46. The Complaint fails to state one or more causes of action
against Defendant Allensville upon which relief can be granted.
47. At all times relevant hereto, Defendant Allensville acted
in a reasonable manner and was not negligent.
48. Defendant Allensville did not have a contract with
Plaintiff with regard to the manufacture and/or sale of the roof
trusses.
49. Defendant Allensville did not breach any contract with
regard to the manufacture and/or sale of the roof trusses.
50. Plaintiff's claims are barred or limited by the economic
loss doctrine.
51. Plaintiff's claims may be barred or limited by
Plaintiff's negligent acts and/or omissions, inClUding but not
limited to Plaintiff's failure to remove accumulated ice and snow
from the roof of its warehouse addition.
52. In accordance with the plans and specifications which
accompanied the roof trusses, the erection contractor was
responsible for SUPPlYing and attaching lateral bracing for the
trusses.
53. Plaintiff's damages, if any, were caused by a person or
persons other than Defendant Allensville and over whom Defendant
Allensville had no control.

56. If the accident described in Plaintiff's Complaint
occurred as alleged therein, then Defendant Emmanuel Allgyer, t/a
A & Z Contractors (hereinafter "Allgyer") and/or Defendant Alpine
Engineered Products, Inc. (hereinafter "Alpine") are solely liable
to the Plaintiff.
57. In the alternative, Defendant Allgyer and/or Defendant
Alpine are jointly and/or severally liable with Defendant
Allensville, and/or Defendant Allgyer and/or Defendant Alpine are
liable over to Defendant Allensville for contribution and
indemnity, the existence of any liability on the part of Defendant
Allensville being strictly denied.
.58. Defendant Allensville asserts these crossclaims against
Defendant Allgyer and Defendant Alpine in order to preserve its
right of contribution or indemnity.
WHEREFORE, Defendant Allensville Planing Mill, Inc. demands
that any judgment entered in favor of the Plaintiffs be entered
solely against Defendant Emmanuel Allgyer, t/a A & Z Contractors
and/or Defendant Alpine Engineered Products, Inc.
In the
alternative, Defendant Allensville demands that in the event

5. In 1990 the Plaintiff contracted for the construction and
erection of an addition to an existing warehouse on the
Plaintiff's real property in Mechanicsburg, Cumberland County,
Pennsylvania.
6. The Defendant Allgyer constructed and erected the warehouse
addition,
7. The Defendant Alpine designed the truss system which supported
the roof of the warehouse addition.
B. The Defendant Allensville manufactured the individual components
of the truss system and, it is believed and averred, cooperated
and coordinated with the Defendant Alpine with regard to the
desiqn of the truss system.
9. On or about March 4, 1994 a portion of the roof of the warehouse
addition collapsed,
10, On or about March 4 and March 5, 1994 additional portions of the
roof of the warehouse addition collapsed.
11. As a consequence of the collapse of the roof and consequential
damage to the building, the entire warehouse addition had to be
demolished,
12. The roof collapsed because of the absence of lateral bracing on
certain trusses of the truss system,

14. The Defendant Allgyer had a duty to construct the truss system
in a safe and workmanlike manner which required lateral bracing
of certain elements of the truss system.
15. The Defendant Allgyer failed to laterally brace portions of the
truss system and other components of the truss system which
required lateral bracing.
16. As a direct and proximate consequence of the failure of the
Defendant Allgyer to brace portions the warehouse roof collapsed
as set forth above causing Plaintiff to Buffer a loss in the
amount of $244,525,93.
Wherefore, Plaintiff demands judgment against Defendant
A1Igyer in the amount of $244,525,93 plus Court costs, interest and
delay damages as allowed by law, The total amount claimed in this
complaint exceeds the jurisdictional limit for arbitration in
Cumberland county, Pa,

bracing tor portions of the truss system in breach ot its
contractual obligations to the Plaintiff.
20. As a direct and prvximate result of this breach ot contract by
the Defendant AIIgyer the roof collapsed as set torth above
resulting in damages to the Plaintiff in the amount ot
$244,525.93.
Wherefore, Plaintiff demands judgment against Defendant
Allgyer in the amount of $244,525.93 plus Court costs, interest and
delay damages as allowed by law. The total amount claimed in this
complaint exceeds the jurisdictional limit for arbitration in
Cumberland County, Pa,

the Defendant Alpine failed to provide proper construction

trusses and truss systems resulting in the ultimate tailure of
the truss system and collapse of the root,

