6. I.timate. 9477, 9477-A, 9477-0, 9477-E and 9477-F were
approved by the detendants and the plaintiff pertormed the
necessary work.
7. Exhibit "A" provides " detailed breakdown of the wOl'k
pertormed, but generally the repairs involved interior repair to
drywall, including painting, wallpapering and other interior
preparation including replacement of carpet and a large portion of
the work devoted to the replacement of the roof on the structure at
1312 Sadler orive, Carlisle, Pennsylvania as well as repair of the
interior ceilings.
8. The oral contract specified that payment would be made
upon completion of the various estimates attached hereto as Exhibit
"A." Total cost of the estimated jobs were:

9. Of this grand total, payments and credits have been made
in the amount of $20,936.72 with a balance remaining of $13,518.24.
10. On or prior to August 31, 1994, plaintiff delivered all
the materials called for under the contract at defendants'
residence as well as completed all the necessary services included

in the estimated exhibits attached hereto and marked as Exhibit
"A."
11. On or after August 31, 1994, plaintiff presented
defendants with a final invoice entitled job no. 9477 and requested
payment in the amount of $13,518.24. A true and correct copy of
this invoice is attached hereto and marked as Exhibit "B."
12. Plaintiff has repeatedly demanded payment of the amount
due, but defendant has wholly neglected and refused to pay the same
or any part thereof.
WHEREFORE, Plaintiff demands judgment against DefendBnts
for the sum of $13,518.24 with interest from August 31, 1994 and
costs.
COUNT I
BREACH OF CONTRACT
13. Plaintiff incorporates herein by reference the
allegations set fort.h in paragraphs 1 through 12 as if the same
were fully set forth herein or at length.
14. The actions of defendants as aforesaid are willful and
constitute a material breach of the agreement entered into between
plaintiff and defendants.
15. As a direct and proximate result of the actions of
defendants as aforesaid, plaintiff has suffered and continues to
suffer serious injury, including but not limited to loss of the

monies owed to it by defendants, loss of use of said monies, lost
interest on the money and other such damages as may be discovered.
WHEREFORE, Plaintiff demands that This Honorable Court
enter judgment in its favor and against Defendants in the amount of
$13,518.24, together with costs and interest.
COUNT II
QUANTUM MERUIT
16. Plaintiff incorporates herein by reference the
allegations set forth in paragraphs 1. through 15 as if the same
were fully set forth herein or at length.
17. Between April 1994 and August 1994, plaintiff performed
certain work and services for defendants, consisting of purchasing
materials and providing there installation in a good and
workmanlike conditioned upon the property of defendants and of the
specific request of defendants to repair weather related damage.
18. The unpaid work, labor and Rervices performed by
plaintiff on defendants' house had a reasonable value of
$13,518.24.
19. Defendants have refused to pay plaintiff for the unpaid
work, labor and services performed by the plaintiff.
20. As a result of defendants refusal to make full payment to
plaintiff of the reasonable value of plaintiff'S work, labor,
service and materials, plaintiff has suffered serious and.

6. Estimates 9477, 9477-A, 9477-0, 9477-E and 9477-F were
approved by the defendants and the plaintiff performed the
neoessary work.
7. Exhibit "A" provides a detailed breakdown of the work
performed, but generally the repairs involved interior repair to
drywall, inoluding painting, wallpapering and other interior
preparation inoluding replacement of carpet and a large portion of
the work devoted to the replacement of the roof on the structure at
1312 Sadler Drive, Carlisle, Pennsylvania as well as repair of the
interior ceilings.
8. The oral contract specified that payment would be made
upon completion of the various estimates attached hereto as Exhibit
"A." Tot.al cost of the estimated jobs weret

