COMPLAINT
The plaintiff, Carrie L. Roland, by her attorneys, the Family Law Clinic, sets forth the
followina cause of action:
COUNT I
DIVORCE UNDER 23 Pa.C.S. SECTION 330lCcl AND 3301{d}
OF mE DIVORCE CODE
1. Plaintiff is Carrie L. Roland, who currently resides at SO Short Lane, Shippensburg,
Pennsylvania.
2. Defendant is John R. Roland, who currently resides at 13 Charlton Drive, East
Stroudsburg, Pennsylvania.
3. Plaintiff and defendant have been bona fide residents in the Commonwealth for at
least six months immediately previous to the filing of this Complaint.
4. Plaintiff and defendant were married on September 8, 1990 at Stroudsburg,
Pennsylvania.
S. Plaintiff and defendant have lived separate and apart since September 10, 199.5.
6. The marriage is irretrievably broken.
7. Plaintiff has been advised that counseling is available and that plaintiff may have the
ri&ht to request that the court require the parties to participate in counselin,.
WHEREFORE, the plaintiff requests the court to enter a decree in divorce dlSlOlvina the

Commonwealth. Plaintiff does not know of a person nlll a party to the proceedings who has
physical custody 01' the children or claims to have custody or visitation rights with respect to the
children,
13, The best interest and permanent welfare of the children will be served by the
granting the relief requested becausc:
a) Plaintiff has been thc primary caretaker of the children since birth;
b) Plaintiff provides the children with a hOllle with adequate moral. emotional and
physical surroundings as rcquired to meet the children's needs;
c) Plaintiff is willing to accept custody of the children;
d) Plaintiff continues to exercis.: parental duties and enjoys the love and affection of the
children;
e) Defendant has not indicated to plaintiff an interest in accepting custody of the
children;
t) Plaintiff continues to reside with the children. since the defendant left the home of
plaintiff and the cbildren;
g) Children have lived continuously with the plaintiff even during periods when
defendant did not reside with plaintiff and children;
h) Plaintiff's custody will maintain the status quo;
i) The defendant desertcd the plaintiff and children In early September. 1995.
14) Each parent whose parcntal rights to the children have not been terminated and the
person who has physical custody of the children have been named as parties to this action.
WHEREFORE. plaintiff requests the court to grant her custody of th.;: children.