23. The Defendant Alpine had a duty to provide appropriate drawings
to the manufacturer and/or to the erector of the truss system
concern.tng erection and construction of the truss system.
24. It is believed and averred that Defendant Alpine tailed to
provide appropriate drawings either to the manufacturer and/or
to the erector of tho truss system.
25. It is believed and averred that Defendant Alpine had an
obligation to inspect the warehouse addition to insure proper
erection and construction of the truss system.
26. The Defendant Alpine either failed to inspect the warehouse
addition or negligently inspected the warehouse addition and in
so doing failed to discover defects in the erection and
construction of the truss system.
27. As a direct and proximate consequence of the Defendant Alpine's
failures as set forth above the Plaintiff suffered a 10S8 in the
amount of $244,525,95.
Wherefore, Plaintiff demands judgment against Defendant
Alpine in the amount of $244,525,93 plus Court costs, interest and
delay damages as allowed by law, The total amount claimed in this
complaint exceeds the jurisdictional limit for arbitration in

29. The Defendant Alpine had a contractual duty to provide certain
services related to proper design and erection of the truss
system of the warehouse addition to the Plaintiff.
30, As more fUlly set forth in paragraphs 22 through 26 above, the
Defendant Alpine breached its contractual obligations to the
Plaintiff with regard to the preparation and delivery of proper
drawings and/or the proper lnspection of the truss system,
31, As a direct and proximate consequence of the Defendant Alpine's
said breaches of contract the plaintiff has suffered a loss in
the amount of $244,525,93.
Wherefore, Plaintiff demands judgment against Defendant
Alpine in the amount of $244,525.93 plus Court costs, interest and
delay damages as allowed by law. The total amount claimed in this
complaint exceeds the jurisdictional limit for arbitration in

33. It is believed and averred that Defendant Allensville had a duty
to provide proper construction and/or shop drawings to the
contractor or erector of the truss system.
34. It is believed and averred that Defendant Allensville failed to
provide proper construction and/or shop drawings to the
contractor or erector of the truss system.
35. The Defendant Allensville breached its duties to the Plaintiff
by failing to insure that proper construction and/or shop
drawings were provided to the contractor and/or erector of the
truss system, resulting in damages to the Plaintiff.
36. It is believed and averred that Defendant Allensville had a duty
to provide direction concerning the construction and bracing of
the truss system to the contractor or erector of the truss
syst~m.
37. It is believed and averred that Defendant Allensville failed to
provide proper direction and instruction to the contractor
and/or erector of the truss system.
38. As a result of the failure of the Defendant Allensville to
provide proper direction and instruction to the contractor or
erector of the truss system, the said truss system failed,
resulting in damages to the Plaintiff as set forth above,
39. It is believed and averred that Defendant Allensville had a duty
to insure that the constructor or erector of the truss system
followed any construction drawings and/or shop drawings which
were provided to the constructor or erector of the truss system

particularly with regard to the nece88ity of continuou8 lateral
bracing.
40. It i8 believed and averred that Defendant Allensville failed to
insure that the contractor and/or erector of the truss system
followed shop and/or con8truction drawings particularly with
regard with the necessity of continuous lateral bracing.
41. The failure of Defendant Allen8ville to insure that shop and/or
construction drawings were followed particularly with regard to
continuous lateral bracing resulted in damages to the Plaintiff
a8 set forth above for which damages are claimed.
Wherefore, Plaintiff demands judgment against Defendant
Alpine in the amount of $244,525,93 plus Court costs, intere8t and
delay damages as allowed by law. The total amount claimed in this

