7. Di,'orce is sought pursuant to the provisions of the Divorce Code,
Sections 3301 (c) and 3301 (d), in that:
a) The marriage is irretrievably broken;
b) The Plaintiff and Defendant have lived separate and apart since
February 8, 1996; at the appropriate time the Plaintiff wi II file the appropriate affidavits.
8. The Plaintiff has been advised of the availability of counselling and of
the Plaintiff's right to request that the Court require the parties to participate in counselling
and does not request same.
9. Defendant is not a member of the armed services.
WHEREFORE, Plaintiff requests your Honorable Court to enter a Decree in
Divorce, divorcing Plaintiff and Defendant.

COUNT II . EQUITABLE DISTRIBUTION
10. Paragraphs 1 through 4 of this Complaint are incorporated herein by
reference as though set forth in full.
11. Plaintiff and Defendant have acquired property, both real and personal,
during their marriage from August 20, 1993 until February 8, 1996, the date of their
separation, which property is "marital property".
12. Plaintiff and Defendant may have owned, prior to the marriage,
property which has increased in value during the marriage and/or which has been
exchanged for other property, which has increased in value during the marriage, all of
which property is "marital property".
13. Plaintiff and Defendant have been unable to agree as to an equitable
division of said property prior to the filing of this Complarllt.
WHEREFORE, Plaintiff requests your Honorable Court to equitably divide all
marital property.

have elapsed from the date of filing of the complaint and the date of service of the complaint on the
Defendant.

1. The Petitioner herein is the Defendant, Harry M, Houdeshell, an adult
individual who resides at 811 Wertzville Road in East Pennsboro Township, Cumberland
County, Pennsylvania,
2, The Respondent herein is the Plaintiff, Mary E, Houdeshell.
3, Defendant is the sole and exclusive owner of real estate at 811 Wertzville Road
in East Pennsboro Township, Cumberland County, Pennsylvania, which has always been
titled in his name alone,
4, The Plaintiff has repeatedly come to Defendant's home, without his consent
and contrary to his instructions to her, and entered the property without his consent. On
two occasions, she removed property to which she had no lawful claim and on at least
one of those occasions she did damage to the property.
o5. The East Pennsboro Township Police will not enforce the criminal trespass
statutes against the Plaintiff and have advised the Defendant that they will not take any
action to prevent the Plaintiff from entering on the Defendant's property or entering his
home unless there is an order of court prohibiting her from doing so,
6, Defendant is entitled to his privacy and to the exclusive possession of the home
which is his alone and for which the Plaintiff has made no payment and to which she has
made no contribution.
WHEREFORE, Defendant prays this Court to issue an order awarding him
exclusive possession of his residence at 811 Wertzville Road in Enola, East Pennsboro
Township, Cumberland County, Pennsylvania,

Defendant believes there are no significant marital assets in this case, A list of the non. marital assets of the
parties, as known to Defendant is attached and marked as Exhibit B, Because of the brevity of the marriage,
Defendant believes there is no increase in value of any of these assets,
2, EXPERT WITNESSES. Defendant does not intend to call any expert witnesses at the present
time but reserves the right to call experts in the event the parties cannot agree on values and it becomes
necessary to establish the value of any of the marital or non-marital assets,
3, FACT WITNESSES. At the present time Defendant intends to call only himself as a witness,
However, he reserves the right to call any other witnesses as may be necessary to respond to Plaintiffs case,

reserves the right to offer such exhibits as may be necessary to respond to Plaintilf's case,

provide a complete and accurate income and expense statement at the time of the hearins. if one is requested

6, EXPENSE ST A TEl\! ENT Defendant does not intend to offer any testimony about his expenses
but reserves the right to offer such testimony if appropriate to respond to Plaintilf's evidence,
7. PENSION INFORMATION, There are no significant retirement benefits acquired by either
party during the marriage, to the best of Defendant's knowledge. He reserves the right to offer testimony
about such benefits, however, in response to Plaintiffs request.
8. COUNSEL FEES. To Deftndant's knowledge, there is no claim fc,r counsel fees pending in this
case,
9, PERSONAL PROPERTY, Defendant doubts that the parties will be able to agree upon the

By order of Court of President Judge Harold E. Sheely
dated June 26, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on February 20, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage. The motion for appointment of Master indicates that
the parties will both file consents so grounds for divorce are
apparently not an issue.
The divorce complaint also raised the economic claim of
equitable distribution. No other economic issues have been
raised in the action.
In accordance with P.R.C.P. 1920.33(b) I am directing
each counsel to file a pre-trial statement on or before Monday,
JUly 22, 1996. Upon receipt of the pre-trial statements I will
immediately schedule a pre-hearing conference with counsel to

