STIPULATION AGAINST LIENS

'l'HXS AGRIlIlMENT made the /Ij/~ day of February, 1996, by and
between
At Your Service Contractora, Inc.,
hereinafter referred to aa Contractor,
AND
Raymond G. Bennese and Lynn C, Benneae, huaband and Wife,
hereinafter referred to aa Owner, whereby the former undertook and
agreljd to erect and COnstruct a Cape Cod home on that certain lot
of ground aituate in North Newton TownShip, Cumberland County,
Pennsylvania I more particllarly bounded and described in Exhibit
"A" attached her.eto and made a part hereof.
NOW THEREPORE, THIS AGREEMENT WITNESSETH I That the said
Contractor, for and in consideration of the sum of ONE AND NO/100
DOLLARS ($1. 00), to At Your Servcice Contractors, Inc. in hand paid
by Owner, the receipt whereof is hereby acknowledged, and the
further consideration mentioned in the agreement aforeaaid, for
themselves and their SUbcontractors, and all parties acting through
or under them, covenant and agree that no mechanics's liens or
. claima shall be filed or maintained by them or any of them against
the said bUildings and the lot of ground appurtenant thereto for or
on account of any work done or materials furnished by them or any
of them under said contract or otherwise, for , towards, in, or
about the erection and construction of the said bUildings on the
lot above described and the sald Contractor, for themselves, their
subcontractors and others under them her'eby expressly w'live and
relinquish the right to have, flle, and maintain any mechanics's
liens or claims against the said bUildings or any of them, and
agree that this instrument, waiVing the right of lien, shall be an
independent covenant, however that nothing herein shall be
construed to prevent At Your Service Contractors, Inc. and its
subcontractors from flling a mechanic's lien in the event the last
draw pursuant to the Construction Loan Agreement between OWner,
Contractor and Cross Keys Capital, L. P., dat/ld February 14, 1996,
herein is not paid pursuant to Paragraph 12(e) therein.
