No bill for cremation marked as Exhibit A was attaohed to the Complaint served upon the Defendant. 6. Denied. It is denied that Defendant made any misrepresentation and/or fraudulent misrepresentation to Plaintiff involving the sale of the two (2) Cremation packages. The Cremation packages sold to Plaintiff provided benefits to Plaintiff as set forth in the contract. To date, Plaintiff has never requested performance of the benefits Bet forth in the contract with Defendant. Plaintiff remains entitled to the benefits set forth in the contract with Defendant, 7. Admitted in part, denied in part. It is admitted that Plaintiff, Marie K. Poole, met with Defendant'e agent on December 29, 1995, It is denied that Defendant's agent made no offer to arrange for cremation. Plaintiff advised Defendant's agent that she did not wish to utilize the cremation services to which she was entitled under the contract with Defendant. Defendant's agent did not attempt to sell Plaintiff merchandise, but rather offered to provide other services not already contracted for, in lieu of the services set forth in said contract, as a courtesy accommodation to Plaintiff; however, said offer by Defendant's agent was declined by Plaintiff. 2 ,......, ' 8. Denied. Plaintiff is not entitled to resoind the legAlly binding contraot with Defendant and is not lawfully entitled to the return of any funds paid to the Defendant. NIW MATT!m 9. The Defendant was not timely contacted regarding the death of Francis C. Poole on March 28, 1995. 10. Upon the death of Francis C. Poole on December 2B, 1995, plaintiff contacted the Ewing Funeral Home, located at 630 South Hanover street, Carlisle, PA, whose employees took possession of the remains of the deceased at the site of his demise, 11. A representative of Ewing Funeral Horne, acting as agent for Plaintiff, on December 29, 1995, notified the Defendant that the deceased had already been prepared for burial, a full memorial service had been planned at Ewing Funeral Horne by Plaintiff, and that she did not want the funeral director contracted by Defendant to conduct the cremation process to which Plaintiff was entitled pursuant to the contract with DefendAnt. 12. plaintiff failed to request from Defendant any further services set forth in the contract with Defendant. 13.
