Detendants
COMPLAINT
1. The Plaintitf, Dauphin Deposit Bank and Trust company,
is a state banking institution, with its principal ottice situat~
at. 213 Market Street, HarriSburg, Pennsylvania 17101.
2. The Defendants, Keith E. Peifer and Sandra M. Peiter
(the "Peifers"), are adult individuals living and residing at
1450 Main Street (Lisburn Road), Mechanicsburg, Pennsylvania
17055.
3. The united States of America acquired subordinate liens
on July 19, 1991, in the amount of $80,775.51 (Docket 15935
FTL91), and on May 29, 1992, in the amount of $15,368.61 (Docket
16418 FTL92) and on February 1, 1993, in the amount of $5,263.04
(Docket 16728 FTL93) and on September 27, 1994, in the amount of
$9,129.27 (Docket 11994-5013), and on October 12, 1994, in the
amount of $8,673.79 (Docket 11994-5851).
4. At all relevant times, the Peifers have been the real
owners of a tract(s, or parcells) of land with buildings and

other improvements thereon loc~ted at 1450 Main street, (Lisburn
Road), Mechanicsburg, Cumberland County, Pennsylvania (the
"Premises"). The Premises are more fully described hereinafter.
5. On or about November 4, 1986, the Peifers executed an

Adjustable Rate Note in favor of the Bank (the "Note") in the
amount of $135,000.00. A true and correct copy of the Note is
attached hereto, made a part hereof and marked Exhibit A.
6. The payment obligations of the Peifers are secured by a
mortgage on the Premises also dated November 4, 1986 (the
"Mortgage"), made, executed and delivered by Defendant.s, as
Mortgagors, to Dauphin Deposit Bank and Trust Company, as
Mortgagee, which mortgage was duly recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania, in
Mortgage Book 839, page 951. A true and correct copy of the
Mortgage is attached hereto, made a part hereof and marked

Exhibit B.
7. The failure of the Peifers, among other things, to pay
when due and payable the payments under the Note constitutes a
"default" as defined under the terms of the Mortgage,

9. The Premises subject to the lien of the Mortgage are

Peifers are computed as follows:

13. Notice ot the availability of mortgage assistance under
the Homeowners Emergency Mortgage Disclosure Act ot 1983 ("Act
91") was provided. A true and correct copy ot the Notice is
attached hereto, made a part hereof. and marked Exhibit C.
13. Notice of Intention to Foreclose pursuant to section
403 ot Act 6 was provided. A true and correct copy of the Notice
is attached hereto, made a part hereot and marked Exhibit D.
WHEREFORE, Plaintitf demands judgment in the sum of
$78,465.65, together with interest as may hereafter accrue and
costs ot suit, and for foreclosure of the Mortgage and judicial
sale of the Premises and that the liens of the United states be
discharged.

9. OBUGATIONS OF PERSONS UNDER THIS NOTE
If more Ihan one person signs this Note. each person is fully and personally ohligaled 10 keep all of the promises
made in this Note, including the promise 10 pay Ihe full amoune owed. Any person who is a auarantor, surety. or
endorser of Ihis Note is also obli~ated 10 do Ihese things, Any person who takes over Ihese obligalions, including the
obligations of a auaranlor, surety, or endorser of Ihis Note, is also obligaled 10 keep all of the promises made in this
