Fogal, now residing at an undisclosed location, Bnd the minor children now residing, to the best of plaintiff's knowledge, at 680 Briton Road, Shlppensburg, Pennsylvania, are In Immediate and present danger of abuBe from tbe defendant, Dean A, Fogal, the following Temporary Order Is entered. La~ enforcement agencies, human service agencieR and Rchool districts shall not disclose the presence of the plaintiff or the children in the Jurisdiction or district or furnish anY address, telephone number, or any other demographic Information about the plaintiff or children except br further Order of Court. The defendant, Dean A. Fogal, (SSN: 190-60-7494 and date of birth: 1/29/72) now residing at 680 Briton Road, Shippensburg, Cumberland County, Pennsylvania, is hereby enjoined from physicallY abusing the plaintiff, Rebecca S. Fogal, or the children, or placing them In fear of abuse. The defendant Is ordered to stay away from the plaintiff'S residence, a residence which is not owned or leased by the defendant, and any other residence the plaintiff mny estahlieh. The defendant is ordered to refrain from having any direct or indirect contact. with t.he plaint.lff Irwludinlf, hut, not ltmited to, telephone and written comnmnlcations, except. for t.he limited purpose of facllitatlng visitation arrangements. The defendant is enjoIned from harassing and stalking the plaintiff and from harassing the plaintiff's relatives. , The defendant Is enjoIned from entering the plaIntiff's place of employment.. The defendant is enjoined from removing, damaging, deetroying or selling any property owned jointly hy the parties or owned solely by the plaintiff. A violation of this Order may subject the defendant to: i) arrest under 23 Pa.e.S. g6113; ii) a private criminal compLaint under 23 Pa.e.s. g6113.1; iii) a charge of Indirect criminal contempt under 23 Pa.e.S. g6114, punishable by imprisonment up to six months and a fine of $100.00-$1,000.00; and Iv) civil contempt under 23 Pa.e.S. g6114.1. Resumption of co-residence on the part of the plaintiff and defendant shall not nullify the provisions of the court order. Teml)Orary cust.ody of Kimberly Sue fllld St.ephanle Renee Fogal When the defendant came to bed, he brought 8 loaded shotgun with him nnd laid It on the bed between the plaintiff and him with the barrel pointed at the plaintiff's head causing her to fear for her safety. d. On several different occasions since 1991, the defendant has choked the plaintiff, grabbed her by the wrists leaving bruises, thrown car keys at her, shoved her, and puLled her hair. On one occasion when she was pregnant with her first child, the defendant forcefully hit her In the stumach. On different occasions, the defendant has grabbed, forcefully pulled, Rhaken, and kicked the plalntlff's children In the buttocks with steel toed shoes. 6. On or about February 3, 1996, the plaintiff left her residence at 680 Briton Road, Shippensburg, Cumberland County, Pennsylvania, in order to avoid further abuse. 7. The plaintl.ff believes and therefore avers that she and the minor children are In Immediate and present danger of abuse from the defendant should Bnd that they are in need of protection fl'om such abuse. 8. The plaintiff desires that the defendant be restrained from entering her place of employment. 11. The plaintiff desires that the defendant be enjoined from removing, damag~ng, destroying or selling any property owned Jointly by the parties or owned solely by the plaintiff. B. EXCWSIVE POSSESSION 12. The apartment which the plaintiff Is asking the Court to order the defendant to stay away from is not owned or rented in the defendant's name, 13. The defendant has his own residence located at 680 Briton Road, Shippensburg, Cumberland County, Pennsylvania. C. SUP~QRT 14. The defendant has a duty to support .the plaintiff and the minor children. 15. The plaintiff is In need of financial support from the defendant including, but not limited to: health Insurance coverage, and payment of unrelmbursed medical expenses for the plaintiff Bnd the children. 16, The defendant Is presently laid-off from Is truck driving Job and receiving approximately $175.00 per week In unemployment compensation benefits. 17. The plaintiff, the mot.her of the ch!ldren, current.ly'resides ' at an undisclosed location. She is married. Tbe defendant, the father of the children, current.ly resides at. 680 Brit.on Road, Shippensburg, Cumberland Count.y, Pennsylvania. He is married. 21. The plaint.iff has not. previouslY part.icipat.ed in any litigation concerning custody of the above mentioned children in this ar any other Court, 22. The plaintiff has no knowledge of any custody proceedings concerning these children pending before a court in 'I this or any other jurisdiction. 23. The plaintiff does not know of any person not a party to this action who has physical custody of the children or claims to have custody or visitation rights with respect to the . eh ildren. 24. The plaintiff is a 'responsible parent who Can best take care of the minor children and has provided for the emotional and physical needs of the children since their births. b. The defendant has shown by his abuse of the plaintiff that he is not an appropriate role model for the minor children. c. The defendant's behavior haR adversely affected the children. WHEREFORE, pursuant to t,he provisions of the "Protection from Abuse Act" of October 7, 1976, 23 Pa.C.S. g 6101 !l1 !I.!l.!l., a8 amended, the plaintiff prays this Honorable Court to grant the following relief: A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:" 1. Ordering th~ defendant to refrain from abusing the plaintiff and the minor children or placing them in fear of abuse. 2. Ordering the defendant to refrain from having any direct or indirect contact with the plaintiff including, but not limited to, telephone and written communications, except to fa~ilitate visitation arrangements. 3. Ordering the defendant to stay away from the plaintiff's present residence, which the parties have never shared. and any other residence the plaintiff may establish. 7. Grantlng support to the plaintiff and the minor children in an appropriate amount according to the support guidelines, mailed to her residence, and ordering the defendant to provide health coverage to the spouse and the minor children, directing the defendant to pay all of the unrelmbursed medical expenses of the plaintiff (spouse) and minor children of the defendant to the provider or to the plaintiff when she has paid for the medical treatment. 8. Ordering the defendant to pay reasonable attorney fees to Legal Services, Inc. The plaintiff further asks that this Petition be filed and served without payment of fees and costs by the plaintiff, 9 " The above-named plaintiff, Rebocca S.