Present for the Plaintiff, Mary Elizabeth
Houdeshell, is attorney Austin F. Grogan, and present for the
Defendant, Harry Meade Houdeshell, is attorney Samuel L. Andes.
A divorr.e complaint was filed on February 20, 1996.
There was another action filed which has been consolidated with
the present action. That action was docketed to No. 96 - 1239
Civil. Both actions are in Cumberland County.
The divorce complaint raised grounds for divorce of
irretrievable breakdown of the marriage and counsel have
indicated that the parties will sign and file affidavits of
consent prior to the hearing to be scheduled in these
proceedings. The complaint also raised the economic issue of
equitable distribution. Mr. Andes indicated tOday that his
client is going to file a petition for alimony pendente lite and
alimony.
The parties were married on August 20, 1993, and
according to wife separated on February 8, 1996, and according
to husband separated on February 3, 1996. There were no
children born of this marriage.
wife is 39 years of age and has a bachelors degree
in nursing. She is an employee presently for the Commonwealth
of Pennsylvania and has an annual gross income of $50,000.00.
She previously reported income of $1,769.00 biweekly gross with
the Pinnacle Health System at Polyclinic Hospital where she was
a pediatric nurse practitioner. wife is requested to file an
updated income and expense statement prior to the hearing. Wife
has not raised any health issues. She has a child to a prior
marriage and is receiving support from her prior husband for
that child. wife lives at RR 1, Box 179-A, Coudersport,
Pennsylvania, where she lives with the son from the previous
marriage.
Husband is 44 years of age and resides at 811
Wertzville Road, Enola, Pennsylvania, where he lives alone. He
is a high school graduate and is an electrician. He is a member
of the International Brotherhood of Electrical Workers and has
been recently laid off from his employment with Heim Electric.
He has applied tor unemployment compensation and will most
likely receive the maximum benefits since his income while
employed was around $40,000.00 annual gross. Husband has not
raised any health issues. Husband is requested to tile an
income and expense statement.
Husband owns a piece of real estate at 811
Wertzville Road, Enola, Pennsylvania, where the parties lived
together. The home has remained in husband's name which was in
his name prior to the marriage. There is an issue as to any
increase in value of the home from the date ot marriage to the
date of separation. Mr. Grogan indicated that he is going to
have the property appraised to establish any increase in value
and stated that the appraiser will probably be Raymond Woof.
The property is SUbject to a mortgage in favor of York Federal
and counsel are going to establish when that mortgage was
entered into and the amount of the mortgage. There is a
question as to whether or not wife is an Obligor on that
mortgage.
The only vehicle subject to distribution is wife's
1994 Ford Explorer. Mr. Grogan is going to provide specific
information as to the vehicle so that perhaps counsel can look
at an appropriate book to try to determine the market value.
The vehicle is subject to an encumbrance in the amount of
$21,000.00.
There is a substantial issue with respect to
distribution and values of household tangible personal property.
The parties had been before Judge Oler on a petition for special
relief to allow wife to retrieve certain items oi household
tangible personal property. After the order was entered wife
did receive the items provided for in the order; however,
counsel have indicated that she subsequently broke in to the
home ot husband and took additional items. Further, wife has
provided a list stating that there are other items which she
claims are premarital, which she would like to have from the
house. Husband's statement on this issue is that items which
wife claims she would like to have returned to her have in some
instances already been retrieved by wife or husband does not
have the items in his possession.
An issue also has arisen with respect to a train
collection. Husband claims that he had an interest in trains

prior to the marriage and had certain parts of the collection
prior to the marriage and has acquired some after the date of
separation. On the other hand, wife claims that husband's
interest in trains occurred during the marriage and that the
trains were all marital and purchased during the marriage. Wife
has a video tape of husband's train collection which Mr. Grogan
is going to show at the hearing. There is some question as to
an $8,000.00 train set which wife claims she bought husband as a
gift and husband claims that it was simply purchased as part of
his collection. In any event, we need to establish values for
the trains and then determine when the particular trains were
purchased to determine whether they are marital or nonmarital.
Mr. Andes has also asked that Mr. Grogan provide
information on any pension which wife is a participant in so we
can determine if that pension has increased in value during the
marriage.
The Master is also interested in having a list of
each of the party's premarital and nonmarital assets and the
value of those assets. Of particular interest to the Master
will be the value of assets other than marital that each of the
parties has in his or her possession. Mr. Andes has asked for
clarification on that request and the Master is more concerned
about assets other than household tangible personal property.
Obviously it appears as if we are going to be getting into the
tangible personal property issue in any event in the testimony
with respect to the equitable distribution claim.
A hearing is scheduled for Thursday, August 7,
1997, at 9:00 a.m. Notices will be sent to counsel and the
parties.

