COKPLAINT
1. Plaintiff Kathleen R. stull is an adult individual,
citizen of the commonwealth of Pennsylvania, who resides at 147
Lucknow Road, Harrisburg, Dauphin county, Pennsylvania.
2. Defendant Susan L. Langan is an adult individual, citizen
of the Commonwealth of Pennsylvania, who resides at R. D. 3, Box
36, Etters, York County, Pennsylvania.
3. The facts and occurrences hereinafter related took place
on or about June 7, 1994, at approximately 3:40 p.m., on state
Route 83, at its intersection with State Route 581, Lemoyne,
Cumberland County, Pennsylvania.
4. At that time and place, Plaintiff Kathleen R. stull was
operating a 1987 Dodge Dakota, owned by her employer, J.C. Ehrlich
company, and was travelling northbound on SR 83 on the connector
ramp to continue on SR 83 in Lemoyne, Cumberland County,
pennsyl vania.

15. At that time and place, oetendant Susan L. Lan';Jan was
operating a 1990 Ford Bronco II and was travelling northbound on SR
83 behind plaintiff Kathleen R. stull.
6. At that time and place, traffic had come to a stop and
plaintiff Kathleen R. stull applied her brakes and was already
stopped in the line of traffic.
7. At that time and place, Defendant Susan L. Langan
operated her vehicle at a high rate of speed, failed to stop for
the line of traffic, and struck the vehicle Plaintiff Kathleen R.
stull was operating.
8. At that time and place, a violent collision occurred
between the front portion of Defendant Susan L. Langan's vehicle
and the rear portion of the vehicle being operated by plaintiff
Kathleen R. stull.
9. The foregoing accident and all of the injuries and
damages set forth hereinafter sustained by Plaintiff Kathleen R.
stull are tile direct and proximat.e result of the negligent,
careless, wanton, and reckless manner in which Defendant Susan L.
Langan operated her motor vehicle as follows:
(a) Failure to hav~ her vehicle under such control ao to be
able to stop within the assured clear distance ahead;
(b) Failure to keep alert and maintain a proper watch for the
presence of other motor vehicles on the highway;
(e) Failure to apply her brakes in sufficient time to avoid
striking the vehicle driven by Plaintiff;

(d) Failure to travel at a safe speed;
(e) Failure to keep a proper watch for traffic on the
highway;
(f) Failure to take reasonable evasive action to avoid the
accident;
(g) Failure to drive her vehicle with due regard for the
highway and traffic conditions which were existing and of
which she was or should have been aware;
(h) Failure to keep proper and adequate control over her
vehicle; and
(i) Driving her vehicle upon the highway in a manner
endangering persons and property and in a reckless manner
with careless disregard to the rights and safety of
others and in violation of the Motor Vehicle Code of the
Commonwealth of Pennsylvania.
CLAIM I

10. Paragraphs 1 through 9 of Plaintiff's Complaint are
incorporated herein by referance.
11. Plaintiff Kathleen R, stull sustained painful and serious
injuries, which include, but are not limited to, cervical and
lumbar musculoligamentous strain, which has caused continuous pain
and restrictions.
12. By reason of the aforesaid injuries sustained by
Plaintiff Kathleen R. Stull, she was forced to incur liability for
medical treatment, medications, hospitalizations, and similar

miscellaneous expenses in an effort to restore herself to health,
and claim is made therefor.
13. Because of the nature of her injuries, plaintiff Kathleen
R. stull has been advised and therefore, avers that she may be
forced to incur similar expenses in the future, and claim is made
therefor.
14. As a result of the aforementioned injuries, Plaintiff
Kathleen R. stull has undergone and in the future will undergo
great physical and mental suffering, great inconvenience in
carrying out her daily activitles, loss of life's pleasures and
enjoyment, and claim is made therefor.
15. As a result of the aforementioned i.njuries, plaintiff
Kathleen R. stull has been and in future will be subject to great
humiliation and embarrassment, and claim is made therefor.
16. As a result of the aforementioned injuries, Plaintiff
Kathleen R. stull has sustained work loss, loss of opportunity and
a permanent diminution of her earning power and capacity, and claim
is made therefor.
17. plaintiff Kathleen R. stull continues to be plagued by
persistent limitation and therefore, avers that her injuries may be
of a permanent nature, causing residual problems for the remainder
of her lifetime, and claim is made therefor.

WHEREFORE, Plaintiff Kathleen R. stull demandl judqment
aqainlt Defendant Susan L. Lanqon in an amount in excess of Twenty-
Five Thousand Dollars ($25,000.00), exclusive of interest and costs
and in excess of any jurisdictional amount requiring compulsory
arbitration.
