Complaint
1. The plaintiff is Citibank South Dakota N.A., with place of business located at
7920 NW 110 STREET, KANSAS CITY, MO.
2. The defendant is MICHAEL J KMAN JR, who resides at 1018 DOGWOOD LANE,
ENOLA, CUMBERLAND County, Pennsylvania.
3. At the defendant's request, plaintiff issued the defendant a credit card with account
number 5424180357195418 for the defendant's use in making credit purchases and securing cash
advances subject to the terms and conditions governing the use of the credit card. Attached hereto,
made a part hereof and marked Exhibit A is a true and correct copy of the terms and conditions.
4. The defendant accepted the credit card and the terms and conditions governing its
use for the purchase of goods, merchandise and services and/or cash advances from vendors
who accepted plaintiffs credit card. In using the credit card, the defendant agreed to comply
with the terms and conditions governing its use which included the obligation to pay plaintiff
for all the charges made in full upon receipt of the statement or in installments subject to monthly
finance charges.
5. The defendant utilized the credit card by making/obtaining purchases of goods,
merchandise and services and/or cash advances from vendors who accepted the credit card.
Monthly statements were sent to the defendant which detailed the charges made to the account
including finance charges, late and/or over limit charges. The balance due for the charges made
by the defendant including any finance charges, late or over limit charges is $13,201.00.
6. Defendant did not pay the balance due in full upon receipt of the billing statements
and failed to make the required minimum monthly payment set forth in the the billing statement. As
such, defendant is in default of the terms and conditions governing the use of the credit card.
7. Although demand has been made by plaintiff upon defendant to pay the sum of $13,201.00,
the defendant failed and refused to pay all or any part thereof.
8. Plaintiff alleges it is entitled to recovery of attorney's fees from defendant pursuant
to the terms and conditions governing the account. Plaintiffs counsel is not a salaried employee
of Citibank South Dakota N.A. Plaintiff seeks recovery of attorney fees in the sum of $2,508.19.
WHEREFORE, plaintiff demands judgment against the defendant in the sum of $13,201.00,
attorneys fees in the sum of $2,508.19 and the costs of this action.

COMPLAINT
AND NOW comes the Plaintiff, Pauline B. King, by and through her attorneys,
HANDLER, HENNING & ROSENBERG, LLP, by Matthew S. Crosby, Esq., and makes the
within Complaint against the Defendants, Ann Lebo and Leahy's Auto Collision Repair,
Inc., and avers as follows:
1. Plaintiff, Pauline B. King, is an adult individual currently residing at 211
Eleventh Street, New Cumberland, Cumberland County, PA 17070.
2. Defendant, Ann Lebo, is an adult individual currently residing at 1906 Maple
Street, New Cumberland, Cumberland County, PA 17070.
3. Defendant, Leahy's Auto Collision Repair, Inc., is a corporation currently
doing business at 1051 Columbus Avenue, Lemoyne, Cumberland County, PA 17043.
4. At all times material hereto, Defendant, Leahy's Auto Collision Repair, Inc.,
was the owner of a 1996 Chevrolet (hereinafter, Defendant's vehicle) bearing Pennsylvania
registration number BXZ-4220.
5. At all times material hereto, Defendant, Ann Lebo, was the operator of said
1996 Chevrolet.
6. At all times material hereto, Plaintiff, Pauline B. King, was the owner and
operator of a 2000 Honda Civic (hereinafter, Plaintiff's vehicle), bearing the Pennsylvania
registration number PD-27886.
7. At all times material hereto, Plaintiff was insured under an automobile
insurance policy with Erie Insurance Group and was covered by the full-tort option.
8. At all times material to this action, there were no adverse weather or road
conditions.
9. On or about October 7, 2000, at about 8:45 a.m., Plaintiff, Pauline B. King,
was lawfully traveling westbound on Lowther Street in Lemoyne, Cumberland County,
Pennsylvania.
10. At approximately the same time and place, Defendant, Ann Lebo, was
traveling northbound on Maple Street approaching the intersection with Lowther Street, in
Lemoyne, Cumberland County, Pennsylvania.
11. At approximately the same time and place, Defendant, Ann Lebo, failed to
obey the properly posted Stop sign for northbound Maple Street traffic, and pulled directly
into the path of Plaintiff's vehicle.
12. As a direct and proximate result of the negligence of Defendants, Ann Lebo
and Leahy's Auto Collision Repair, Inc., the Plaintiff, Pauline King, sustained serious and
extensive injuries as set forth below:

COUNT I - NEGLIGENCE

13. Paragraphs 1-12 are incorporated herein as if fully set forth at length.
14. The occurrence of the aforementioned collision and all the resultant
injuries to Plaintiff, Pauline B. King, are the direct and proximate result of the negligence
of the Defendant, Ann Lebo, generally and more specifically, as set forth below:
(a) In failing to keep a proper lookout for vehicles lawfully traveling on
Lowther Street in Lemoyne, Cumberland County, Pennsylvania;
(b) In failing to be reasonably vigilant to observe the vehicle which
Plaintiff was operating;
(c) In failing to yield the legal right-of-way to Plaintiffs vehicle;
(d) In failing to operate her vehicle under proper and adequate control in
order that she could avoid striking the Plaintiff's vehicle;
(e) In failing to operate her vehicle in such a manner so that she could
apply the brakes to avoid striking Plaintiff's vehicle;
(f) In failing to operate her vehicle at a speed, and under such control, as
to be able to stop within the assured clear distance, in violation of 75
Pa.C.S.A. §3361;
(g) In negligently driving her vehicle into the intersection of Maple Street
and Lowther Street without properly stopping;