9. Of this grand total, payments and credits have been made
in the amount of $20,936.72 with a balance remaining of $13,518.24.
10. On or prior to August 31., 1994, plaintiff delivered all
the materials called for under the contract at defendants'
residence as well as completed all the necessary services included

in the estimated exhibits attached hereto and marked as Exhibit
"A."
11. On or after August 31, 1994, plaintiff presented
defendants with a final invoice entitled jOb no. 9477 and requested
payment in the amount of $13,518.24. A true and correct copy of
this invoice is attached hereto and marked as Exhibit "B."
12. Plaintiff has repeatedly demanded payment of the amount
due, but defendant has wholly neglected and refused to pay the same
or any part thereof.
WHEREFORE, Plaintiff demands judgment against Defendants
for the sum of $13,518.24 with interest from August 31, 1994 and
costs.
COUNT I
BREACH OF CONTRACT
13. PlBintiff incorporhtes herein by reference the
allegations set forth in paragraphs 1 through 12 as if the same
were fully set forth herein or at length.
14. The actions of defendants as aforesaid are willful and
oonstitute a material breach of the agreement entered into between
plaintiff and defendants.
15. As a direct and proximate result of the aotions of
defendants as aforesaid, plaintiff has suffered and continues to
suffer serious injury, including but not limited to lOBS of the

monies owed to it by defendants, 10s8 of use of said monies, lost
interest on the money and other suoh damages as may be disoovered.
WHEREFORE, Plaintiff demands that This Honorable Court
enter judgment in its favor and against Defendants in the amount of
$13/518.24/ together. with costs and interest.
COUNT II
QUANTUM MERUIT
16. Plaintiff incorporates herein by referenoe the
allegations set forth in paragraphs 1 through 15 as if the same
were fully set forth herein or at length.
17. Between April 1994 and August 1994, plaintiff performed
oertain work and services for defendants, consisting of purohasing
materials and providing there installation in a good and
workmanlike conditioned upon the property of defendants and of the
specific request of defendants' to repair weather related damage.
18. The unpaid work, labor and services performed by
plaintiff on defendants' house had a reasonable value of
$13/518.24.
19. Defendants have refused to pay plaintiff for the unpaid
work, labor and services performed by the plaintiff.
20. As a result of defendants refusal to make full payment to
plaintiff of the reasonable value of plaintiff / s work, labor /
service and materials, plaintiff has suffered serious and

AMENDED COMPLAINT
1. Plaintiff is Dennis E. Mitchell an adult individual t/a
Mitchell Restoration, with his residence and principlll place of
business at P. O. Box 6564/ Harr.isburg, Pennsylvania 17112-0564.
2. Defendants are Terance Wilson and Carol Wilson who are
adult individuals residing at 1312 sadler Drive, Carlisle,
Pennsylvania 17013.
3. During the winter of late 1993 through early 1994/
defendants exper ienced a var iety of weather related damages to
their residence located at 1312 Sadler Drive, Car lisle,
Pennsylvania 17013.
4. On or about April 1994 plaintiff and defendants entered
into an oral contract to perform certain work and to furnish
certain materials by the plaintiff to repair the weather related
damages incurred by the defendants.
5. The oral contract was supported by written e.timat..
which are attached hereto as Exhibit "A."
labeled as job no. 9477, 9477-A, 9477-0/ 9477-E and 9477-F~

6. Estimates 9477, 9477-A, 9477-0, 9477-E and 9477-F were
approved by the defendants and the plaintiff performed the
necessary work.
7. Exhibit "A" provides a detailed breakdown of the work
performed, but generally the repairs involved interior repair to
drywall, including painting, wallpapering and other interior
preparation including replacement of carpet and a large portion of
the work devoted to the replacement of the roof on the structure at
1312 Sadler Drive, carlisle, Pennsylvania as well as repair of the
interior ceilings.
8. The oral contract specified that payment would be made
upon completion of the various estimates attached hereto as Exhibit
"A." Total cost of the estimated jobs were:

9. Of this grand total, payments and credits have been made
in the amount of $20,936.72 with a balance remaining of $13,518.24.
10. On or prior to August 31, 1994, plaintiff delivered all
the materials called for under the contract at defendants'
residence as well as completed all the necessary services included

in the e.Umated exhibit. attaohed hereto IInd marked aa Exhibit
"A."
11. On or after August 31, 1994, plaintiff presented
defendants with II final invoice entitled job no. 9477 and requested
payment in the amount of $13,51B.24. A true and correct copy of
this invoice is attached hereto and marked as Exhibit "B."
12. Plaintiff has repeatedly demanded payment of the amount
due, but defendant has wholly neglected and rofused to pay the same
or any part thereof.
COUNT I
BREACH OF CONTRACT
13. Plaintiff incorporates herein by reference the
allegations set forth in paragraphs 1 through 12 as if the same
were fully set forth herein or at length.
14. The actions of defendants as aforesaid are willful a~d
oonstitute a material breach of the agreement entered into between
plaintiff and defendants.
15. As a direct and proximate result of the actions of
defendants as aforesaid, plaintiff has suffered and continues to
suffer serious injury, including but not limited to loss of the
monies owed to it by defendants, loss of use of said monies, lost
interest on the money and other such damages as may be discovered.

