(hereinafter referred to as "WIFE"), and RICHARD W. KAUFFMAN, of
Mechanicsbull'g, Pennsylvania (hereinafter referred to as "HUSBAND"),

WIfBRBAS, tl'>e parties hereto are HUBband and Wife, having been
married on October 4, 1987, in Dauphin ~ounty, Pennsylvania:
WIfBRBAS, there are no minor children born of the marriage:
WIII!REA5, the parties hereto are desirous of settling fully and
finally their respective financial and property rights and obligations aa
between each other, including, without limitation, the settling of all
matters between them relating to the ownership of real and personal
property, the support and maintensnce of one another and, in general, the
settling of any and all claims and possible claims by one against the other
or against their respective estates.
~, ~, in consideration of these premises, and of the
mutual promises, covenants and undertakings hereinafter set forth, and for
other good and valuable consideration, receipt and sufficiency of which is
hereby acknowledged by each of the parties hereto, Wife and Husband, each
intending to be legally bound hereby, covenant and agree as follows:
1. ADVICE OF COUNSEL. The provisions of this Agreement and
their legal effect have been fully explained to the parties by their,
respective counsel, Dawn S. Sunday, EsquireJ for Wife, and Michael L,
8angs, Eaquire, for Husband. Each party acknowledges that she or he has
received independent legal advice from counsel of her or his selection, and
that each fully understands the facts and has boen fully informed as to her
or his legal rights and obligations, and each party acknowledges snd
accepts that this Agreement is, in the circumstances, fair and equitable,
and that it is being entered into freely and voluntarily, after having
reclIilled such advice and with such knowledgeJ and that execution of this
Agreement is not the result of any duress or undue influence, and that it
is not the result of any improper or illegal agreement or agreements. In
addition, each party hereto scknowledges that she or he has been fully
advised by her or his respective attorney of the impact of the Pennsylvania
Divorce Code, whereby the court has the right and duty to determine all
marital rights of the parties including divorce, alimony, alimony pendente
lite, equitable distribution of sll marital property or property owned or
possessed individually by the other, counsel fees and costs of litigation
and, fully knowing the same and being fully advised of her or his rights
thereunder, each party hereto still desires to execute this Agreement, and
waives her or his respective right to have the Court of COITI1lOn Pleas of
Cwrberland County, or sny other court of competent jurisdiction, make any
determination or order affecting the respective parties' rights to alimony,
alimony pendente lite, support snd maintenance, equitable distribution,
counsel fees and costs of litigation.
2. DISCL05llRB OF ASSETS. The parties warrsnt that they have
given a ful', complete and accurate disclosure of all assets, of any
nature, whether or not the assets were held jointly or in one name alone.
The remedies avsilable to either party for breach of violation of this
provision shall be those remedies available purauant to law and equity
inclUding the right to punitive and compensatory damages.
3. PBIlSCHU. RIGII'l'S. Wife and Husband may and shall, at all
timee hereafter, live eeparate and epart. Each shall be free from all
control, reetraint, intet'ference and authority, direct or indirect, by the
other. Each may reeide at euch plsce or placee as ehe or he may eelect.
Each may, for her or hie eeparate use o~' !;Htnefit, conduct, carry on or
engage in any business, occupation, profession or employment which to her
or him may seem advisable. Wife snd Husband shall not molest, haraee,
disturb or malign each other or the respective fBlllilies of each other, nor
compel or attempt to compel the other to cohabit or dwell by sny means or
in any manner whatsoever with her or him. Neither party will interfere
with the useJ ownership, enjoyment or disposition of any property now owned
by or hereafter acquired by the other.
4 . J.Q1ITABLE DISTRIIlt1l'IQI.
A. Household and Personal Property.
(1) Husband transfers to Wife sll of his right, title
and interest in and to the itell/5 of personal property listed on Exhibit A
to this Agreement.
(2) Wife transfers to Husband all of her right, title
and interest in and to the i tell/5 of personal property listed on Exhibi t B
to this Agreement.
B. Motor Vehicles.
(1) The parties agree that Husband shall retain
poeseesion of and receive as his sole and seperate property the 1986
Chevrolet Camaro Coupe, 1986 Suzuki Madura motorcycle and 1984 Goldwing
Aspencade motorcycle, along with all rights under any insurance policiee
thereon, and the responsibility for payment of any outstanding indebtedneee
pertaining thereto and insurance thereon, and Husband shall indemnify end
hold Wife and her property harmlees from any lillbility, coet or expenee,
including attorney's fees, incurred in connection with the vehicles
transferred to Husband by the terms of thissubparagreph. Wife agrees to
execute, acknowledge and deliver any and all instruments or documents
necessary in order to effectuate the transfer of said vehicles to Husband.
(2) The parties agree that Wife shall retain possession
of and receive as her sole and separate property the 1992 Chevrolet SlO
Blazer, along with all rights under any insurance policy thereon, and the
responsibility for payment of any outstanding indebtedness pertaining
thereto and insurance thereon, and Wife shall indemnify and hold Husband
and his property harmless from any liability, cost or expense, including
attorney's fees, incurred in connection with the automobile transferred to
Wife by the terms of this subparagraph. Husband agrees to execute,
acknowledge and deliver any and all instruments or documents necessary in
order to effectuate the transfer of said vehicle to wife.
C, Real Estate.
(1) Both parties acknowledge that during the marriage
they held, as tenants by the entirety, the fee simple interest in the
marital residence located at 914 East Simpson Street, Mechanicsburg,
Cumberland County, Pennsylvania. Wife shall transfer all her right, title
and interest in the mad tal residence to Husband as his sole property in
exchar~e for payment to Wife of Fifteen Thousand ($15,000.00) Dollars.
(2) Husband shall promptly file an application and all
other necessary documents in order to obtain refinancing, in his sole name,
of the existing encumbrance on the marital residence. The lump sum payment
of Fifteen Thousand ($15,000,00) Dollars shall be paid by Husband to Wife
on or before the settlement date of the refinancing.

