sufficiency of which Is hereby acknowledged by each of the parties hereto, HUSBAND and WIFE,
each Intending to be legally bound, hereby covenant and agree as follows:
1, Advice of Counsel: The parties hereto acknowledge that each has been notified
of his or her right to consult with counsel of his or her choice, and have been provided a copy of
this agreement with which to consult with counsel. WIFE is represented hy Carol J, Lindsay,
Esquire, and HUSBAND is represented by Samuel L. Milkes, Esquire, Each party acknowledges
and accepts that this agreement is, In the circumstances, fair and equitable, and that it is being
entered into freely and voluntarily, after having received such advice and with such knowledge as
each has sought from counsel, and that execution of this agreement Is not the result of any duress
or undue influence, and that it Is not the result of any improper or illegal agreement or agreements.
2. Divorce: The parties agree to the entry of a Decree In Divorce, The parties will
execute, on the date of this agreement, Affidavits of Consent and Waivers of Notice under Section
3301 (c) of the Divorce Code. consenting to the entry of a Decree in Divorce,
3, Personal Property: The parties acknowledge that they have equitably and
satisfactorily divided all of their personal property, and that all personal property shall be the sole
and Individual property of the party in whose possession it Is as of the date of this agreement.
HUSBAND will retain his Honda automobile, HUSBAND shall pay all obligations undertaken for
the purchase of the automobile and shall Indemnify and hold WIFE harmless against any claim on
account of said vellicle,
4, Real Property: The parties are owners ot a home at 15 West Springvllle Road,
Boiling Springs, Cumberland County, Pennsylvania, The home is subject to an Agreement ot Sale
between the parties herein and Lewis Klugh and Diane Klugh, his wite, On the date of this

Agreement, HUSBAND transfer to WIFE all his right, title and Interest In the marital home by
executing a special warranty deed and hereby waives any claim on account of the marital home,
WIFE shall make the purchase payments as they come due and shall Indemnify and hold
HUSBAND harmless on account of any charge Ir)r the marital home,
5. Alimony: Tile parties waive any claim that they may have one against the other for
alimony, alimony pendente lite or spousal support, The parties acknowledge that each waives the
claim to alimony and that each shall be responsible for his or her own support after the divorce,
6. Marital Debt: The parties have, in their own names, certain credit card accounts
which may include some marital debt. Each party will be responsible for the debt on the credit
card accounts in his or her name, Each party will incur no debt for which the other may be liable,
and will Indemnify and hold the other harmless for any debt so incurred,
7, Exchange of Information: The parties have requested from each other and
received any information regarding their assets, liabilities, income and expenses which the party
rsqulres prior to entering into the terms of this Agreement. The parties acknowledge that the terms
of this Agreement are fair and equitable and constitute an equitable distribution of marital property
and debt, taking into account all of the relevant factors set out in Section 3502 of the Divorce
Code, 23 Pa. C,S,!j3502 including the length of the marriage; any prior marriage of the parties; the
age, health, station, amounts and sources of income, vocational skills, employability, estate,
liabilities and needs of each of the parties; the contribution by each party to the education, training
or increased earning power of the other; the opportunity ot each party tor future acquisitions of
capital assets and income; the sources of income of both parties, including but not limited to,
medical, retirement, insurance or other benefits; the contribution or dissipation of each party in the

acquisition, preservation, depreciation, or appreciate of the marital property, Including the
contribution of a party as homemaker; the value of the property set apart to each party; the
standard of living of the parties during the marriage; the economic circumstances of each party

whether the party will be serving as custodian of any dependent minor children,
8. Modification: No modification, rescission, or amendment of this agreement shail
be effective unless in writing signed by each of the parties hereto.
9. Applicable Law: Ail acts contemplated by this agreement shail be construed and
enforced under the laws of the Commonwealth of Pennsylvania,
10, Agreement Binding on Parties and Heirs: This agreement, except as otherwise
expressly provided herein, shall bind the parties hereto, and their respective heirs, executors,
administrators, legal representatives, assigns and successors in any interest of the parties,
11. Agreement Not to be Merged: This agreement shail be incorporated into the final
decree of divorce of the parties hereto for purposes of enforcement only, but otherwise shail not
be merged into said decree, The parties shail have the right to enforce this agreement under the
Divorce Code of 1980, as amended, and in addition, shail retain any remedies in law or in equity
under this agreement as an independent contract. Such remedies in law or equity are specifically
not waived or released,
12, Documents: The parties hereto agree that they will execute and deliver one to the
other any documents necessary to give effect to the terms of thiS Agreement.
13. Full and Final Settlement: WIFE and HUSBAND each do hereby mutuaily remise,
release, quitclaim and forever discharge the other and the estate of such other, for ail time to

