COMPLAINT
AND NOW, comea the Plaintiff, Jonathan C. Bair, by and
through his attorneys, Saidis, Guido, Shuff & Masland, and avers
as follows:
1. The Plaintiff is Jonathan C. Bair, an adult individual
who resides at 77 East Willow Street, Carlisle, Cumberland
County, Pennsylvania.
2. The Defendant is David A. Dashill, an adult individual
who currently resides at Apartment No.2, 34 ~ Hanover Street,
Carlisle, Cumbftrlond County, Pennsylvania.
3. The events hereinafter complained of occurred on or
about May 24, 1995 at approximately B:30 p.m. on South Hanover
Str.eet in the vicinity of Wendy's in the Borough of Carlisle,
Cumberland County, Pennsylvania.
4. At said time and place, Plaintiff was operating his 1987
Volkswagen Scirocco. He was stopped in Wendy's driveway waiting
to pull onto South Hanover Street.
5. At gaid time and place, Defendant was riding his bicycle
SAIDIS, GUIDO,
SHUFF & on the sidewalk along South Hanover Street.

6. At sl!'.id time and place, Defendant's bicycle collided
with Plaintiff'a vehicle.
7. Plaintiff's vehicle sustained damages in the amount of
$1,270.46.

B. The damage to Plaintiff's vehicle was the direct and
proximate result of the negligence of Defendant, then and there
occurring,
9. Defendant was negligent generally and in the fOllowing
particulars:
a. Operating his bicycle in a reckless manner;
b. Failing to yield the right-of-way;
c. Failing to maintain a proper look-out;
d. Failing to have his bicycle under proper
control;
e. Failing to stop before colliding with
Plaintiff's vehicle; and
f. Failing to take action to avoid the collision
with Plaintiff's vehicle.
q. Operating his bicycle without proper lights
and/or reflective equipment;
h. Operating his bicycle on the sidewalk;
1. Failing to comply with the provisions of the
Pennsylvania Motor Vehicle Code relating to the
operation of motor vehicles, specifically as it relates
to the aforesaid acts of negligence.
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of One Thousand Two Hundred Seventy and 46/100
($1,270.46) Dollars, plus interest and costs, which amount is
within the limits for compulsory arbitration under the Local
SAlOIS,

Sectlon I. Blcycle ReRulatlona. Tho followlng provislona ahall pertain
to bicyclca (i. e., Ilght vchiclea having two (2) wheela. wlth lnClatod tlroa,
having handlebars or a ateering wheel and a saddle scat or sea.h. and pro-
pelled, or capable of being propelled, elther wholly or In part, by muacular
power) and bicycle rldlng within the Borough of Carltale:
1. Every pereon propelllng or riding a bicycle upon a publlc thorough-
fare shall be aubject to the proviaions of all ordinance a and State laws appll-
cable to the operator of any vehicle, except those provlsions whlch by their
nature would have no applicatlol1 or whe re othe rwlse expreasly provided.
2. Every bicycle when operated upon a publlc thoroughfare shall be
equipped with a brake adequate to control the movement of and to stop such
vehicle whenever necessary. Such brake shall be maintained in good work-
ing order at all tlmes.
3. Eve ry bicycle when ope rated upon a publlc thoroughfare shall be .
equipped with a horn or bell in good working order, capable of emittlng
aound audible under normal conditions for a distance of not less than one
hundred (100) feet, and it shall be unlawful for any bicycle to be equlpped
with a airen or whistle, or to use any such bell or horn otherwiae than aa
a reasonable warning to other users of the public thoroughfare.
4. No such bicycle shall be ope rated upon any publlc aidewalka or upon
any pedestrian paths.
5. Eve ry bicycle when ope rated upon a public thoroughfa re shall be kept
as close to the right-hand curb as possible.
6, Eve ry pe rson when ope rating a bicycle upon a publlc thoroughfare
shall ride such bicycle in single !lie only and at no time shall bicycles be
operated two or morc abreast.
7. The operator of a bicycle .hall not carry another person on the
bicycle when operatlng such bicycle upon any publlc thoroughfare in the
Borough, nor shall the operator of any such bicycle tow or draw any
coaste r -wagon, sled, pe reon on rolle r akate s, toy vehicle 8, or othe r
similar vehicles on a publlc thoroughfare.

8. No person operatIng a bicycle upon a publlc thoroughfare shall
partlclpate In any race or speed or endurance contest with any other vehicle.
9. No rIde r of a blcycle shall remove both hands !rom the handlebars,
or feet from the pedals, or practlce any acrobatlc or fanc}' ridIng on any
publlc thoroughfa reo
10. Eve ry pe rson ope rating a bicycle upon a publlc thoroughfa re shall
stop for all arterIal highway signs and automatic traffIc signals.
II. No blcyc Ie shall b'l pa rked upon the sidewalks In such a manne r as
to Interfere wIth the access to the doorway or entrance to a bulldlng or In
such a manner to Interfere with the free and uninterrupted flow of pedestrian
trafflc.
12. All persons engaged In the buslnesB of buying second-hand bicycles
are hereby required to make a daily report to the Police Department speclfylngl
a. The name and add re s s of the pe r son f rom whom
each bicycle is purchased
b. The kind of bIcycle sold
c. A description and serial nunlber the roof.

Section 2. Penalty for Violation. Any person, flrm or corporatlon
vIolating any of the provisions of Section 2 of this ordlnance2 shall, upon
convictlon thereof, be subject to a fine of not less than five (5) dollars nor
more than twenty-five (25) dollars, for each oHense. and cOsts of prosecu-
tlon, to be collected as other fines and costs are by law collectlble; and
In def"ult oC payment of said fine and costs. who re such default is not caused
by a ('" rson 's indigency. he shall be subject to imp risonment in the Cumber-
land County Jall for a pe riod of up to thirty (30) days, (Ordinance 1144,

to render inapplicable any other State law or Borough ordinance pertaining to

the licensing requirements. as provided in Article XU oC the "Borough
Traffic Code" in Ordinance 145-C, as amended. and to retain certain
safety provisions'therein. Section I oC the ordInance repealed Article