(3) Promptly upon payment of the Fifteen 'l'houeand
($15,000.00) Dollar sum by HUllband to Wife on or before the refinancing
settlement date, Wif~ shall transfer all her right, title and interest in
the marital residence by Deed to Husband as his sole property. Husband
shall assume solely all encumbrances on the marital residence and will hold
harmless, release and indemnify Wife for any mortgage Obligation,
encumbrance or lien.
(4) Husband shall pay all refinancing and transfer costs
or fees in cOMection with the marital residence. The Husband shall pay
all past, present and future obligations, expenses, taxes, maintenance and
costs relating to the marital residence.
O. other Assets.
(1) Wife shall retain as her sole and separate property,
free from any right, title, claim or interest of Husband, any and all bank
accounts, credit union accounts, insurance policies, stocks, bonds and
other intangible personal property held by Wife on the date of execution
hereof or acquired thereafter.
(2) Husband shall retllin as his sol" and separate
property, free from any right, title, claim or interest of Wife, any and
all bank accounts, credit union accounts, insurance policies, stocks, bonds
and other intangible personal property held by Husband on the date of
execution hereof or acquired theroafter.
E. Pensions, Retirement and Profit Sharing Plans.
The parties shall retain liS their sole property any
interest, and the other party waives any intereat, in all of each other's
Pensions, Retir.ment and Profit Sharing Plans, or the like, which the
parties now own or may own in the future.
F. Miecellaneoue Property. Any and all property not
epecifically addreeeed herein shall be hereafter owned by the party to whom
the property ill titled: and if untitled, the party in poeeeeeion. Thie
Agreement ehall constitute a sufficient bill of eale to evidence a tranefer
of any and all rights in such property from each to the other.
5. PRCPERl'r ro WIFE. The partiee agree that Wife ehall own,
poeeeee, and enjoy, fr.ee from any claim of Husband, the property awarded to
her by the terms of this Agreement. Husband hereby quitclaime, aesigns and
conveys to Wife all such property, and waivee and relinquishee any and all
righte thereto, together with any insurance policies covering the property,
and any escrow accounts relating to that property, This Agreement shall
constitute II sufficient bill of sale to evidence the transfer of any and
all righta in such property from Husband to Wife.
6. PRCPERl'r ro IIUSBAND. The parties agree that HUllband ehall
own, possese, and enjoy, free fr.om any claim of Wife, the property awarded
to him by the terms of this Agreement. Wife hereby quitclaime, assigne and
conveye to Husband all such property, and waives and relinquishes any and
all righte theretoJ together with any insurance policies covering that
property, and any escrow accounts relating to that property. This
Agreement shall constitute a sufficient bill of sale to evidence the
transfer of any and all rights in such property from Wife to Husband.
7. ASSUWl'IOO OF ~ Unless otherwise provided

