It was gcnerally agrecd that in the event sums are awarded for lost wages. the amount will
necd to be molded to rcflect first party benefits received,

expert has not opined that this eondition is pennanent, We agree with counsel for the defendant
that the plaintiff cannot argue that it is pennanent, though we agree with the plaintiff that the
duration of the condition is for the jury,
The above mentioned engineer is from the state of Tennessee. Because ofthe distance
which this witness must trovcl. counsel have an interest in a precise trial date as soon as possible.
The preference would be to begin on Monday. Though this case joins two plaintiffs, counsel
agreed to four peremptory challenges apiece.

Plaintiff, Lawrence Whitley. by his allomey. John D, Briggs, Esquire, files this
Complaint. and states the following:
PARTIES
I. Plaintiff, Lawrence Whitley, is an adult individual residing at 6353 Locust Lane.
Mechaniesburg, PA 17055,
2, Defendant, William Rummel. is an adult individual residing at48 Fickes Road.
Newville. PA 17241.
OPERATIVE FACTS
3. On or about March 29, 1994, at approximately 4:30 PM. Plaintiff was the owner
and operator of a 1979 GMC Caballero.

4. Plaintiff's vehicle was stopped in the eastbound lane ofR\. 944 in the vicinity of
the intersection of Pine Hill Road, Cumberland County. PA,
5, At the aforesaid time and place, the Defendant. William Rummel, was traveling
eastbound on Rt. 944 in a 1987 Ford Escort. PA license tag # EWC204, owncd by Lorraine M.
Ferguson, 48 Fickcs Road. Newville. PA,
6, At the aforesaid time and placc, the Defendant. William Rummel. struck the rear
of the Plaintilrs vehicle,
7, As a result of the aforesaid accident, Plaintiff suncred injuries. which include, but

8, As a result of the Defendant's negligence, Plaintiff has been forced to incur
medical expenses in the treatment of his injuries and will continue to incur medical expenses in
the future treatment of his injuries,
9. As a result of the Defendant's negligence. Plaintiff has sustained or will sustain
the following damages:
a, Pust and future pain and suffering;
b. Pust and future embarrassment, humiliation and mental anxiety;
c. Pust and future incidcntal costs;
d, Post and future loss oflife's enjoymcnt:
e. Pust and future loss of cumings and earning capacity which has or may
exceed the applicable limits of the Pennsylvania Motor Vehicle
Responsibility Insurance Act,

11. At the time of the occident. Defendant William Rummel owed PlaintilTa duty to
operate Lorraine Ferguson's vehicle in 0 careful, prudcnt and reasonable manner.
12, Said accident and 011 of the aforesaid injuries and damages sustained by thc
Plaintiff are the direct and proximate result of the negligent. careless and reckless manner in
which Defendant acted or foiled to act in thc following particulars:
a) foiling to make reasonablc and prudent observations ofthe conditions thcn
existing;
b) opemting the vehicle at an excessive rate of speed given the conditions and
cireumstances then existing;

c) failing to maintain reasonable and propcr control of the vehicle he was
operating;
d) operating his vehicle in violation of the Pennsylvania Motor Vehicle Code. 75

e) failing to allow an assured clear distance within which to stop his vehicle;
l) failing to keep reasonable and proper attention to the roadway while operating
the vehicle;
g) failed to see the Whitley vehicle had stopped to make a len turn onto Pine Hill
Road;
h) failing to bring his vehicle to a stop before striking the rear of Plaintirrs
vehicle,
13. The carelessness, recklessness and negligence of the Defendant as hereinabove
more fully described was a substantial factor in causing the aforesaid incident and resulting
injuries and damages sustained by Plaintiff,
WHEREFORE. Plaintiff Lawrence Whitley demands judgment against Defendant
William Rummel for compensatory damages in an amount in excess of $25,000.00 together with
interest and costs of suit.

TO CONSOLIDATE PURSUANT TO PA. R.CIV. P. NO. 213Cal
AND NOW, comes Defendant William Rummel, by and through his
counsel, Reynolds & Havas, a professional corporation, and files
this Motion to consolidate the above-captioned actions, assigning
the following reasons:
1. On March 29, 1994, a vehicle operated by William
Rummel, Defendant in both of the above-captioned actions, was
involved in a motor vehicle accident on Route 944, Cumberland
County, Pennsylvania.

