7. The best interest and permanent welfare of the child will be served by granting the
relief requested for the following reasons:
A, The Defendant displays continuous signs of erratic, abusive and irrational
behavior that is potentially harmful to the child,
B. Plaintiff spoke with Defendant on February 2, 1996, Defendant stated, "I'm
heartless, I don't care about the kids," Defendant stated she is "fully prepared to sign over
all custody for both children and never wants to see them again." She stated she is

The Father, Daniel J. Morton, Sr., and the Mother, Dorothy J.
Dieffenbach, shall enjoy shared legal custody of Danie J.
Morton, Jr., born July 2, 1989.
The Father shall enjoy primary physical custody of the minor
child.
The Mother shall enjoy temporary physical custody of the minor
child on alternating weekends from Friday evening at 6:30 p.m.
until Sunday evening at 6:30 p.m. Transportation for exchange
of custody shal,l be shared between the parties wi th the non-
custodial parent picking the child up at the other parent's
home at the designated time.
This is a temporary Order entered pursuant to an agreement
reached by the parties. The parties shall convene for a
second Custody Conciliation Conference with the Conciliator on
the lull- day of May, 1996 at>? '" Il...m. In the event the
parties are unable to reach an agreement at the second
conciliation conference, each party reserves the right to
advance any position with respect to custody or any suggested
restrictions on custody.
The Father's petition for custody of Megan E. Dieffenbach is
dismissed upon the Father's representations at the Custody
Conciliation Conference that he is not claiming paternity in
this case. Father is directed to deliver custody of Megan E.
Dieffenbach to Dorothy J. Dieffenbach.
6. ~h. above custody Order relating to Daniel J. Morton, Jr.,
shall modify the August 24, 1990 Order issued by Dauphin
County which was docketed in Cumberland County at the above
term and num;'er.

4. Mother shall enjoy periods of temporary physical custody of

parties. When the parties reach an agreement on Mother's
periods of temporary custody, transportation for exchange of
custody shall be shared between the parties with the non-
custodial parent picking the child up at the other parent's
home at the designated time.
5. It is ordered that Joan Carey, Esquire, of Legal Services, may
file a praecipe withdrawing her appearance in this case
pursuant to this order.
6. In the event the Mother at any t,ime becomes dissatisfied with
the allowance of temporary custody provided by the Father, the
Mother may petition the Court to again have the case scheduled
with the Custody Conciliator.

for a period of 17 months. During those 17 months, the Plaintiff rarely had
contact with the said child.
B. Defendant spoke with Plaintiff one month prior to fathers day to
ask if he would like to have his son. Plaintiff stated, "TIris is our chicken barbq
weekend, I do not have time."
C. The said child was always grounded while living with the Plaintiff,
D. The said child has been doing better at school while under the care of
his mother. The said child is also involved in an extracurricular activity which his
current grade is an A.
WHEREFORE, Defendant requests the Court to grant physical and legal custody of
the child to Defendant pending the hearing.

4. Since July 3, 2005, the parties' son, Daniel J. Morton, Jr., has been residing with the
laintiff, his father and Petitioner herein.
5. Since the time of the Court's Order of February 3, 2005, the parties' son, Daniel J.
orton, Jr., who is age 16, has indicated his desire and intention to live with his father, Daniel J.
orton, Sr., and not his mother, through the summer months and into the coming school year.

, upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Hubert X. Gilroy, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthonse, Carlisle on Friday, Selltember 30, 2005 at 10:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five Dr older may also be present at the conference. Failure to appear at the conference mav
provide grounds lor entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Ahuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

Custody Conciliation Report, it is ordered and directed as follows:
1. A hearing is scheduled..m Courtroom No.4 of the ~umberland County Courthouse on
the ftj-f:il day of \4ML.'4~ ,200" at ~. ~m. Atthis hearing,
the Father shall proceed initially th testimony. Counsel for tlie Father and connsel for
the Mother, or the Mother herself if she does not retain legal counsel, shall file with the
Court and opposing counsel a Memorandum setting forth the history of custody in this
case, the issues currently before the Court, a list of witnesses who will be called to testify
on behalf of each party, and a summary of anticipated testimony of each witness. This
Memorandum shall be filed at least five (5) days prior to the mentioned bearing date.
2. Pending further Order of this Court, the following temporary Custody Order is entered
in light of the current status quo of the minor child residing with the Father:
A. The Father, Daniel J. Morton, Sr., and the Mother, Dorothy G. Diefenbach, shall
enjoy shared legal custody of Daniel J. Morton, Jr., born July 2,1989.
B. The Father shall enjoy primary physical custody of the minor child.
C. The Mother shall enjoy periods of temporary physical custody at such times and
under such circumstances as agreed upon by the parties.

CUSTODY CONCILIATION REPORT
IN ACCORDANCE WITH THE CUMBERLAND COUNTY CIVIL RULE OF
PROCEDURE 1915.3-8(B), the undersigned Custody Conciliator submits the following report:
1. The pertinent information pertaining to the child who is the subject ofthis litigation is as
follows:
Daniel J. Morton, Jr., born July 2, 1989
2. A Conciliation Conference was held September 30, 2005. Present were:
The Father, Daniel J. Morton, Sr., with his counsel, Keith Brenneman, Esquire
The Mother, Dorothy G. Diefenbach, who appeared without counsel
3. In February of this year, the parties appeared before the Conciliator at which time there
was an agreed upon Order entered giving Mother primary physical custody of the minor
child. In July of this year, the child went to live with the Father and has been living with
the Father since that time. Father relates that the child has indicated a desire to continue
to live with him. Mother agrees that the child is making that suggestion, but Mother
suggested it is still in the best interest of the minor child to return to the primary physical
custody of the Mother. The minor child is sixteen (16) years old and currently a junior in
high school enrolled at Trinity High School.
4. Based upon the above, the Conciliator recommends an Order in the form as attached.