enter judgment in its favor and against Defendants in the amount of
$13,518.24, together with costs and interest.
COUNT II
QUANTUM MERUIT
16.
Plaintiff
incorporates
herein by
reference
the
allegations set forth in paragraphs 1 through 15 as if the same
were fully set forth herein or at length.
17. Between April 1994 and August 1994, plaintiff performed
certain work and services for defendants, consisting of purchasing
materials and providing there installation in a good and
workmanlike conditioned upon the property of defendants and of the
specific request of defendants to repair weather related damage.
18. The unpaid work, labor and services performed by
plaintiff on defendants' house had a reasonable value of
$13,518.24.
19. Defendants have refused to pay plaintiff for the unpaid
work, labor and services performed by the plaintiff.
20. As a result of defendants refusal to make full payment to
plaintiff of the reasonable value of plaintiff's work, labor,
service and materials, plaintiff has suffered serious and
continuing injury, including but not limited to 106S of material.,'
time and effort expended on defendants' residence.

21. Aa a result of defendants' refusal to make full payment
to plaintiff of the reasonable value of plaintiff/s work, labor,
materials and services, defendants have been unjustly enriched at
the expense of plaintiff.
22. The amount in controversy in this matter is subject to
compulsory arbitration under Cumberland County RUle 1301-1.
WHEREFORE, Plaintiff demands This Honorable Court enter
judgment in its favor and against Defendants in the amount of
$13/518.24 together with costs and interest.

Beaause of Plaintiff I s incomplete work, Defendants were required to
alean drywall dust out of their draperies at a charge of $128.26.

Plaintiff appropriated carpeting owned by Defendants from
DefendantB' property with the understanding that said carpeting was
to be returned in a bound condition. Plaintiff never returned said
carpeting pursuant to the agreement between the parties and,
thereby, Defendants Buffered 10sB of $3,538.

Because of improper work performed on DefendantB' property by
Plaintiff, Defendants will be required to have the textured
ceilingB of the property redone BO that the Beams will not show,
with the cost of this work and the damage sUBtained by the
DefendantB being approximately $2,000.00.

Plaintiff underBtood that the weather damage to Defendant.' home
wu covered by insurance provided by PW, and Plalntiff further
understood that PW required that ~ny work for damage caused by
weather to Defendants' home must be first approved by PW before the
work is performed.

Plaintiff either willingly or negligently proceeded with performing
work on the roof of Defendants' dwelling which additional work was
required because of weather damage and which work was not
previously disclosed by Plaintiff to Defendante or to PW and for
which Plaintiff did not atop work and allow PW an opportunity to
inspect the additional roof damage.

As a result of Plaintiff's failure to allow PW to inspect the
additional roof damage, PW has denied a supplemental claim
submitted by Defendants to the Defendants' damage of $2,738.32.

In preparing estimates for weather damage to the Defendants' home
and submitting said estimates to PW, Plaintiff negligently failed
to include additional work that was clearly required for hall
bathroom flooring of $621.70, Master bedroom flooring of $588.40,
Master bedroom carpet of $1,671.90, tape and texture of ceiling of
$874.90, wallpaper of $2,479.21, and contractor's overhead and
profit of $846.38, for a total of $7,569.97.

A. .et forth above, Defendants have suffered damage of $2,000.00
for necessary work to have the textured ceilings redone so that the
8eams will not show.

As set forth above, Defendants have incurred damag~ of $2,738.32 as
a result of Defendants inability to obtain reimbursement from its
insurance company for work on Defendants' roof because of
Plaintiff's negligence in failing to obtain approval from PW before
performing said work.

As a result of Plaintiff's negligence in failing to adequately
estimate work required to Defendants' home because of the weather
damage, Defendants suffered damage by their inability to not submit
a claim to PW for the hall bathroom flooring, maeter bathroom
flooring, master bedroom carpet, tape and texture of ceilings,
wallpapering, and contractor's overhead and profit for a total of
$7,569.97.

