The averment of paragraph 11 represents a conclusion of law to which a response is not required. If it is later judicially determined that a response is required, the averments are specifically denied. 12. The averment of paragraph 12 represents a conclusion of law to which a response is not required. If it is later judicially determined that a response is required, the averments are specifically denied. 13. The averment of paragraph 13 represents a conclusion of law to which a response is not required. To the contrary, the recertification process is required by HUD to comply with program requirements. The HUD HAP subsidy is received as a "'_.J , , '.y ... result of contractual understanding between HUD and Plaintiff and has no relationship with the activities of the Defendant. Finally, the acceptance and payment of rent has nothing to do with the waiver of alleged breaches of other terms and conditions of the Agresment. This is point is especially true in light of the fact that Plaintiff has not tendered and/or renewed any Lease Agreements with the Defendant; Plaintiff has been faced with defending the allegations of discrimination filed by the Defendant with the Pennsylvania Human Relations Commission, to which action Plaintiff did not desire to be accused of retaliatory actions. The Defendant's Discrimination Complaint was filed with the Human Relations Commission in the Summer of 1994, with hearings were held by the Commission in October, 1994, and as of this date the Commission's file remains open. The allegation that the Plaintiff has waived any right to terminate the Defendant's tenancy represents a conclusion of law or fact to which a response is not required. 14. The averments of Paragraph 14 are denied. At no time did the Plaintiff or its agent authorize the Defendant to leave Avon books in the common areas of the apartment complex or sell Avon products at that location. The remainder of the 2 ~ allegation represents a conclusion of law or fact to which a response is not required. 15. The averments of Paragraph 15 represent conclusions of law and fact to which a response is not required. By way of further pleading, HUD Transmittal 4350.3, Paragraphs 4-21 states the fOllowing: (a) The owner's notice must: 1) Specify the date on which the lease will be terminated; 2) State the grounds for the termination with enough detail for the tenant to prepare a defense; 3) Advise the tenant that if he or she remains in the leased unit on the date specified for termination, the owner may seek to enforce the termination, only by bringing a judicial action, at which time the tenant may present a defense; and 4) Advise the tenant that he or she has 10 days within which to discuss the proposed termination of tenancy with the owner. The 10 day period may begin on the earlier of the date the notice was hand-delivered to the unit or the day after the date the notice was mailed. The Notice given to the Defendant clearly stated that if she failed to heed the Notice, the owner would be compelled to proceed against her as the law directs. If a jUdicial 3 10 proceeding for eviction is instituted, the Defendant could present, at that time, a defense. The Notice fairly placed the Defendant on notice that the termination could only be enforced by bringing a judicial action. 16. The averment of Paragraph 16 represents a conclusion of law or fact to which a response is not required. CIVIL ACTION - LAW LOUISE WARNER, Defendant JURY TRIAL DEMANDED COMPLAINT AND NOW, comes the Plaintiff, CUMBERLAND ELDERLY HOUSING ASSOCIATES, t/d/b/a CUMBERLAND ELDERLY APARTMENTS, and also t/d/b/a MALLARD RUN APARTMENTS, by and through its attorneys, cunningham & Chernicoff, P.C., and files this Complaint in Ejectment and in support thereof, avers the following: 1. Plaintiff, CUMBERLAND ELDERLY ASSOCIATES, t/d/b/a CUMBERLAND ELDERLY APARTMENTS, and also t/d/b/a MALLARD RUN APARTMENTS is a limited partnership which it and its various fictitious names are registered with the Pennsylvania Department of State, having a registered address of 820 Lisburn Road, Camp Hill, Cumberland County, Pennsylvania. . . 2. Defendant, LOUISE WARNER, is an adult individual who resides at Unit No. 310, 820 Lisburn Road, Camp Hill, Cumberland County, Pennsylvania. 3. At all times material to Plaintiff's cause of action, Plaintiff, CUMBERLAND ELDERLY ASSOCIATES, has been the legal owner of the tract of land and the building in which the Defendant resides is sited. A true and correct copy of the legal description of said property is attached hereto, made part hereof and is incorporated by reference and marked as Plaintiff's Exhibit "P-1". 4. On or about September 8, 1993, Defendant, LOUISE WARNER, executed a Lease Agreement by the terms of which the Defendant leased from the Plaintiff Unit No. 310, 820 Lisburn Road, Camp Hill, Cumberland county, Pennsylvania, for an initial term beginning September 8, 1993 and ending september 30, 1994, after which initial term, the Lease continued on successive terms of one (1) year each. A true and correct copy of the Lease Agreement for Unit No. 310, 820 Lisburn Road, Camp Hill, Cumberland County, Pennsylvania is attached hereto, made part hereof and is incorporated by reference as Plaintiff's Exhibit "P-2". 