CASE NO. 'It,., - '/" l ( r: ,""'( 1,.,", THE BOROUGH of CARLISLE Defendunt CIVIL ACTION. EQUITY INJUNCTION COMPLAINT 1. Plaintiff is Liberty Holding Company ("Liberty"), a Pennsylvania General Partnership with offices at 1442 Trindle P.oad, Carlisle, Pennsylvania. 2. Defendant is the Borough of Carlisle (the "Borough"), a political subdivision of the Commonwealth of Pennsylvania. 3. Liberty is the owner of property located at 2-8 South Hanover Street, Carlisle, Pennsylvania ("the Property") also known as the Kronenburg Building. 4. By letter dated May 12, 1995, addressed to the Kronenburg Building Company, the Borough's Public Works Department alleged that the Property was in violation of Section P-802.1 of the Carlisle BOCA Code for discharging storm water into a public sanitary sewer system. A copy of the violation letter is attached hereto as Exhibit "A" and incorporated herein by reference. 5. Upon receipt of the alleged violation letter, Liberty filed a Notice of Appeal to the Carlisle Borough Board of Appeals, an agency created by the Borough of Carlisle to review matters pertaining, among other things, to the Carlisle Borough Building Code. 6. On August 14, 1995, a decision was rendered by the Carlisle Borough Board of Appeals affirming the Borough's determination that a violation of the Carlisle BOCA Code had occurred. The decision further ordered Liberty to disconnect its storm water -, llvaJlN\UIl11Jl,1Y,I.-'OM drains from the sanitary sewer system within thirty days from the date of the decision. A copy of the Board's decision is attached hereto as Exhibit "B". 7. Liberty has filed an appeal to the Court of Common Pleas from the decision captioned as Libertv Holdine Company v. Carlisle Boroueh Board of Appeals and docketed to Case Number 95-6863 Civil Term, Cumberland County, Pennsylvania. 8. The downtown Carlisle business district lacks any storm sewer drainage facilities. 9. Due to the lack of storm sewers, Liberty has discharged, and presently discharges, storm water into the sanitary sewer system of the Borough. 10. The stormwater drains were connected to the sanitary sewer system at the time that Liberty purchased the building. At the time of purchase, Liberty was required to obtain a certificate from the Borough that the Property complied with all Borough regulations. 11. At the time of purchase of the building by Liberty, a certificate was obtained from the Borough stating that the building complied with all Borough regulations. 12. Upon information and belief, other properties discharge stormwater into the sanitary sewer system and no action has been taken by the borough against such properties. 13. The Borough of Carlisle has, in recent years, constructed, and approved building permits for the construction of buildings in the downtown Carlisle district. The newer buildings and existing buildings discharge their stormwater directly into the street, which, again, is due to the lack of storm sewers in downtown Carlisle. 14. The lack of stormwater facilities in the downtown Carlisle and the Borough's granting of additional building permits in the area have created stormwater runoff problems 2 ~11011NlUlIlli Iyeo,. for Uberty Holding and its tcnants, including, but not limited to, the impassability of street and sidewalks in front of thc building whencver a significant rainfall is elCperienced, an accumulation of ice in the winter months which has resulted in claims and a lawsuit against Liberty Holding, damage to its building and to it:; tcnants. 15. Liberty, and its tenants, havc repeatcdly askcd Carlisle Borough to take affirmative actions to correct the storm water runoff into the downtown streets, but to date has refused to do so. 16. Rather than taking steps to permanently correct the problem, the Borough has ordered that the storm water from the Kroncnburg Building also be discharged Into the streets, which will contribute to the problem, 17. The actions taken by the Borough will result in unsafe and hazardous conditions to visitors, patrons, invitees, and employces of Liberty and its tenants at the Kronenburg Building and cause damage to the building. 17. The Plaintiff will suffer immediate and irreparable harm if an injunction Is not granted. Unless enjoined, the actions of Boro~gh will result in a further discharge of storm water directly into the streets and public right-of-ways of downtown Carlisle which may result in the exposure of a further liability to Liberty and its tenants for damages caused by falls and other hazardous conditions. Moreover, tenants may seek to terminate their leases with Liberty at the Kronenburg Building.. 18. Liberty has no adequate remedy of law to redress the current and impending harm from the Borough's continued conduct.
