COMPLAINT
1. Plaintiff, Hempt Bros., Inc., is a Pennsylvania
corporation, with a principal place of business at 205 Creek Road,
Camp Hill (Lower Allen Township), Cumberland County, Pennsylvania
17011.
2. The Defendant, New Enterprise stone & Lime Co., Inc., is
a Pennsylvania corporation, with a place of business at Church
street, New Enterprise, Bedford County, Pennsylvania 16664.
3. At all times relevant hereto, Plaintiff has been engaged
in the business, inter aJ..is, of manufacturing and selling concrete,
asphalt, and stone.
4. At all times relevant hereto, Defendant, New Enterprise
Stone & Lime Co., Inc., has been engaged in the construction and
reconstruction of roads and highways.
COUNT I
5. The allegations of paragraphs 1 to and including 4 are
incorporat~d herein by reference as though herein fully set forth.
6. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, New
Enterprise stone & Lime Co., Inc., acting within the scope of their
employment, sold and delivered to the Defendant, New Enterprise
stone & Lime Co., Inc., goods and materials at the times, in the
amounts of, of the kinds, and for the prices set forth in a true
and correct copy of Plaintiff's book of original entry, copy of
which is marked Exhibit "A", and Exhibit "A-1" to and including
"A-2", attached hereto and made part hereof, which goods and
materials were received and accepted by the Defendant, New
Enterprise stone & Lime Co., Inc.
7. The prices charged for said goods and materials are just
and reasonable, and are the prices which the agents, servants, and
employees of the Defendant, New Enterprise stone & Lime co., Inc.,
acting in the scopo of their employment, orally promised to pay
Plaintiff for the same.
8. Plaintiff has demanded payment from Defendant, New
Enterprise stone & Lime Co., Inc., in the amount of $$18,169.82,
with delinquency charges in the amount of one and one-fourth (1-
1/4th%) percent per month after thirty (30) days, but Defendant,
New Enterprise Stone & Lime co., Inc., has refused and still
refuses to pay the same or any part thereof.
WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, New Enterprise stone & Lime Co., Inc., in the
amount of $18,169.82, together with delinquency charges in the

amount of one and one-fourth (1-1/4th') percent per month, together
with costs of suit.
COUNT II
9. The allegations of paragraphs 1 to and including Bare
incorporated herein by reference as though herein fully set forth.
10. The Plaintiff, at the special insistence and request of
agents, servants, and employees of the Defendant, New Enterprise
stone & Lime Co., Inc., acting within the scope of their
employment, sold and delivered to the Defendant, New Enterprise
stone & Lime Co., Inc., goods and materials at the times, in the
amounts, of the kinds, and for the prices set forth in the invoices
marked Exhibit "A-l" to and including IA-2", attached hereto and
made part hereof, which goods and materials were received and
accepted by the Defendant, New Enterprise stone & Lime Co., Inc.
11. The prices charged for the said goods and materials are
just and reasonable and are the prices which the agents, servants,
and employees of the Defendant, New Enterprise stone & Lime co.,
Inc., orally promised to pay Plaintiff for the same.
12. Plaintiff has demanded payment from the Defendant, New
Enterprise stone & Lime Co., Inc., in the amount of $$18,169.82,
with delinquency charges in the amount of one and one-fourth (1-
1/4th') percent per month after thirty (30) days, but Defendant has
refused and still refuses to pay the same or any part thereof.

13. As a result of the aforesaid, Defendant, New Enterprise
stone & Lime Co., Inc., has been unjustly enriched at Plaintiff's
expense in the amount of $18,169.82.
WHEREFORE, plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, New Enterprise stone & Lime Co., Inc., in the
amount of $18,169.82, together with delinquency charges in the
amount of one and one-fourth (1-1/4th%) percent per month, together
with costs of suit.
COUNT III
14. The allegations of paragraphs 1 to and inclUding 13 are
incorporated herein by reference as though herein fully set forth.
15. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, New
Enterprise stone & Lime Co., Inc., acting within the scope of their
employment, sold and delivered to the Defendant, New Enterprise
stone & Lime Co., Inc., goods and materials at the times, in the
amounts of, of the kinds, and for the prices set forth in the
invoices marked Exhibit "A-I" to and including "A-2", attached
hereto and made part hereof, which goods and materials were
received and accepted by the Defendant, New Enterprise stone & Lime
Co., Inc.
16. The prices charged for said goods and materials are just
and reasonable and are the prices which the agents, servants, and

employees of the Defendant, New Enterprise stone & Lime Co., Inc.,
orally promised to pay Plaintiff for the same.
17. Plaintiff has demanded payment from the Defendant in the
amount of $18,169.82, with delinquency charges in the amount of one
and one-fourth (1-1/4th%) percent per month after thirty (30) days,
but Defendant has refused and still refuses to pay the same or any
part thereof.
WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, New Enterprise stone & Lime Co., Inc., in the
amount of $18,169.82, together with delinquency charges in the
amount of one and one-fourth (1-1/4th%) percent per month, together
with costs of suit.