MARY ELIZABETH HOUDESHELL, hereinafter referred tt;! as "WIFE", and HARRY MEADE
HOUDESHELL, hereinafter referred to as "HUSBAND",
WITNESSETH:
WHEREAS, the parties hereto are Husband and Wife, having been married August
20, 1993; and
WHEREAS, differences have arisen between Husband and Wife, as a result of which
it is the desire of the parties after long and careful consideration, amicably to adjust,
compromise and settle all property rights and all rights in, to, or against each other's
property or estate, including property heretofore or subsequently acquired by either party,
and to settle all disputes existing between them, including any and all claims for
maintenance, support, alimony, equitable distribution, counsel fees, and costs; and
WHEREAS, it is the mutual desire of Husband and Wife to reduce their agreement
to writing; and
NOW, THEREFORE, in consideration of the mutual promises, covenants, and
agreements hereinafter contained, each of the parties hereto, intending to be legally bound
hereby promises, covenants, and agrees as follows: and

The parties mutually agree to live sepdrate and apart as though the parties had not
been married, Neither party will molest the other, or compel the other to cohabit or in any
way harass or malign the other, nor in any way interfere with the peaceful existence of the

Husband and Wife agree that the Husband will return to Wife the pre-marital
property identified in attachment (It 1) within thirty days of signing the Agreement.
Furthermore, the parties agree that each party has separilted their marital property to their
satisfaction and hereby specifically waive, release, renounce or forever abandon whatever
claim, if any, he or she may have to the sole and separate property of the other.

Husband and Wife each covenant, represent and agree that each other will now and
at all times hereafter save harmless and keep the other indemnified from all debts, charges
and Iiabi lilies incurred by the other prior to or after the effective date of this Agreement,
except as may be otherwise specifically provided for the by the terms of this Agreement.

lite.

!Waiver of Interest in Retirement}
Husband and Wife each agree to waive any interest in the other parties pensions
whether or not currently matured or vested or contingent on condition precedent.

Husband and Wife declare lhat each has had a full and fair opportunity to obtain and
consult with legal counsel of his/her selection and that the parties, cognizant of their legal
rights, declare and express that:
a) Wife is represented by Austin F. Grogan, Esquire; and

b) Husband, is represented by Samuel L. Andes, fsquire.

(Mutua' Discharllel
Wife relinquishes her inchoate intestate right in the estate of Husband, and Husband
relinquishes his inchoate intestate right in the estate of Wife, and each of the parties hereto
for himself or herself, his or her heirs, executors, administrators or assigns does remise,
release, quitclaim and forever discharge the other party hereto, his or her heirs, executors,
administrators or assigns, or any of them, of any and all claims, demands, damages, actions,
causes of action or suits of law or in equity of whatsoever kind or nature for or because of
a matter or thing done, omitted or suffered to be done by said party prior to and including
the date hereof, except that this release shall in no way exonerate or discharge either party
hereto from the obligations and promises made and imposed by reason of this Agreement.

(Execution and Delivery of Documen~
The parties hereto agree to execute and deliver all papers needed to effectuate the
terms and intentions of this Agreement.

If either party breaches any provisions of this Agreement, the other party shall have

the right, at his or her election, either to sue for specific performance or for damages for

Agreement.

This Agreement encompasses all agreements between the parties concerning the
matters set forth herein and may not be altered or omitted except in writing executed by the
parties; the waiver of any term, condition or provision of this Agreement shall in no way
be deemed a waiver of any other term, conditions or provisions of this Agreement.
If any term, condition or provision of this Agreement shall be determined to be void
or invalid in law or otherwise, then only that term, condition or provision shall be stricken
from this Agreement, and in all other respects, this Agreement shall be valid and continue
in full force.
It is agreed by and between the parties hereto that this Agreement shall survive and
shall not be merged into any decree, judgment, or order of divorce or separation, It is
specifically agreed, however, thlt a copy of this Agreement or the substance of the
provisions thereof, may be incorporated, by reference, into any divorce, judgment or decree.
This incorporation, however, shall not be regarded as a merger, it being the specific intent
of the parties to permit this Agreement to survive any judgment and to be forever binding
and concl usive upon the parties.

This Agreement shall be construed under the laws of the Commonwealth of
Pennsylvania.
This Agreement is executed in triplicate, and Husband and Wife, as parties hereto,
acknowledge the receipt of a duly executed copy hereof,

It is agreed by and between the parties hereto that this Agreement shall survive and
shall not be merged into any decree, judgment, or order of divorce or separation. It is
specifically agreed, however, that a copy of this Agreement or the substance of the
provisions thereof, may be incorporated, by reference, into any divorce, judgment or decl'ee.
This incorporation, however, shall not be regarded as a merger, it being the specific intent
of the parties to permit this Agreement to survive any judgment and to be forever binding
and conclusive upon the parties.