come, and for all purposlls whatsoever, of and from any and all rights, titles, Interests or claims
in or against the property (Including income and gain from property hereafter accruing, of the
other) or against the estate of such other, of whatever nature and wheresoever situate, which she
or he now has or at any time hereafter may have against such other, the estate of such ::lther or
any part thereof, whether arising out of any former acts, contracts, engagements or liabilities of
such other, or by way of dower or curtesy, or claims in the nature of dower or curtesy, or widows'
or widowers' rights, family exemption or similar allowance, or under the Intestate laws, or the right
to take against the spouse's will: or the right to treat a lifetime conveyance by the other as
testamentary, or all other rights of a surviving spouse to participate in a deceased spouse's estate,
whether arising under the laws of Pennsylvania, any other State, or any other Country, or any
rights which either spouse may have, or at any time hereafter have, for past, present or future
support or maintenance, alimony, alimony pendente lite, counsel fees, costs or expenses, whether
arising as a result of the marital relation or otherwise, except and only eX.cept, all rights and
agreements and obligations of whatsoever nature arising or which may arise under this Agreement
or before the breach of any thereof, It is the intention of HUSBAND and WIFE to give to each
other by the execution of this Agreement a full, complete and general release with respect to any
and all property of any kind or nature, real, personal or mixed, which the other now owns or may
hereafter acquire, except and only except, all rights and agreements and obligations of
whatsoever nature arising or which may arise under this Agreement, or for the breach of any
thereof, subject, however, to the Implementation and satisfaction of the condition precedent as
set forth herein above,

At that time, husband was earning approximately $45,000,00 per year,
The parties separated August 1, 1995, Subsequent to separation, wife retained primary
physical custody of Michael and her other two children, Husband Initially sought and received
partial custody of all three boys, claiming that he had established a relationship with all three and
wanted to maintain that relationship,
In the Summer of 1996, husband was arrested and charged with both State and Federal
crimes, The arrest arose out of his ordering child pornography over the InterNet. The
investigating officers discovered in husband's residence a video tape, The video, apparently taken
by husband, showed one of wife's children by the prior marriage, asleep, being molested by
husband, Husband Is presently incarcerated In Cumberland County Prison, Upon Information and
belief, he has been sentenced In the federal system as well, although the undersigned is unaware
of the term of his sentence or the place of Incarceration,
During the marriage, the parties purchased a property at 15 West Sprlngvllle Road, Bolling
Springs, Pennsylvania. The property was valued by the parties in a bankruptcy filing at $81,000,00.
The property was leined in the amount of $72,100,00. The mortgage payments were more than
wife could maintain after husband's incarceration and her subsequent loss of child and spousal
support. Wife arranged to sell the house with a closing date on or before September, 1998, and
moved her and the three children into less costly quarters. The bankruptcy discharged virtually
all of the marital debt. Husband had a vehicle on which there were payments due which his family
paid.
Because of her vital role In the care of Michael, wife remains unemployed during husband's
Incarceration, She is reliant upon the County and the support of the community in addition to the

AGREEMENT OF I)ALE FOR REAL ESTATE
THIS AGREEMENT is made this day of
1996, by and between DAVID HARDY and GENEVA POLlTZER.HARDV, of Bolling Springs,
Pennsylvania, hereinafter called SELLER and, LEWIS CLUGH and DIANE CLUGH, husband and
wife. of Bolling Springs, Pennsylvania, hereinafter called PURCHASER.
WIT N E SSE T H:
1. SELLER hereby sells and conveys to PURCHASER, and PURCHASER agrees to
purchase and accept the conveyance of: 15 West Springville Road, Boiling Springs, Cumberland
County, Pennsylvania,
2. PURCHASER agrees to pay the appraised value 01 subject property as determIned
by an appraisal, to be perlormed by Steven Barrett 01 Carlisle, PennsylvanIa. and paid lor by
PURCHASER, less any credit lor the cost 01 Improvements and repairs agreed to by the parties
In wrIting and paid lor by PURCHASER. Property to be paid lor on or belore the 30th day 01
September, 1998.
3. Settlement stlall be h"ld on or before the 30th day of September, 1998, and
it shall be held in the office of FLOWER, MORGENTHAL, FLOWER and LINDSAY, Attorneys-at-Law,
11 East High Street, Carlisle, Pennsylvania, unless otherwise mutually agreed to between the parties.
At settlement, SELLER shall convey title in fee simple, such as will be insured by a reputable title
insurance company at standard rates, by special warranty deed, free and clear of all liens and
encumbrances except easements or restrictions visible or of record.

