9. After delivery ami instullution of the home, Plaintiffs I\llticed u nnmber of defects within
the home.
10. 11\e Plaintiffs gave immediate notice to the DefendmllS of "II essenti,,' defects of the
home. The Plaintiffs' allomey gave notice in writing of the different defects. and indicated that
the Ilnre"sonable delay in delivery can pro,ide the Plaintiffs with civil relief b"sed upon the
contructu"l rights, The attorney's letter of December 9. 1994 has been incorporated herein and
design"ted as Plaiutiffs' Exhibit "Il",
11. I'I"intiffs h"ve given the Defemlants timely notice of nnmerous defects within the home.
These defects include;
A, Livinl! Hoom: The carpet seam is llefect; there is a gap between wallallll ceiling; trim
is not complete aud not the same as at the bedroom doorways; and Ihere is a cmck in spmyed
ceiling.
B. Kitchen: Galley mil and cabinets "re missing and not finished on top; frame of the.
window is bent; there is a loose trim; and a sticking window,
C. Master Bedroom: There is a gap betwe,~n w"lIand ceiling; a loose trim; three sheets
of dryw,,1I are defective; the window frame is bent; and the drywall is broke between windows.
D, Master Bath: There are st"ins on the lino\enm 110or; a trim around doorway; trim
around mirrors falling off wall; and the skylight is very crooked and cmcked,
E, Front B.~drollln: The wood insid.. windows is falling out "nd the doors do not level.
F. Back Bedroom: There is a loose trim; a broken drywall in the corner; the windows are
not square and therefore do not open; the w\lml in the window is f"lIing out; and the doors do
notleveJ.
G, Laundry HOllin: There are pans missing for furnace cover; the funmce is not trimmed
in properly,
H. Second u"th: The skylight is crooked,; the door knob is broke; there are gaps in
drywall behind door; stains on IinoleulII 110or; gaps between walls and ceiling; and the ceiling
is cracked,
L Outside The Home: There are holes in siding; there is a cracked trim "round back door;
corners of facia board arc not wmpped "nd there is still w"ter getting in; rubber around vents is
not se"led down; peak shingled so th"t shingles lift and blow off frequently; ami there is a
buckled siding,

confirms that delivery to site is included ill Ihe purchasc price, It also cOlllln])s that ccntral
air and an oil lank arc be to installed, that thc hOlllC is to wiled onto a crawlspace, that the
interior and exterior of the home shail be trimmcd, that thc sewcr linc will bc hookcd up
provided thc line is stubbed through the wall, and th"t the well will bc hookcd up provided
the well equipment is in place,
My clicnts were advised by you that this work should be completc by thc end of
October, or altemativcly it may hlst untilthc end of Novembcr. The Reaths havc relied upon
your assertion as to when the hOll1c would bc ready, They havc tenninated Iheir lease of Iheir
residence at the cnd of Novembcr. 11lcy are in tcmporary quarters now that arc vcry
expensive. They havc had to put all of thcir belongings in storagc pending their movc imo
the new h<:lme,
They also arc very concemed about the current status of the house. While thc home
itsclf has been delivercd Ihere is a significant amount of work that needs to bc completcd,
They have noted that the ,~nds of the unit arc exposed and that wal,'r is gelling in, TIley are
concerned that as the front and the bm:k of the house have not bcen joincd, that duc tll the

11. Admitted in part and denied in part. It is admitted that
Plaintiffs have given the Defendants timely notice of those defects oet forth
in the letter from Plaintiffs' attorney attachlld as Exhibit "8". After
reesonable inveetigation, Defendante ere without sufficient knowledge or
information to form a belief as to whether Plaintiffe have given timely notice
of any defects not set forth in said letter. Accordingly, those allegations
are denied and strict proof thereof is demanded at trial.
12. Denied. To the contrary, it is averred that Defendants have
repaired all defects for which they posoibly could be responsible.
Defendants. however. have refused to repair any defects for which they are not
responsible. Defendants deny that the home is presently in a condition which
does not fit for the ordinary purposes for which such c home and the installed
parts are to be used. The remaining allegations of Paragraph 12 consitute
conclusions of law to which no response is necessary. If a response is deemed
to be required, then said averments are specifically denied.
WHEREFORE, Defendants request that this Honorable Court enter
judgment in their favor and against Plaintiffs, dismiss the Complaint with
prejudice and grant euch other relief as is deemed just and fair.

This aCKnowledges receipt of your letter dated February 17, 1998, with respect to the
above.referenced matter. I first wish to thank you for continuing the hearing originally
scheduled for February 18, 1998, I was puzzled. however, to read that "the lateness of your
request has seriously inconvenienced the opposing party", When I spoke with Attorney
Kayer, he represented that he could not agree to the continuance but would not oppose the
request and so authorized me to represent same to you, Consequently, the cited portion of
your letter came as a complete surprise to me,
In addition, I would note you remembered that Attorney Kayer had twice represented
to you that the case had been settled and provided that r~~lonale to you so that you would
continue the case, Your recollection of Attorney Kayer's position comports with the
Defendant's position that Attorney Kayer and I had reached a settlement on two separate
occasions only to find that he had taken lhe position that he only made a counter offer. Of
course, his representation to you on two separate occasions that a settlement occurred Is
the reason why the case was continued,
I do regret the lateness of my request which was my fault as I had not cleared the
date with my client at an earlier date, While I always respect the schedules of the arbitrators
as well as the opposing parties, I thought that a commitment to celebrate a 451h wedding
anniversary was important enough to request a continuance. Again, thanK you for
continuing the .::ase, As we agreed, my office will promptly reschedule the arbitration at the
earliest available date,