9. INDI!MNIFICATIQI OF WIFE. If any claim, action or proceeding
is hereafter initiated l3eeking to hold Wife liable for the debts or
obligationl3 al3sumed by HUl3band under this Agreement, HUl3band will, at his
sole expense, defend Wife againl3t any such claim, action or proceeding,
whether or not well-founded, and indemnify her and her property against any
damages or loss resulting therefrom, including, but not limited to, costs
of court and actual attorney' s fees incurred by Wife in connection
ther.ewith.
10. INDI!MNIFICATIQI OF IIUSBAND. If any claim, action or
proceeding is hereafter initiated seeking to hold HUl3band liable for the
debts or obligations assumed by Wife under this Agreement, Wife will, at
her sole expenseJ defend Husband against any such claim, action or
proceedingJ whether or not well-founded, and indemnify him and his property
against any damages or loss resulting therefrom, including, but not limited
to, costs of court and actual attorney's fees incurred by Husband in
connection therewith.
11. NARIlAN1'Y AS TO fUl'URE OBLIGA.TI<H>. Wife and Husband each
represent and warrant to the other that she or he will not at any time in

the future incur or contract any debt, charge or liability for which the
other, the other's legal representatives, property or estate may be
respomlible, From the date of execution of this Agreement, each party
shall ulle only those credit cards and accounts for which that party is
individually liable and the parties agree to cooperate in closing any
remaining accounts which provide for joint liability. Each perty hereby
agrees to indemnify, save and hold the other and his 0:' her property
harmless from any liability. lossl cost or expense whatsoever incurred in
the event of breach hereof.
12. TAXES. The parties agree that they will flle separate future
tax returns for all tax obligations I and any tax obligation shall be the
responsibility of the individual party. Wife and Husband warrant that they
have heretofore paid all taxes on prior retu~nsl that they do not owe any
interest or penalties thereon; and that no tax deficiency proceeding or
audit is pending or notice thereof received. Husband shall give Wife
notice of any deficiency assessment and Wife shall give Husband notice of
any deficiency assessment of which they individually or collectively become
aware. The parties agree that should it ultimately be determined that any
deficiency and/or penalty exists with respect to any jointly filed returns,
the party responsible for the erroneous preparation and/or non-disclosure
of information which has resulted in the deficiency and/or penaltYJ shall
be solely responsible for the payment of the l\ITIOunt ultimately determined
to be due. together with interest, as well as expenses that may be incurred
to contest the assessment. Should said sums become dU<i as a result of
individually filed returns, the party who filed said return shall be solely
responsible for all sums due. and shall indemnify and hold harmless the
other party for any payment thereon.

If ~ither party unreaeonably faile on demand to comply with theee
provieions, that party ehall pay to the other party all attorney'e feee,
coste, and other expeneee actually incurred as a reeult of euch failure.
15. c:nRlEL FEES, cn3TS AND BXPmsBS.:. Each party ehall be
responeible for her or hie own legal fees, costs and expensee incurred in
connection with their eeparation, the dissolution of their marriage, and
the preparation and execution of this Agreement.
16. WAIVER OF I:NHmITANCE RlGm'S. Unless otherwise specifically
provided in this Agreement, effective upon the execution date, Wife and
Husband waive all rights of inheritance in the estate of the other, any
right to elect to take against the Will or any trust of the other or in
which the other haB an interest, and each of the parties waivee any
additional righte which said party hae or may have by reason of their
marriage, except the rights saved oJ:' created by the terms of this
Agreement. This waiver shall be construed generally and shall inClUde, but
not be limited to, a waiver of all rights provided under the laws of
Pennsylvania, or any other jurisdiction, and shall include all rights under
the Pennsylvania Divorce Code.

17. WAIVIR c. IlI!NEPICIARY DBSIQiATI~. Unless otherwise
Ilpecifically let forth in this AgreementJ each party hereto apecifically
waives any and all beneficiary rights in and to any asset, benefit or like
program carrying a beneficiary designation which belongs to the other party
under the terme of this Agreement, including, but not limited to, penaions
and retirement plans of any sort or nature, deferred compensation plans,
life insurance policies, annuities, stock accounts, bank accounts, final
pay checks or any other post-death distribution scheme, and each party
expressly states that it is her and his intention to revoke by the terms of
this Agreement any beneficiary designations naming the other which are in
effect as of the date of execution of this Agreement. If and in the event
the other party continues to be named as beneficiary and no 1l1ternate
beneficiary is otherwise designated, the beneficiary shall be deemed to be
the estate of the deceased party. Notwithstanding the foregoing, however,
in the event that either party hereto specifically designates the other
party as a beneficiary after the date of execution of this Agreement, then
this waiveI:' provision shall not bar that party from qualifying as such
beneficiary .