2 . . 5. The Defendant agreed to abide by the terms set forth in the Lease Agreement which specifically states in Paragraph 13 (d) of the Lease that the tenant agrees not to make or permit noises or acts that will disturb the rights or comfort of neighbors. 6. Plaintiff's agent, Michelle Kready, after a review of the Defendant's history, reached a decision to terminate the Defendant's Lease Agreement and/or not to renew the Defendant's Lease Agreement for the following reasons: (a) Defendant's acts of disturbing the peace and quiet of other tenants and thus materially diminishing the rights, comforts, and convenience of other tenants by bouncing a ball against the wall and floor of her apartment unit and the common areas of the apartment complex, and creating loud noises in the early morning hours, in violation of Paragraphs 13(d) and 23 of the Lease Agreement and the Pennsylvania Landlord/Tenant Act, S250.503-A ~. ~ on June 12, 1994 and June 13, 1994. 3 (b) Defendant's acts of disturbing the peace and quiet of other tenants by creating scenes at community functions in violation of Paragraphs 13(d) and 23 of the Lease Agreement and the Pennsylvania Landlord/Tenant Act, S250.503-A n. ~, and HUD Regulations, HUD Transmittal 4350.3, Paragraph 4-19 on May 31, 1994, June 1, 1994 and June 14, 1994. (c) Defendant's acts of interfering with management of the apartment complex by filing unfounded claims against management with the local police, disrupting community social functions and general disruptive behavior in violation of HUD Regulations, HUD Transmittal 4350.3, Paragraph 4- 19, and Paragraph 23 of the Lease Agreement. (d) Defendant's acts of maintaining and pursuing a business in the apartment complex and soliciting business in the apartment complex in violation of Paragraphs 14 and 23 of the Lease Agreement and the RUles and Regulations of the Tenant Handbook. 4 . , ~ (e) On August 1995, without 22, or consideration of third parties and in a reckless, wanton and careless manner, Defendant maneuvered her wheelchair in such a fashion as to threaten the health, safety and welfare of various tenants. Specifically, Defendant almost knocked down a Violet Snyder as Defendant was attempting to enter the elevator, all of which is in violation of HUD Regulations, HUD Transmittal 4350.3, Paragraph 4- 19, and Paragraphs 13 and 23 of the Lease Agreement. 7. On or about November 9, 1995, the Defendant was served by the Plaintiff with a Proposed Notice to Vacate and Notice of Termination. A true and correct copy of the ~coposed Notice to Vacate and Notice of Termination is attached hereto, made part hereof and incorporated by reference as Plaintiff's Exhibit IP-3". 8. On or about November 20, 1995, the Defendant was served by the Plaintiff with a Final Notice to Vacate and Notice of Termination. A true and correct copy of the Final Notice to Vacate and Notice of Termination is attached hereto, 5 c made part hereof, and incorporated by reference as Plaintiff's Exhibit "P-4". 9. Defendant, although requested to do so by Plaintiff, has refused to surrender Apartment Unit No. 310, 820 Lisburn Road, camp Hill, Cumberland County, Pennsylvania to the Plaintiff and has since the time she received the Notice to Vacate and Notice of Termination has continued to remain in possession of said apartment. 10. The Plaintiff has not defaulted in its responsibility to provide a habitable premises to the Defendant and is of the opinion and therefore avers that the premises being occupied by the Defendant are in such a state as not to violate the applied warranty of habitability owed by the Defendant to the Plaintiff. WHEREFORE, Plaintiff demands entry of judgment against the Defendant, LOUISE WARNER, on the issue of material non- compliance with the terms of the Lease Agreement, RUles and Regulations of the apartment complex, and HUD Regulations and 6 40\ in favor of the plaintiff, and further Plaintiff demands it be granted possession of Unit No. 310, 820 Lisburn Road, Camp Hill, Cumberland County, Pennsylvania, together with costs and interest. Briganti, Esquire, Legal services, Inc., and as her Answer to Plaintiff's Complaint, states as follows: 1. Admitted. 2. Admitted. 3. Admitted. 4. Admitted in part and denied in part. Defendant denies that the Lease continued on successive terms of one year after the initial term, but rather avers that it continued on successive terms of one month, subject to the termination provisions set forth in the Lease and relevant HUD regulations. Defendant admits the remaining averments set forth in paragraph 4 of Plaintiff's complaint. 5. Admitted. 