In this opinion, we address motions for summary Judgment flied by
Defendants Allensvllle Planing Mill, Inc. and Alpine Engineered Products, Inc,
This case was flied as a consequence of a roof collapse at plaintiff's
Mechanlcsburg warehouse In early March 1994. The roof that collapsed covered
an addition to plaintiff's warehouse, built In 1990. The contractor on the project
was Defendant Emmanuel Allgyer, tla A&Z Contractors ("A&Z"), The structure was
erected using wooden trusses manufactured by Defendant Allensvllle Planing Mill,

Inc, ("Allensvllle"). Defendant Alpine Engineered Products, Inc. ("Alpine") designed
the truss system which supported the roof of the warehouse, On or about March
4 and 5, 1994, portiol1s of the warehouse addition's roof collapsed. As a result,
the entire addition had to be demolished,
A Praecipe for Writ of Summons was flied against all three defendants on
February 13, 1996. Plaintiff's Complaint was filed March 12, 1997. Plaintiff alleges
that the roof on the warehouse addition collapsed because certain trusses lacked
lateral bracing. Defendant Alpine filed an answer on May 22, 1997. Defendant
Allensville flied an answer on June 3, 1997. Plaintiff responded to New Matter
raised by both defendants July 28, 1997,
Both defendants filed motions for summary judgment on March 17, 1998.
As of this date, no response has been filed by the plaintiff. Oral argument was
held June 24, 1998. Defendants submitted a joint brief In support of the motions
for summary judgment. No brief was submitted by the plaintiff.
DISCUSSION
The rules concerning motions for summary judgment in Pennsylvania are
clear. A party opposing summary judgment,
may not rest upon the mere allegations or denials of the
pleadings but must file a response within thirty days after
service of the motion Identifying
(1) one or more issues of fact arising from

evidence In the record controverting the evidence cited In
support of the motion or from a challenge to the
credibility of one or more witnesses tesllfylng In support
of the mollon, or
(2) evidence In the record establishing the facts
essential to the cause of action or defense which the
motion cites as not having been produced.
Pa. R. Clv. P. 1035.3(a). It Is permissible to grant summary judgment against a
party who falls to respond. Pa. R, Clv. p, 1035.3(d).
Parties must be given a full and fair opportunity to argue against motions for
summary judgment.

Super. 1998). Rule 1035.3 Is a mechanism which allows a court to enter judgment
against a party who falls to respond to motions for summary Judgment. J.d.. A trlal
court has dlscrellon to decide whether briefs and/or oral argument are necessary
to fairly determine a mollon for summary judgment. J.d..
Cumberland County Rules of Procedure require briefs to be flied before
argument Is held. C.C.R.P. 210 .6. "Issues raised, but not briefed, shall be
abandoned." C,C.R.P, 210 . 7, Parties who fall to file brief may be denied
argument. C.C.R.P. 210 . 8.
Plalnllff, In the case at bar, has had ample opportunity to respond to
defendants mollons and has failed to do so. The motions for summary judgment
were flied March 17, 1998. Alpine listed Its motion for argument May 12, 1998,

Allensvllle listed its motion for argument May 13, 1998. Argument was not hel~
until June 24, 1998. Each time Defendants' flied their motions and listed the
motions for argument, Plaintiff was notified. The Court gave Plaintiff every
opportunity to respond. No written response to the motion has ever been flied by
the plaintiff. In accordance with Pennsylvania Rules of Civil Procedure and
Cumberland County Rules of Procedure, Defendant Allensville Pianing Mill, Inc.'s
Motion for Summary Judgment is granted and Defendant Alpine Engineered
Products, Inc.'s Motion for Summary Judgment is granted.