including all rights and benefits under the Pennsylvania Divorce Code of
1980, its supplements and amendments, as well as under any other law of any
other jurisdiciton, except and only except all rights and obligations
arising under thJ.s Agreement or for the breach of any of its provisiona.
Nei ther party shall have any obligation to the other not expressly set
forth herein.
C. Except as set forth in thifl Agreement, each party hereb~
absolutely and unconditionally releases and forever discharges the other
and her or his heirs, executors, administrators, assigns, property and
estate from any and all rights, claims, demands or obligations arising out
of or by virtue of the marital relationship of the parties whether now
existing or hereafter arising. The above release shall be effective
regardless of whether such claims arise out of any former or future acts,
contracts, engagements or liabilities of the other or by way of dower,
curtesy, widow's or widower's rights, family exemption or similar
allowance, or under the intestate laws or the right to take against the
spouse's will, or the right to treat a lifetime conveyance by the other as
testamentary or all other rights of a surviving spouse to participate in a
deceased spouse's estate, whether arising under the laws of Pennsylvania,
any state, corrmonwealth or territory of the United States, or any other
country .
D. Ellcept for the obligations of the parties contained in
this Agreement and such rights 6S are ellpressly reserved herein, each party
gives to the other by the execution of this Agreement an absolute and
unconditional release and discharge from dl causes of action, claims,
rights or demands whatsoever in law or in equitYI which either party ever
had or now has against the other.
19. PRESERVATIOO OF RIOCXJUl5. Each party will keep and preserve
for a period of four (4) years from the date of their divorce decree all
financial records relating to the marital estateJ and each party will allow
the other party access to those records in the event of tall audits.
20. M:X>Il"ICATIOO. No modification, rescission, or amendment to
this Agreement shall be effective unless in writing signed by each of the
parties hereto.
21. SEVERABILITY. If any provision of this Agreement is held by
a court of competent jurisdiction to be void, invalid or unenforceable, the
remaining provisions hereof shall nevertheless survive and continue in full
force and effect without being impaired or invalidated in any way.
22. 1lRBAC8. If either party hereto breaches any provision
hereof, the other party shall have the right, at her or his election, to
sue for d8lll8ges for such breach, or seek such other remedies or relief as
may be available to her or him. The non-breaching party shall be entitled
to recover from the breaching party all costs, ellpenses and legal fees
actually incurred in the enforcement of the rights of the non-breaching
party.
23. NAIVm OF 1lRBAC8. The waiver by one party of any breach of
this Agreement by the vther party will not be deemed a waiver of any other
breach of any provision of this Agreement.
24, &LICABLB LAW. All acts contemplateQ by this Agreement
shall be construed and enforced under the lalls of the COITIllOnlleal th of
Pennsylvania in effect as of the date of execution of this Agreement.
25, ~TB OF EXm1l'I~. The "date of execution" or "execution
date" of this Agreement shall be defined as the date upon which the parties
aigned the Agreement if they do so on the same date, or if not on the same
date, then the date on which the Agreement was signed by the last party to
execute this Agreement. This Agreement shall become effective and binding
upon both parties on the execution date.
26. EFm:T OF fW:DlCILIJl.TI~, COf\ABITATIal 00 DIVa<<:E. This
Agreement ahall remain in full force and effect and shall not be abrogated
even if the parties effect a reconciliation, cohabit as husband and wife or
attempt to effect a reconciliation, This Agreement also shall continue in
full force and effect in the event of the parties' divorce. There shall be
no modification or waiver of any of the terms hereof unless the parties in
writing execute a statement declaring this Agreement or any term of this
Agreement to be null and void.
27. HBADINGS tDl' PART OF AGREEMBN'l'. Any headings preceding the
text of the sev~ral paragraphs and subparagraphs hereof are inserted solely
for convenience of reference and shall not constitute a part of this
Agreement nor shall they affect its meaningJ construction or effect.
28. AGREIiJll'Nl' BINDING ~ PARTIF.S AND HEIRS. This Agreement shall
bind the parties hereto and their respective heirs, executors,
administrators, legal representatives, assigns, and successors in any
interest of the parties.
29. BNTIRE AGREEMBN'l'. Each party acknowledges that she or he has
carefully read this Agreement, that she or he has discussed its provisions
