Petition.
5. A fundamental disagreement as to the handling of this
action has arisen between the Plaintiff, Angela Welcomer, on the
one part, and Peter J. Speaker and law firm of Thomas, Thomas &
Hafer on the other part, such that it is appropriate for Peter J.

Speaker and the law firm of Thomas, Thomas & Hafer to withdraw as
counsel in this matter.
6. Upon withdrawal, the entire file will be made available
to the Plaintiff, Angela Welcomer, and she will be free to obtain
other counsel if she chooses to continue with the action.
WHEREFORE, Peter J. Speaker and the law firm of Thomas, Thomas
& Hafer, respectfully petition the Court to grant them permission
to withdraw as counsel in this matter.

A pretrial conference was held in the chambers of
Judge Oler in the above-captioned case on Wednesday, August 26,
1998, Present on behalf of the Defendants was William P.
Douglas, Esquire, who had previously submitted a pretrial
memorandum, Plaintiff, who is pro se, did not appear at the
pretrial conference and did not submit a pretrial memorandum.
This is a negligence action for personal injuries
arising out of an alleged slip and fall on ice or snow in a
parking lot, The accident allegedly occurred on January 28,
1994,
By separate Order of court, the complaint in this
matter is being dismissed because of plaintiff's failure to
attend the pretrial conference and failure to submit a pretrial
memorandum,
