YEAGER, Defendants : CIVIL ACTION - LAW CQMfl.AlliI AND NOW, comes the Plaintiff, S & A Custom Built Homes, Inc., by and through its attorneys, METTE, EVANS, & WOODSIDE, and in bringing this civil action before the Court avers as follows: 1. Plaintiff, S & A Custom Built Homes, Inc., is a business corporation duly organized and existing under the laws of the Commonwealth of Pennsylvania, with a place of business at 1147 Harrisburg Pike, Carlisle, Cumberland County, Pennsylvania 17013 (hereinafter "S&A"). 2. Defendants, Charles L. Yeager, II and Traci M. Yeager, are adult individuals residing at 732 Trail Lane, Enola, Cumberland County, Pennsylvania 17025 (hereinafter the "Yeagers"). 3. Defendant, Charles L. Yeager, an adult individual, is the father of Charles L. Yeager, II and resides at Pine Hill Extension, Enola, Cumberland County, Pennsylvania 17025. < , . I( , 4. On or about December 11, 1992, Plaintiff and Defendant Charles L. Yeager, II entered into a Residential Construction Contract for the construction of a 28' x 44' "S&A Jennifer" ranch-style home at Lot 14 Trail Lane, Enola, Cumberland County, Pennsylvania 17025. A true and correct copy of the written agreement dated December 11, 1992 is attached hereto as Exhibit "A" and incorporated by reference. 5. The contract price, adjusted after change orders, was $57,967.00. 6. The contract provided that the contract price would be paid by the buyer to the contractor based upon written applications for payment which were to be submitted in accordance with York Federal Savings and Loan's Requirements of Draw: 20% of construction cost when a well is drilled, foundation installed with parging, and asphalt coating in place; 25% of construction cost when construction is under roof and shingled, doors and windows are installed; 25% of construction cost when septic and tile field or public water and sewer hookups are installed, rough wiring, rough plumbing, and heating installed, studding erected, exterior brickwork or siding installed, basement concreted; 20% of construction cost when insulation, drywall or plastering, trim, cabinets, vanities, gutters and down spouts are completely installed; - 2 - .'>>. \ ~ . .. . 10% of construction cost when Wl remaining construction, both interior and exterior is completed "'100% complete. (100% completc includes all interior and exterior painting, floor coverings, service walks, driveway, gencral clean-up and final grade, rake and seeding.) 7. Charles L. Yeager and Charles L. Yeager, II are titled owners of the lot on which thc homc was constructed. A true and correct copy of the Deed is attached hereto as Exhibit "B" and incorporated by reference. 8. Construction was completed on or about October 10, 1993. Charles L. Yeager, II and Traci M. Yeager moved into the home immediately. 9. Plaintiff satisfied all tenns and conditions of the Residential Constrv.ction Contract, including changes ordered by Defendants and described in the "Contract Change Authorizations" attached to the Contract. (See Exhibit "A"). 10. As stated above, 10% of the Contract price was due upon substantial completion of the building or at the time of occupancy of the building by the buyer. 11. Upon information and belief, Charles L. Yeager, II and Traci M. Yeager are residing in the home. 12. Settlement occurred on or about February 18, 1994 between Plaintiff and Defendants. The balance due at closing was $7,754.00 as reflected by the Settlement Sheet. (See Exhibit "CO). At settlement, Defendant Traci M. Yeager presented a check for payment in the amount of $7,754.00. - 3 - .. "'",~,,,,;~,";,-iT+.-~'.,,";..,',:>: . C , ( . 4 . 13. Plaintiff submitted the check to the bank for payment, but the check was returned to Plaintiff and marked "NSF" (Non-Sufficient Funds). (See Exhibit "D"). 14. Plaintiff has repeatedly demanded payment of the amount due, but Defendants have wholly neglected and refused to pay the same or any part thereof. 15. Defendants have materially breached the Residential Construction Contract by withholding the final draw and/or balance due in the amount of $7,754.00. 16. Upon information and belief, Defendant Charles L. Yeager, II converted the funds provided by York Federal Savings and Loan Association as the final draw on the loan (Loan #480050708) for the construction of the above- described home, which funds were due and owing to Plaintiff. A true and correct copy of this Loan Agreement is attached hereto as Exhibit "C" and incorporated herein by reference. Cill.lliIl Breach of Contract S&A Custom Built Homes. Inc. v. Charles L. Plaintiff has repeatedly demanded payment of the amount due but Defendant Charles L. Yeager, II has wholly neglected and refused to pay the same or any part hereof. 19. Defendant Charles L. Yeager, II has materially breached the Residential Construction Contract by withholding the final draw and/or balance due in the amount of $7,754.00. WHEREFORE, the Plaintiff, S&A Custom Built Homes, Inc., demands judgment in its favor and against Defendant, Charles L. Yeager, II, for the sum of $7,754.00, with interest from February 18, 1994, which amount is below the threshold requiring compulsory arbitration, together with costs and any other relief this court deems appropriate. c..o.mITll Uniust Enrichment S&A Custom Built Homes. Plaintiff completed construction of an "S&A Jennifer" ranch-style home on real property owned by and deeded to Charles L. Yeager and Charles L. c ~ Yeager, II. 22. At all times relevant hereto, Plaintiff performed the construction in a competent and workmanlike manner. 23. The home was constructed on Lot 14 Trail Lane which lot is owned by Charles L. Yeager and Charles L. Yeager, II, according to a deed registered at the Recorder of Deeds Office, Cumberland County in Deed Book D36, page 1120. (See Exhibit "B"). 24. The home constructed on Lot 14 Trail Lane increased the value of the lot which Charles L. Yeager owns along with his son, Charles L. Yeager, II, as joint tenants with right of survivorship and not as tenants in common. (See Exhibit "B"). 25. As a result of the Plaintiffs labor and Defendants' failure to pay the aforesaid final draw, Defendants Charles L. Yeager and Charles L. Yeager, II have become unjustly enriched at Plaintiffs expense. WHEREFORE, the Plaintiff, S&A Custom Built Homes, Inc., demands judgment in its favor and against Defendants, Charles L. Yeager and Charles L. Inc. v. Charles L. Yealler. Charles L. Yealler. II and Traci M. Yealler 26. Plaintiff incorporates the allegations of Paragraphs 1 through 25 inclusive, as if set forth at length herein. 27. York Federal Savings and Loan Association, pursuant to its LORn Agreement with Charles L. Yeager, II and Charles L. Yeager, provided funds as a loan for construction of the "S&A Jennifer" ranch-style home on Lot 14 Trail Lane, Enola, Cumberland County, Pennsylvania. (See Exhibit "E"). 28. Pursuant to the requirements of the contract between the parties and the Loan Agreement, the final draw at settlement of $7,754.00 was due and owing. 29. Defendants did not pay the $7,754.00 to Plaintiff pursu:mt to the Contract between Plaintiff and Defendant Charles L. Yeager, II. 30. Upon information and belief, Defendants used that money for purposes other than paying the final draw on the Contract with Plaintiff, thereby converting to their own use the funds due and owing to Plaintiff. 31. Defendants knew that the $7,754.00 was owed to and the property of Plaintiff but converted the same to their own use and have refused to return any part of the money to Plaintiff. - 7 - '......