As B result of Plaintiff's negligence in failing to install a
proper new roof on Defendant's home, Defendant's home and their
belongings suffered damage in December, 1995 as a result of water
leaki~g from the roof that Plaintiff had allegedly repaired. The

plaintiff on defendants' house in Exhibit "A" was performed in a

26. Denied. It is first denied that plaintiff performed any
work in Job 9477-A in a poor or incomplete manner.
To the
contrary, the items speoified in Exhibit "A" were indeed performed
and plaintiff has ottered to make any touch-up or additional
repairs a8 needed. It is specifically denied that the defendant.'
are due any credit for defective wallpaper, since the plaintiff
installed the wallpaper and did not produce the wallpaper itselt.
Any claim for defect should be made agRinst the wallpaper
manutacturer. It is turther pleaded that a cr.edit setoff suggested
by the defendants' should more properly be made by the insurance
company since the defendants' have made no payment to the plaintiff
to date.
27. Denied. It is specifically denied that the plaintiff
performed items of work specified in Job 9477-0 in a poor and
incomplete manner. To the contrary, it is suggested that all items
were performed in a workmanlike manner and in fact the plaintiff
has offered to make any touch-up as necessary. It is further
denied that any credit or setoff would be due the defendants',
sinco all payments to date have been made by the insurance company
and the invoices are currently outstanding.
28. Denied. It is further denied that plaintiff performed
items of work in Job 9477 in a poor and incomplete manner. To the
contrary, Rll of these items were performed appropriately by the
plaintiff. Further, it is specifically denied that any item for
roof repair should be permitted as a creditor setoff to the
defendants', since they have not paid for the original roof repair
to which they seek a credit. Further, it is denied that the
plaintiff provided a new roof to the defendants' which apparently
is the basis for their setoff in Exhibit "C."
29. Denied. strict proof of same is demanded at trial.

~O. Denied. It is specifioallY denied that plaintiff
appropriated carpeting owned by the defendants. To the contrary,
defendants' did ask plaintiff to return carpeting in bound
condition. However, this property was the property of the
insurance company after new carpeting was laid in the defendant's
house. It was therefore not the property of the defendant'c and in
fact was not salvageable and could not be bound. Therefore any
valuation for the carpeting is specifically denied as an item of
damage.
31. Denied. strict proof of same is demanded at trial.
32. Admitted in part, denied in part. It is admitted that
the plaintiff did perform services for the defendants under an
insurance policy issues by PW Group/Providence Washington Group and
New York Insurance company (PW). However it is specl.fically denied
that PW required any work for damage caused by weather to
defendants' home be first approved by PW. These charges were in
fact initiated by the defendants themselves and were not part of
the underlying insurance claim. These services were specifically
requested by the defendants and are the subject matter of
Plaintiff'S Amended complaint.
33. Denied. It is first specifically denied that plaintiff
either willingly or negligently proceeded with the work on the roof
of defendant's dwelling required because of weather damage before
disclosing same to the defendants. To the contrary, the defendant
specifically requested that this work be performed. It is further

denied that the plaintiff d~,d not stop work and allow PW an
opportunity to inspect the additional root damaga. Plaintitt did
not have the opportunity to seek. inspection because of the
".c.ssity to complete the job before additional weather damage
occurred. This again was done with the full knowledge and approval
ot the detendants.
34. The averment a of paragraph 34 are specifically denied and
strict proof is demanded at trial.
35. The averments of paragraph 35 are specifically denied and
strict proof of same is demanded at trial.
36. The averments of paragraph 36 are specifically denied and
strict proof of same is demanded at trial.
WHEREFORE, Plaintiff requests your Honorable Court to
dismiss Defendants' New Matter and judgment in favor of the
Plaintiff in the amount of $13,518.24 together with costs and
interest.

strict proot of same is demanded at trial. To the contrary, the
carpeting became the property of PW after new carpeting was laid in

carpetinq was not salvaqeable.

plaintiff performed repairs in a workmanlike manner. Further the
plaintiff denies that any weather damagE<s from the severe winter of
1995-1996 can be attributable to his partial roof repairs made in
1994.
WHEREFORE, Plaintiff requests judgment against defendants
in the amount of $13,518.24 along with costs of this action.