This Agreement of Sale is subject to the financing as follows:

"sald loan cannot be obtained as herein provided, Ihls Agreement shall be NULL AND
VOID and all deposit monies shall be returned to the PURCHASER on or before date of settlement
as provided herein.
5, At settlement, all Realty Transfer Taxes, if any, shall be divided equally between the
parties; except that the obligation of the SELLER shall not exceed one per cent (1%) of the purchase
price as stated in this Agreement.
6. Possession of said premises shall be delivered to PURCHASER on September 1, 1996,
Subject 10 the terms set out In this paragraph, PURCHASER agrees that the said premises shall
remain in substantially the same condition as at the time of the execution of this Agreement,
reasonable wear and tear exCepted and improvements agreed in writing excepted, The risk of loss
by fire or other casualty shall be assumed by the PURCHASER until the time and date of settlement.
PUHCHASER shall pay the taxes and maintain comprehensive, liability and casualty insurance on
the property and shall indemnify and hold SELLER harmless against any loss occurring while this
Lease is in effect. PURCHASER shall name SELLER as an additional insured on the Insurance
policy and provide to SELLER a copy of the policy and receipt of payment for yearly premium within
ten (10) days of the date of thiS Agreement, PURCHASER has provided SELLER a security deposit
of $642,45. Until the settlement anticipated by this Agreement, SELLER will lease the Subject
residence to PURCHASER for a min'mum of Seven Thousand Seven Hundred Nine and 40/100

paint and/or lead-based paint hazards at the Purchaser's expenses until 9 p,m, on the tenth
calendar day alter ratification or October 15, 1996, whichever is earlier, (Intact lead-based paint that

Lead in Your Home for more Information), This contingency will terminate at the above
predetermined deadline unless the Purchaser (or Purchaser's agenL) delivers to the Seller (or
Seller's agent) a written contract addendum listing the specific existing deficiencies and corrections
needed, together with a copy of the inspection and/or risk assessment report, The Seller .may, at
the Seller's option, within 5 days alter delivery 01 the addendum, elect in writing whether to
correct the condition(s) prior to settlement. If the Seller will correct the condition, the Seller shall

MARITAL PROPERTY
Defendant lists all property in which either or both spouses have a legal or
equitable interest individually or with any other person as of the date this action
WIl8 commenced:
1. The real property located at 15 West Springville Road, Boiling Springs,
Pennsylvania. The Plaintiff is in a better position to know of the current status of
the debt relating to, and value of this asset.
2. Miscellaneous items of personal property. It is Defendant's belief that all the
personal property has been divided, and is to remain in the possession of the person
now having such property.
3. Retlremllnt benefltll/Pension, For a vel'Y short period of time during the
marriage, Defendant worked for the Capital Area Intermediate Unit. His benelUs
are negligible.
4. The Defendant hall a Honda automobile. It is believed this automobile hall been
repossessed.
LJABILITIES
The parties debts have been extinguished through II recent bankruptcy
proceeding. However, Defendant's considerable debt aIlllociated with Iltudent loans
hall not yet been extinguillhed, A determine of the statull of these debts is pending
before the United States Middle Dist.rict Court.
The only other liability ill believed to be the home itllelf.

The Defendant does not anticipate that expert testimony will be needed,

The Defendant hall 110 income. The Plaintiff's income is unknown.
PROPOSED RESOLUTION

marital residence, with arrangements to relell8e him from liability on this aIlset and
that each party retain any items of perllonal property now in his or her pOllsession.
He would keep any retirement or pension ber.efitll from his prior employment.
Given the Bort duration of this marriage, and the Defendant'B limited earning
capacity, which will remain nonexistent for several more years, there would be no
