Plaintiff : IN THE COURT OF COMMON PLEAS OF : CUMBERLAND COUNTY. PENNSYLVANIA /' 96-0443 CIVIL vs. WILLIAM RUMMEL. Dcfcndant CIVIL ACTION - LAW IN RE: PRETRIAL CONFERENCE Prcscnt at a prctrial confercnec held this datc were John D, Briggs, Esquirc, attorncy for plaintiffs and Rolf E, Kroll. Esquire, attorney for dcfendant, These arc mailers consolidated for trial whieh arise out of a motor vchicle accident that occurred on March 29, 1994. The defcndant concedes ncgligenee though causation and thc dcgrec of thc injury arc eontcsted. It was gcnerally agrecd that in the event sums are awarded for lost wages. the amount will necd to be molded to rcflect first party benefits received, 'nle defendant intends to proffer the testimony of an enginecr who. in turn, will quote from a study on speed and impact, This testimony would appear to be admissible provided the cngincer ean lay the proper foundation, Onc ofthc plaintiff's in this easc sullers from myofacial pain syndrome, The plaintiff's .. .' expert has not opined that this eondition is pennanent, We agree with counsel for the defendant that the plaintiff cannot argue that it is pennanent, though we agree with the plaintiff that the duration of the condition is for the jury, The above mentioned engineer is from the state of Tennessee. Because ofthe distance which this witness must trovcl. counsel have an interest in a precise trial date as soon as possible. The preference would be to begin on Monday. Though this case joins two plaintiffs, counsel agreed to four peremptory challenges apiece. October 22, 1997 ,Ad John D.
