3, Plainllff, by merger, did acquire and succeed to the Interest and assets of
Central Pennsylvania Savings Association, formerly a Pennsylvania banking corporallon,
on or about October 1, 1994,
4, On or about July 23, 1990, In consideration of a loan of $32,500,00 made by
Central Pennsylvania Savings Association to Timothy A Arthur and Lisa J, Arthur, and the
said Timothy A Arthur and Lisa J, Arthur did execute and deliver to Central Pennsylvania
Savings Association a Note and accompanying Mortgage securing the Improved real
estate located at 7 Shady Lane, East Pennsboro Township, Enola, Cumberland County,
Pennsylvania 17025,
5, The Note and Mortgage did obligate the said Arthurs to pay to Central
Pennsylvania Savings Association the said sum of $32,500,00 with interest on the unpaid
balance at the rate of 9,750% in equal monthly installments of not less than $344,29,
commencing September 1, 1990 and continuing thereafter until on or about August 1,
2005, at which time the entire remaining unpaid balance and accrued interest, if any,
would be immediately due and payable in full, A true and correct copy of the Note and
accompanying Mortgage is attached hereto, marked Exhibit "N' and "B" respectively and
made a part hereof by reference thereto. It Is noted the Mortgage was recorded on or
about July 27, 1990, in the Office of the Recorder of Deeds of Cumberland County,
Pennsylvania In Mortgage Book 985, Page 712,
6, The DebtorslDefendants Timothy A Arthur and Lisa J, Arthur did fail to
tender the monthly payment due on tho aforesaid obligation on June 1, 1995 and have

failed and/or refused to make any payment since that date rendering the obligation In
default on June 16, 1995, It is noted that a payment was received on June 26, 1995,
however, that payment was credited to the delinquent payment of May 1, 1995,
7, As provided in the Note and the accompanying Mortgage, due to said default,
all of the debt is now due and payable as demanded by Plaintiff Great Vallay Savings
Bank,
8, DebtorslDefendants Timothy A Arthur and Lisa J, Arthur are, therefore, In
default on said obligation of Great Valley Savings Bank in the principal amount of
$26,699,65; accrued interest through January 24, 1996, of $1,899.07 and late charges of
$137,67, In addition, there is a negative escrow account balance of $135,08 and
reasonable administrative collection fees to date of $1 ,381 ,50, for a total now due through
January 24, 1996, of $30,252,97, In addition, after that date interest accrues at a per diem
figure of $7,11 per day, In addition to the unpaid Mortgage to Great Valley Savings Bank,
Plaintiff has been advised, believes and, therefore, avers that there is a second mortgage
lien on the subject property at 7 East Shady Lane, Enola, East Pennsboro Township,
Cumberland County, Pennsylvania, in favor of Blazer Consumer Discount Co" which is
also in default and has a principal balance due of approximately $22,400,00.
9, Payments have not been made to Great Valley Savings Bank, Successor
in Interest to Central Pennsylvania Savings Association, since June 26, 1995, as
afore stated,

10, Plaintiff has demanded payment of the aforesaid obligations by
Debtors/Defendants, but Debtors/Defendants have failed and/or refused to pay said sum
or any further portions thereof
11, Pursuant to Act 6, Fulton Bank, Servicing Agent for Plaintiff, Great Valley
Savings Bank, did give to the said DebtorslDefendants a Notice of Intention to Foreclose
Mortgage as required by law, A true and correct copy of said Notice and multiple
addresses of Debtors/Defendants Is collectively attached hereto, marked Exhibit "C" and
made a part hereof by reference thereto,
12, Since on or before September 18, 1995, Debtors/Defendants have
abandoned said property and said property has been vacant and no further notices are,
therefore, required by law.
13, On or about October 24, 1995, the said Debtors/Defendants Timothy A
Arthur and Lisa J, Arthur did file for protection under Chapter 7 of the Bankruptcy Act In
the United States Bankruptcy Court for the United States District Court of Indiana, Said
bankruptcy docketed to No, 95-08222-RLB7,
14, Pursuant to Petition thereafter filed, Great Valley Savings Bank did obtain
relief from the Automatic Stay, allowing it to proceed with this foreclosure action against
the subject properly, A true and correct copy of said Order of Bankruptcy Court of the
Southem District of Indiana in said proceeding is attached hereto, marked Exhibit "0" and
made a part hereof by reference thereto,

PLEASE BE ADVISED that the sale of the parcel of real estate
with the improvements erected thereon known as 7 Shady Lane, Enola,
East Pennsboro Township. Cumberland County. Pennsylvania, which
improved parcel of real estate was conveyed to Defendants Timothy
A. Arthur and Lisa J. Arthur, by Deed dated July 23, 1990 and
recorded July 27, 1990 in the Office of the Recorder of Deeds of
Cumberland County in Deed Book 34, Volume R, Page 861, will be held
on September 4, 1996. under the auspices of the S~eriff of
Cumberland County, Cumberland County Courthouse, One (;Q\!!:.t;hou~~
Sq~are, Carlisle, Pennsylvania, at 10:00 o'clock a.m. A complete
copy of the legal description of said improved real estate is
attached hereto as Exhibit "A",
The aforesaid sale is being held on the judgment of Great
Valley Savings Bank v. Timothy A. Arthur and Lisa J. Arthur,
indexed to No. 96-718 in the Court of Common Pleas of Cumberland
County, said jUdgment being in the principal amount of $32,252.97,
plus interest and costs of suit, together with a per diem of $5.67
per day after December 19, 1995.
The aforesaid tract of land, with improvements erected
thereon, is owned or reputedly owned by the said Timothy A. Arthur
and Lisa J. Arthur.
Claims against the property must be filed with the Office of
the Sheriff before the above sale date. Claims to proceeds must be
made with the Offics of the Sheriff before distribution.
Notice is further given to all parties in interest of said
claim that a schedule of proposed distribution will be filed by the
Sheriff of Cumberland County on or about October 2, 1996.
Distribution will be made in accordance with the said schedule
unless exceptions are filed thereto within ten (10) days
thereafter.
Attached hereto is a copy of the Writ of Execution. It has
been issued because there is a judgment against Defendants, Timothy
A. Arthur, and Lisa J. Arthur. It will cause the property above
identified to be held or taken to pay the judgment. Defendants,
Timothy A. Arthur and Lisa J. Arthur may have legal rights to
prevent the property from being taken. A lawyer can advise you
more specifically of these rights. If you wish to exercise your
rights, you must act promptly.

