BLACKER Detendant COMPLAINT IN ASSUMPSIT AND NOW, comes the Plaintiff, COMMUNITY BANKS, N.A., by its Attorney, Allen Shaffer, and says: 1. The Plaintiff, COMMUNITY BANKS, N.A., is a corporation duly organized and validly existing under and by virtue of the laws ot the United States of America, having its principal place of business situate in Millersburg Borough, Dauphin County, Pennsylvania. 2. Defendant, ERIC D. BLACKER, is an adult individual whose last known residence address is 2000 Wentworth Drive, Camp Hill, Cumberland County, Pennsylvania 17011. 3. On or about December 20, 1994, the Defendant executed a Pennsylvania Motor Vehicle Installment Sale Contract in favor of the Plaintiff in the principal amount of $14,702.04, with an interest rate of 13.25% and being secured by a 1989 Jeep Cherokee, 4X4, VIN #lJ4FJ27L3Kl488844; said Contract provides for a collection charge of "Reasonable Attorney fees". A copy of said Contract is attached hereto and marked as Exhibit "A". 4. The Defendant failed to make the installment payment due on May 28, 1995, for the loan which had been secured by a 1989 Jeep Cherokee, 4X4, as well as the payments due thereafter. 5. On or about September 14, 1995 notice was sent to Defendant informing him the 1989 Jeep Cherokee, 4X4 had been repossessed. The Notice provided the Defendant with the amount due "'"'-'-~):' and owing and the location where the vehicle was being stored. The Notice also informed the Defendant the vehicle would be sold 15 days after the September 14, 1995 date. See Exhibit "B", attached hereto. 6. On or about November 9, 1995, notice was forwarded to Defendant setting forth the amount received from the sale of the 1989 Jeep Cherokee, 4X4 and the deficiency balance. See Exhibit "C", attached hereto. 7. The Defendant has made certain payments, and/or received credit for the sale of the 1989 Jeep Cherokee, 4X4, on the account; the principal amount (pay-off) remaining due, as of December 8, 1995, is $8,576.77, adding the attorney fee of $1,500.00 thereto, brings the balance due to $10,076.77, plus interest from December 8, 1995, at the rate of 13.25% per annum and late charges. 8. Plaintiff avers that the Defendant continues to owe the Plaintiff the sum of Ten Thousand Seventy-six and 77/100 ($10,076.77) Dollars, plus interest, late charges and costs of suit.