6. Denied. Defendant denies that after a review of Defendant's history, Plaintiff's agent, Michelle Kready, reached a decision to terminate Defendant's Lease Agreement and/or not to renew Defendant's Lease Agreement for any of the reasons set forth in Paragraph 6 of Plaintiff's complaint. Defendant responds to the specific alleged grounds for termination and/or nonrenewal of her lease as follows: (a) Denied. Although Defendant did bounce a ball against the wall and floor of her apartment unit in the early morning hours of June 13, 1994, Defendant denies that by doing so she created loud noises, disturbed the peace and quiet of other tenants, or materially diminished their rights, comforts and convenience. The sounds caused by bouncing the ball on this occasion were no more disturbing than other noises typically heard and tolerated by Mallard Run residents. Defendant denies that she bounced the ball in the common areas of the apartment complex during the early morning hours of June 12, 1994 or June 13, 1994, or in her apartment during the early morning hours of June 12, 1994. Defendant, who is disabled and confined to a wheelchair, further avers that h~r physician has prescribed bouncing a ball as therapy for her. Defendant specifically denies that her conduct was in violation of Paragraphs 13(d) and 23 of the Lease Agreement or the Pennsylvania Landlord/Tenant Act, S250.503-A et sea. (b) Denied. Defendant denies that she disturbed the peace and quiet of other tenants by creating scenes at community functions, in violation of paragraphs 13(d) and 23 of the Lease Agreement and the Pennsylvania Landlord/Tenant Act, S250.503-A et sea., and HUD Regulations, HUD Transmittal 4350,3, Paragraph 4-19, on May 31, 1994, June 1, 1994 and June 14, 1994. (c) Denied. Defendant denies that she has interfered with management of the apartment complex as set forth in Paragraph 6(c) of Plaintiff's Complaint, and denies that she has thereby violated HUD Regulations, HUD Transmittal 4350.3, Paragraph 4-19, and Paragraph 23 of the Lease Agreement. (d) Denied. Defendant denies that she has violated Paragraphs 14 and 23 of the Lease Agreement and the Rules and Regulations of the Tenant Handbook, by maintaining and pursuing a business in the apartment complex and soliciting business in the apartment complex. Defendant originally had the permission of Linda Young, the former manager of Mallard Run Apartments, to leave Avon books in the laundry room and lobby. Defendant never directly solicited customers and stopped leaving the books out when requested to do so by Ms. Young on or about June 11, 1994. Moreover, other residents sold various products, which was condoned by management. (e) Denied. Defendant denies that on or about August 22, 1995, without consideration of third parties and in a reckless, wanton and reckless manner, she maneuvered her wheelchair in such a fashion as to threaten the health, safety and welfare of various tenants, or that she almost knocked down a Violet Snyder, in violation of HUD Regulations, HUD Transmittal 4350.3, Paragraph 4-19, and Paragraphs 13 and 23 of the Lease Agreement. ~. . 7. Because of the remoteness in time of the alleged lease violations, and plaintiff's delay in commencing thls eviction action subsequent thereto, Plaintiff is barred under the doctrine of laches from relying on the alleged violations as grounds to evict Defendant. 12. Any lease violations Defendant may have committed are de minimis, and none of the Defendant's conduct constitutes material noncompliance with the Lease Agreement, a material failure to carry out her obligations under Pennsylvania's landlord and tenant laws, or other good cause to terminate the parties' Lease Agreement, as required by paragraph 23 of the Lease and HUD Transmittal 4350.3, Paragraph 4-18 to terminate Defendant's tenancy. 13. By recertifying Defendant for rental subsidies from HUD after the alleged purported lease violations, and/or accepting rent subsidies from HUD and rent payments from Defendant after the alleged purported lease violations and after serving her with lease termination notices, Plaintiff has waived any right to terminate Defendant's tenancy. 14. By authorizing Defendant to leave Avon books in common areas of the apartment complex and sell Avon products there, Plaintiff waived any right to evict Defendant for engaging in this conduct and is estopped from evicting Defendant on this basis. 15. Plaintiff's "Proposed Notice to Vacate and Notice of Termination" (Plaintiff's Exhibit "P-3") and "Final Notice to Vacate and Notice of Termination" (Plaintiff's Exhibit "P-4"), did not advise Defendant that if she were to remain in the leased unit on the date specified for termination, Plaintiff could seek to enforce the termination only by bringing a judicial action, as required by HUD Transmittal 4350.3, Paragraph 4-21, and 24 CFR section 247.4(a). 16. Plaintiff filed this eviction action to retaliate against Defendant for filing complaints against Plaintiff before the Pennsylvania Human Relations Commission, in violation of 43 P.S. section 955(d).