2. The other vehicle involved in the above-described
accident was operated by Lawrence Whitley, plaintiff at
Cumberland County Docket No. 96-00443.
3. Susan Schorr, plaintiff at Cumberland County Docket No.
95-1178, was a passenger in the vehicle operated by Plaintiff
Lawrence Whitley (Docket No. 96-00443).
4. Plaintiff Schorr and Plaintiff Whitley both allege that
they were injured as a result of the negligence of Defendant,
which negligence is alleged to have caused the aforesaid motor
vehicle accident.

S. Plaintiff Schorr and Plaintiff Whitley are represented
by John D. Briggs, Esquire, in their respective actions.
6. Defendant Rummel is represented in both actions by Rolf
E. Kroll, Esquire.
7. Pa. R.Civ.P. No. 213(a) provides:
In actions pending in a county which involve a
common question of law or fact or which arise
from the same transaction or occurrence, the
court on its own motion or on the motion of
any party may order a joint hearing or trial
of any matter and issue in the actions, may
order the actions consolidated, and may make
orders that avoid unnecessary costs or delay.
8. The above-captioned actions arise out of the same motor
vehicle accident, involve the same Defendant, and Plaintiffs were
in the same vehicle at the time of the accident.

9. Therefore, the above-captioned actions involve a common
question of law or fact and arise out of the same transaction or
occurrence.
10. Moreover, in the interests of judicial economy and to
avoid the possibility of inconsistent verdicts, jury confusion,
and the duplication of effort and expense, the above-captioned
cases are properly consolidated for the purposes of trial.
WHEREFORE, Defendant William Rummel prays that this

AND NOW, comes Defendant William Rummel, by and through his
counsel, Reynolds & Havas, a professional corporation, and files
this Motion to consolidate the above-captioned actions, assigning
the following reasons:
1. On March 29, 1994, a vehicle operated by William
Rummel, Defendant in both of the above-captioned actions, was
involved in a motor vehicle accident on Route 944, CUmberland
County, Pennsylvania.
S. Plaintiff Schorr and Plaintiff Whitley are represented
by John D. Briggs, Esquire, in their respective actions.
6. Defendant Rummel is represented in both actions by Rolf
E. Kroll, Esquire.
7. Pa. R.Civ.P. No. 213(a) provides:
In actions pending in a county which involve a
common question of law or fact or which arise
from the same transaction or occurrence, the
court on its own motion or on the motion of
any party may order a joint hearing or trial
of any matter and issue in the actions, may
order the actions consolidated, and may make
orders that avoid unnecessary costs or delay.
8. The above-captioned actions arise out of the same motor
vehicle accident, involve the same Defendant, and Plaintiffs were
in the same vehicle at the time of the accident.

2. The other vehicle involved in the above-described
accident was operated by Lawrence Whitley, Plaintiff at
CUmberland County Docket No. 96-00443.
3. Susan Schorr, Plaintiff at Cumberland County Docket No.
95-1178, was a pasoenger in the vehicle operated by Plaintiff
Lawrence Whitley (Docket No. 96-00443).
4. Plaintiff Schorr and Plaintiff Whitley both allege that
they were injured as a result of the negligence of Defendant,
which negligence is alleged to have caused the aforesaid motor
vehicle accident.
9. Therefore, the above-captioned actions involve a common
question of law or fact and arise out of the same transaction or
occurrence.
10. Moreover, in the interests of judicial economy and to
avoid the possibility of inconsistent verdicts, jury confusion,
and the duplication of effort and expense, the above-captioned
cases are properly consolidated for the purposes of trial.
WHEREFORE, Defendant William Rummel prays that this
Honorable Court enter an Order consolidating these cases for
purposes of trial pursuant to Pa. R.Civ.P. No. 213(a).

WHEREFORE, Defendant William Rummel demands that judgment be
entered in his favor and against Plaintiff Lawrence Whitley, with

15. Plaintiff has failed to state a claim upon which relief
can be granted.
16. Plaintiff's claims are barred by the doctrines of
contributory and comparative negligence.
17. Plaintiff's claims are barred by the doctrine of
assun~tion of risk.
18. Defendant was confronted with a sudden emergency not of
his own creation to which he responded reasonably under the
circumstances.
19. Plaintiff's claims are barred by the applicable statute
of limitations.
20. The named insured of the automobile insurance policy
covering Plaintiff elected coverage under the limited tort option
offered under that policy in accordance with the terms of the
Pennsylvania Motor Vehicle Financial Responsibility Law.
21. Plaintiff's claims are barred in whole or in part by
the terms and conditions of the Pennsylvania Motor Vehicle
