AND NOW, this 16th day of February, 1996, comes the
Plaintiff, Ricky Shultz, by and through his attorneys, Hanft &
Vohs, and appeals from the Commonwealth of Pennsylvania's
determination of his suspension of driving privileges as follows:
1, The plaintiff, Ricky Shultz, is an adult individual who
resides at 944 Buchanan Valley Road, Orrtana, Pennsylvania,
2, On or about August 20, 1995, the Plaintiff was arrested

for violating Section 3731 of the Vehicle Code,

3, On or about January 24, 1996, plaintiff entered a plea
of guilty to section 3731 of the Vehicle code, under the express
condition that since the violation occurred prior to the effect
date of the amendments to the V~hicle Code, his driving
privileges would only be suspended for six (6) months, rather
than one (1) year,
4. On or about February 7, 1996, plaintiff received notice
from the Department of Transportation that his driving privileges
were being suspended for one (1) year as a result of his
conviction for violating section 3731 of the Vehicle Code, A

true and correct copy of sai.d notice is attached as Exhibit "A".
WHEREFORE, plaintiff, Ricky Shultz prays that his suspension
of his driving privileges be vacated, or in the alternative,
reduced to six (6) months,
