4. On March 22, 1995, said mortgage was recorded in the Office of the Recorder of
Deeds of Cumberland County in Mortgage Book 1255, Page 702 and this mortgage in the public
records is incorporated herein by reference.
5. The said mortgage was never assigned by Mellon and is stili held by it as a valid and
subsisting obligation of Castner.
6. Mellon believes lind, therefore avers, that Castner herein, is the only party in interest
in the land described herein as Exhibit" A".
7. Under the terms and conditions of the mortgage and promissory note, Defendant
agreed to make monthly payments to Mellon in the amount of Four Hundred Fifty-Seven Dollars
and Nine Cents ($457.09). beginning May I, 1995 and payable on the 1st day of each successive
month thereafter.
8. Defendant has breached the terms and conditions of the mortgage and promissory note
and has defaulted under their terms and conditions in that she has failed to make the required
monthly payment in accordance with the terms thereof.
9. Defendant is presently indebted to Mellon in the amount of Fifty Thousand Two
Hundred and Eighteen Dollars and Forty-Seven Cents ($50,218.47) itemized as follows:
Principal Balanc.e $ 47,902.73
Interest to 1/29/96 2,210.08
(per diem $10.50)
Late Charges 195.66
TOTAL DUE $ .50,218.47

'10. Det'endant also agreed under the terms ot'the mortgage that in the event ot' default
thereunder she would pay. in addition to the charges listed in pnragraph 9nbove, nllorneys' fees
and costs incurred by Mellon as n result of the institution of these legal proceedings.
II. The obligation owed by Castner to Mcllon cOl1linues to uccrue intereslthereon at the
rate of $10.50 per day beginning Jnnuary 30. 1996.
12. In accordance with the Homeowners' Emergency Mortgage Assistance Act, Act of
December 23, 1983. P. L. 385 No. 91. 35 1'.5. * 1680.40Ic!a ~, Notice of Il1lentto Foreclose
and of Defendants' rights under said Act were forwurded to Jill M. Cnstner by leller dated
December 13, 1995, first class mail, addressed to Jill M. Castner, 57 Ouk Avenue. Camp Hill,
Pennsylvania 17011. A copy of the aforesaid Notice is ullached hereto und marked Exhibit
"C". A copy of the mailing receipt, postal form 3817. evidencing the mailing of said Notice
is allached hereto and marked Exhibit "D". Defendant received delivery of said Notice on
December 18, 1995. See 35 P.S. *1680.404c(e). Defendal1l applied for and was denied
assistance under the Act. See leller dated January 19, 1996 attached hereto and marked Exhibit
"E",
13. Pursuant to the Act of January 30. 1974. P.L. 13, No.6, 41 P.S. * 101 ~~. and
in particular *403 thereof. Mellon gave written notice to Defendant of its intent to foreclose by
letter dated December 13, 1995. addressed to Jill M. Castner, 57 Oak Avenue, Camp Hill.
Pennsylvania 17011. certified mail, return receipt requested No. Z 232 035 213. A copy of
said notice is allached hereto. made a part hereof, and marked Exhibit" F".
14. Defendant received delivery of the aforesaid notice on December 15, 1995, as
evidenced by the signed certified mail receipt attached hereto, made a part hereot', and marked
Exhibit "0".
