COMPLAINT
1. The Plaintif fs, Rogel': Kelley and Debot'f!h Kelley, are adul t
individuals, husband and wife, and are currently residing at ~22
Strohm Road, Bhippensburg, Cumberland County, penneyl vanin 17257.
2. The Defendants, Theresa M. Statler amd Gary Statler, are
adult individuals, husband and wife, currently residing at 105 Farm
Road, Newville, Cuml;lerland County, Pennsylvania 17241.
3. On April 18, 1994, Plaintiff, Roger Kelley was the owner
of a 1992 Pontiac Grand Am.
4. On April 18, 1994, Plaintiff, Deborah Kel.ley, wall the
Pennsylvania licenlled operator of the said 1992 Pontiac Grand Am.
5. On April 18, 1994, Defendant, Theresa M. Statler, was the
owner and Pennsylvania licensed operator of a 1982 Chevy Malibu
Stationwagon.

6. On April l8, 1994, Defendant, Gary Statler was the owner
of a 1982 Chevy Malibu Stationwagon.
7. On April 18, 1994, at approximately 3:45 p.m. Plaintiff
Deborah Kelley, was travelling on Route 11 towards Shippensburg
when the Defendant drove her vehicle from the intersect LOll of
Rittner Highway and Route 11 into Plaintiff'a lane or traff.ic in
.ttempt to execute a left hand turn, and collided with Plaintiff's
veh.icle.
8. .At all 'times r~levant to thd accident Plaintiff, Deborah
Kelley,
maintained an appropriate speed and remained in her
specified Iftne of traffic.
9. As a result of the accident Plaintiff, Roger Kelley
sustained damage to the right front fender of his vehicl~.
10. Defendant acted in a reckles~l, careless and negl igent way
in the fClllowing mannet'l
(a) She failed to observe oncoming traffic;
(b) She failed to yield to oncoming traffic;
(c) She failed to maintain control of her vehicle in a
"roper and adequate manner;
(d) She failed to exercise caution upon entering an
,
intersection without vehicle control devices.
11. Plaintiff as a resul t of said accident has incurred
r.epairs and expenses in the amount of $2,934.46.
WHEREFORE, Plaintiffs respectfully request this Honorable
Court to enter judgment for the Plaintiffs and against the
Defendants in the amount of $ 2.934.46. together with court coats,
interest and any other relief the Court may deem reasonable.