4, Pursuant to Petition filed In said action, Plaintiff, Great Valley Savings Bank,
did obtain relief from the automatic stay allowing it to proceed with this aclion, The
Defendants specifically consented to said relief and a true and correct copy of the Order
of the Bankruptcy Court of the Southern District of Indiana In said proceeding Is attached
hereto, marked Exhibit "A", and made a part hereof by reference thereto,
5, The Defendants were personally served with the Complaint in this
proceeding and have flied no Objections or Answer in any form whatsoever, nor have
retalne':! counsel to enter an appearance, Accordingly, judgment by default was entered
on or about June 4, 1996,
6, Thereafter a Writ of Execution was issued and Defendant Lisa J, Arthur was
properly served wittl the Notice of Sale by the Sheriff of Cumberland County and also by
Plaintiffs counsel, all in accord with Pa, RC,P, 3129,2.
7, The required written notice of the sale was furthermore posted on the
property within thirty (30) days of the initial sale date, September 4, 1996, as also required
by Pa, RC,P, 3129,2.
8, Notice to Defendant, Timothy A. Arthur, at his current address of 1199
Hospital Road, Lot 173, Franklin, Indiana 46131, was sent by Plaintiff's counsel on or
about June 26, 1996, by regular and certified mail, It appears that certified mail sent to
Timothy A, Arthur was signed by another unknown member of the Arthur family on JUly 1,
1996,

9. Plaintiff's counsel has subsequently attempted to send subsequent notices
of the Sheriff's sale to Defendant, Timothy A, Arthur at said last known address and while
said materials were not returned by the Postal Authorities, Mr, Timothy A, Arthur has not
responded,
10. Plaintiff believes that further attempts of service by mail In accordance with
Pennsylvania Rules of Civil Procedure would be ineffective and a special order of court
is required,
11, The Notice of Sheriff's Sale scheduled for September 4, 1996, has been
published in the Cumberland County Legal Reporter and a newspaper of general
circulation, The Patriot News, for three weeks in advance of the sale, which, it is submitted
provides ample published notice of the sale, In addition, as afore stated, the property has
been posted thirty (30) days in advance of the sale,
12, Defendant, Timothy A. Arthur, has received regular and registered mail at
his last known address of the Notice of the sale more than thirty (30) days in advdnce of
the sale, although he did not personally sign the delivery receipt.
13, Sufficient notice has therefore been given to the Defendants,
14, Plaintiff respectfully requests an order approving the service that has
heretofore been given to Defendants of the sale and permitting the sale to proceed on
September 4, 1996, without further notice.

1. The real estate as above identified to be sold at
Sheriff's Sale is described in Exhibit "A" attached hereto.
2. The names of the owners or reputed owners of said real
estate are Timothy A. Arthur, whose last known address is RR4, Box
36A, Franklin, Indiana 46131; and Lisa J. Arthur, whose last known
address is 551 Bast Broadway Street, Greenwood, Indiana 46143.

with the improvements erected thereon known as 7 Sh~~y lan@. Rnola.
Bast pennaboro Township. Cumberland County. Pennaylvan~", which
improved parcel of real estate was conveyed to Defendants Timothy
A. Arthur and Lisa J. Arthur, by Deed dated July 23, 1990 and
recorded July 27, 1990 in the Office of the Recorder of Deeds of
CUmberland County in Deed Book 34, Volume R, Page 861, will be held
on Sept..mber 4. 1996. under the auspices of the Sheriff of
Cumberland County. Cl.imberland County Courthouse. One Courthouse
S~are. Carlisle. Pennsylvania. at 10:00 O'clock a.m. A complete
copy of the legal description of said improved real estate is
attached hereto as Bxhibit "A".

The aforesaid sale is being held on the judgment of Great
Valley Savings Bank v. Timothy A. Arthur and Lisa J. Arthur,
indexed to No. 96-718 in the Court of Common Pleas of CUmberland
County, said judgment being in the principal amount of $32,252.97,
plus interest and COlts of suit; together with a per diem of $5.67
per day after December 19. 1995.
The aforesaid tract of land. with improvement 0 erected
thereon, is owned or reputedly owned by the laid Timothy A. Arthur
and Lisa J. Arthur.
Claims against the property must be filed with the Office of
the Sheriff before the above sale date. Claims to proceeds must be
made with the Office of the Sheriff before distribution.
Notice is further given to all parties in interest of said
claim that a echedule of proposed distribution will be filed by the
Sheriff of Cumberland County on or about October 2, 1996.
Distribution will be made in accordance with the said schedule
unless exceptions are filed thereto within ten (10) days
thereafter.
Attached hereto is a copy of the Writ of Execution. It has
been issued because there is a judgment against Defendants, Timothy
A. Arthur, and Lisa J. Arthur. It will cause the property above
identified to be held or taken to pay the judgment. Defendants,
Timothy A. Arthur and Lisa J. Arthur may have legal rights to
prevent the property from being taken. A lawyer can advise you
more specifically of these rights. If you wish to exercise your
rights, you must act promptly.