(h) In proceeding through an intersection when such movement could not
be made safely;
(1) In failing to exercise the high degree of care required of a motorist
entering an intersection;
0) In failing to stop at a properly posted Stop sign, in violation of
Pa.C.S.A. §3323(b);
(k) In failing to exercise reasonable care in the operation and control of
her vehicle.
15. As a direct and proximate result of the negligence of Defendant, Ann Lebo,
the Plaintiff, Pauline B. King, sustained serious personal injuries including, but not limited
to, injuries to her neck, back, right knee, head, and trapezius muscles and surrounding
areas.
16. As a direct and proximate result of the negligence of Defendant, Ann Lebo,
the Plaintiff, Pauline B. King, has been, and will in the future be, hindered from performing
her daily duties and chores, to her great loss, humiliation and embarrassment.
17. As a direct and proximate result of the negligence of Defendant, Ann Lebo,
the Plaintiff, Pauline B. King, has suffered great physical pain, discomfort and mental
anguish.and will continue to endure the same for an indefinite period of time in the future,
to her great physical, emotional and financial detriment and loss.
18. As a direct and proximate result of the negligence of Defendant, Ann Lebo,
the Plaintiff, Pauline B. King, has been compelled, and will in the future be compelled, in
order to effect a cure for the aforementioned injuries, to expend money for medicine and
medical attention to her great detriment and loss.

19. As a direct and proximate result of the negligence of Defendant, Ann Lebo,
the Plaintiff, Pauline B. King, has suffered a loss of life's pleasures and she will continue
to suffer the same in the future, to her great detriment and loss.
20. Plaintiff, Pauline B. King believes and, therefore, avers that her injuries are
permanent and serious in nature.
WHEREFORE, Plaintiff, Pauline B. King, seeks damages from the Defendant, Ann
Lebo, in an amount in excess of the compulsory arbitration limits of Cumberland County,
and demands a trial by jury.
COUNT II - NEGLIGENT ENTRUSTMENT
Pauline B. King v. Leahy's Auto Collision Repair Inc
21. Plaintiff, Pauline B. King, incorporates and makes part of this complaint
paragraphs 1 through 20 above, as if the same were set forth fully below.
22. The occurrence of the aforementioned collision and the resultant injuries to
the Plaintiff, Pauline B. King, were caused directly and proximately by the negligence,
carelessness and/or recklessness of Defendant, Leahy's Auto Collision Repair, Inc., acting
solely and/or in conjunction with Defendant, Ann Lebo, in allowing Defendant Lebo to
operate their vehicle when they knew, or should have known, of her propensity to operate
motor vehicles as set forth below:
(a) Without being reasonably vigilant to observe other motor vehicles on
the roadway;

(b) Without properly observing existing traffic and road conditions;
(c) Without maintaining proper and adequate control of the vehicles she
had operated in the past;
(d) Without the high degree of care required of operators entering
intersections;
(e) Without yielding the right-of-way to oncoming traffic;
(f) Without obeying properly posted Stop signs;
(g) In allowing Defendant Lebo to operate their vehicle without properly
researching her driving record; and
(h) In allowing Defendant Lebo to operate their vehicle without confirming
that she had a valid and current license to do so.
23. As a direct and proximate result of the negligence of Defendant, Leahy's
Auto Collision Repair, Inc., the Plaintiff, Pauline B. King, sustained personal injuries
including, but not limited to, injuries to her neck, back, right knee, head, and trapezius
muscles and surrounding areas.
24. As a direct and proximate result of the negligence of Defendant, Leahy's
Auto Collision Repair, Inc., the Plaintiff, Pauline B. King, has been, and will in the future be,
hindered from performing her daily duties and from attending to her daily activities, duties
and chores, to her great loss, humiliation and embarrassment.
25. As a direct and proximate result of negligence of Defendant, Leahy's Auto
Collision Repair, Inc., the Plaintiff, Pauline B. King, has suffered great physical pain,
discomfort and mental anguish and will continue to endure the same for an indefinite

period of time in the future, to her great physical, emotional and financial detriment and
loss.
26. As a direct and proximate result of negligence of Defendant, Leahy's Auto
Collision Repair, Inc., the Plaintiff, Pauline B. King, has been compelled, in order to effect

to her great detriment and loss.
27. As a direct and proximate result of negligence of Defendant, Leahy's Auto
Collision Repair, Inc., the Plaintiff, Pauline B. King, has suffered a loss of life's pleasures
and she will continue to suffer the same in the future, to her great detriment and loss.
28. Plaintiff, Pauline B. King, believes and, therefore, avers that her injuries are
permanent and serious in nature.
WHEREFORE, Plaintiff, Pauline B. King, seeks damages from the Defendant,
Leahy's Auto Collision Repair, Inc., in an amount in an amount in excess of the compulsory
