COMPLAINT IN PARTITION
AND NOW, TO WIT, this ~day of January, 1996. comes the Plaintiff, MARK P.
CONNELLY, by his attorney Bruce A. Grove, Jr.. Esquire. who brings this action in Equity
against the Defendant for a Partition of personal property, and respectfully represents as
follows:
I. PARTIES
1. Plaintiff, MARK P. CONNELLY, is an adult individual currently residing at 1341
Scenery Drive, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant, SUSAN D. CONNELLY, is an adult individual residing at 155 Salem
Church Road. Lot 66. Mechanicsburg, Cumberland County, Pennsylvania, the same having a
Mobile Home situate on Lot 66 and being the prior marital residence of the parties and the
current residence of the Defendant.
II. GENERAL ALLEGATIONS
3. Paragraphs I and 2 of the Complaint are incorporated herein by reference as if set
forth at length.
4. Plaintiff and Defendant ure husband and wife having been married at
Mechanicsburg, Pennsylvuniu on March 20. 1994.
5. Prior to March 20, 1994, the parties hereto were residing in the State of New
Jersey and the Plaintiff continued to reside in New Jersey after March 20, 1994 until on or
about May 20, 1994 when he came to Pennsylvania to take up permanent residence with the
Defendant.
6. On Muy 21, 1994 the Plaintiff. using his own personal funds, purchased a DeRose
Mobile Home for a cOlISideration of $11.500.00.
7. Title to this Mobile Home was placed in the names of Plaintiff and Defendant; a
true and correct copy of said Title is attached hcreto, made a part hereof, and marked Exhibit
"A."
8. During August, 1994, the Defendunt with malice and totally without justification
effectuated the removal of the Plaintiff by Court Order from the Mobile Home pursuant to the
Protection From Abuse Act, 23 Pa. C.S.A. ~ 6101, et seq.
9. On or about September 23, 1994, the Defendant and Plaintiff resumed living
together in the marital residence.
10. On or about April 11. 1995, the Defendant, again with malice and totally without
justification, obtained a sccond Cumberland County Temporary Protection From Abuse Order
thereby again effectuating the Court ordered removal of the Plaintiff from the marital
residence, the subject Mobile Home.
11. As a result of the Defendant's fraudulent and malicious misappropriation of the
Mobile Home and its furnishings to her exclusivc use the Plaintiff has been wrongfully
excluded from his residence and dcnied thc use of and the access to the same and all its
furnishings.
12. Immediately following the April II. 1995 Court ordered removal of the Plaintiff

from the marital residence, the Defendant took up residence in the subject Mobile Home with
Monroe A. Yoder; Mr. Yoder is the Defendant's former husband.
13. The Defendant and Monroe A. Yoder reside together in the subject Mobile Home
at present.
14. On April 24, 1995 the Defendant, as Plaintiff, filed a Complaint in Divorce
against Plaintiff herein in Cumberland County, Pennsylvania; a Divorce Decree has not yet
been entered in this case.
III. PARTITION
15. Paragraphs 1 through 14 of the Complaint are incorporuted herein by reference as
if set forth at length.
16. As set out in Exhibit" A," attached hereto, Plaintiff and Defendant are owners of a
DeRose Mobile Home and the interests of the parties are held as tenants by the entireties.
17. The Title to the Mobile Home hereinabove described. upon information and belief,
is currently not encumbered in any way.
18. No person other than the parties to this suit has any interest in the Mobile Home
herein described, which is presently in the possession of and resided in by the Defendant and
Monroe A. Yoder.
19. No partition or division of said premises has ever been made by the parties to this
suit, although the Plaintiff has requested that the Defendant join him in making one.
20. The Defendant's appropriation of the Mobile Home to her own use, as
hereinabove described, creates a revocation of the entireties estate thereby making this
property fit for accounting and division.

21. The parties hereto prior to their marriage on March 20, 1994, entered into an oral
understanding that the subject Mobile Home was not to be cOlISidered marital property as the
Plaintiff would be providing all of the money necessary to purchase a Mobile Home in which
Plaintiff and Defendant would reside.
WHEREFORE. the Plaintiff pruys:
a) that your Honorable Court decree a Partition of the said personal property known as
a DeRose Mobile Home;
b) that the share or shares to which the respective parties are entitled be set out to
them in severalty and that all proper and necessary conveyances and assurances be executed
for carrying such Partition into effect; and that if said Mobile Home cannot be divided without
prejudice to or spoiling of the whole, such proper and necessary sales be conducted in such
mal1l1er as your Honorable Court may direct;
c) that the Plaintiff be awarded reasonable and proper rent during the period of the
Defendant's exclusive occupancy of the Mobile Home;
d) Partition all property of the parties held by the entireties.

PRBLIMINARY OBJECTIONS TO COMPLAINT IN PARTITION
AND NOW, comes Defendant, Susan D. Connelly, by and through
her attorney, R. Mark Thomas, Esquire, and makes the following
preliminary objections to the Plaintiff's Complaint in Partition:
DEMURRER
1. On April 24, 1995, the Defendant herein filed a Complaint
in Divorce which included a Count for Equitable Distribution of
Marital Property which is indexed at No. 25-2069 in the Cumberland
County Court of Common Pleas.
2. On May 25, 1995, the Plaintiff herein filed an Answer to
the Complaint in Divorce in which he admitted that there was
marital property subject to equitable distribution.
3. The mobile home which is the subject of this Complaint in
Partition is marital property subject to the equitable distribution
which is set forth in the Complaint in Divorce and the
Counterclaim.
4. Plaintiff's Complaint in Partition seeks an Order for
partition of marital property which is already the subject of a
dispute which is pending before the Cumberland County Divorce
Master, and therefore the Complaint in Partition is not a cause of
action. Pa.R.c.p. 1019(a).

WHEREFORE, Defendant prays that this Honorable Court will
enter a jUdgment in favor of Defendant and against Plaintiff.

5, Plaintiff's Complaint states in paragraph 18 that "no
person other than the parties to this suit has any interest in the
mobile home herein described,".
6. Monroe A. Yoder does have an interest in the mobile home
by virtue of his payment of the outstanding balance which was due
and owing on the mobile home.
7. Plaintiff has failed to include Monroe A. Yoder as a
party to this action which is a failure on the part of the
Plaintiff to include indispensable parties.
8. Because the Complaint fails to comply with Pa.R.C.p. 1553
and 1554 the Complaint is defective and therefore should be
stricken.
WHEREFORE, Defendant Susan Connelly prays this Honorable Court
will strike the Plaintiff's Complaint for failure to include all
necessary parties.
