AND NOW, this 2nd day of May, 1996, the
Defendant, Daniel Ray Lescalleet, now appearing in court on a
charge of indirect criminal contempt with the Public Defender,
Timothy L. Clawges, Esquire, and the Commonwealth in the person
of Thomas A. Placey, Esquire, having requested that bail be set
and a trial date scheduled in this matter, and it appearing that
the Defendant is serving a six month prison sentence at this
time and is incarcerated on that sentence at the Cumberland
County Prison, bail is set in this case in the amount of
$250.00, and the Defendant is directed to appear trial on the
charge of indirect criminal contempt on Friday, May 31, 1996, at
1:30 p.m., in Courtroom No.5, Cumberland county Courthouse,

AND NOW COMES Travis N. Gery, Assistant District Attorney,
Cumberland County, Pennsylvania and avers as follows:
1. By order of This Honorable Court, dated May 2, 1996, a
hearing to determine whether the above named defendant should be held
in contempt of This Honorable Court's PROTECTION ORDER dated February
28, 1996 (entered into upon consideration of the Consent of the
parties), was scheduled for May 31, 1996 at 1:30.
2. As a result of the allegations which serve as the basia for
the contempt proceeding, the defendant was also charge with violations
of secti.ons 2706 and 2709 of the Crimes Code (Terroristic Threats and
Harassment and Stalking) .
3. A Preliminary Hearing on the criminal charges is scheduled
for June 5, 1996 before the Honorable Paula P. Correal, ~istrict
Justice.
4. The Commonwealth wishes to, at this point. proceed with the
underlying criminal charges.
WHEREFORE, The Commonwealth respectfully requests that the
scheduled hearing on the contempt allegation be continued to a date
after the preliminary hearing on the underlying criminal charges.

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
pF INDIRECT CRIMINAL CONTEMPT
Michael S. Schwoyer, Chief Deputy District Attorney of
Cumberland County, Pennsylvania brings the following Petition for
a hearing on charges of Indirect Criminal Contempt:
1. A Protection from Abuse Order was issued by the Court.
A true and correct copy of the Order is attached.
2. The defendant's violation of this Order is averred in
the attached criminal complaint.
3. The victim requests the filing of an Indirect Criminal
Contempt charge upon information received.
4. The District Attorney's Office approves the filing of
this private criminal complaint.
5. The Commonwealth is requesting a trial on the charges
of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. S6113.
6. The plaintiff and the defendant may seek modification
of the Order based on the filing of this petition as the Court
deems appropriate following the trial in addition to any other
sentence. 23 Pa.C.S.A. S6117.
WHEREFORE, the Commonwealth requests the defendant be
commanded to appear before the Court on the charge of Indirect
Criminal Contempt.

under 23 Pa. C.S. g6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00: and iv) civil contempt
under 23 Pa. C.S. g6114.1. Resumption of co-residence on the
part of the plaintiff and defendant shall not nullify the
provisions of the court order.
11. The Pennsylvania State, Carlisle. and Mt. Holly Springs
Police Departments shall be provided with certified copies of
this Order by the plaintiff's attorney and may enforce this Order
by arrest for indirect criminal contempt without warrant upon
probable cause that this Order has been violated, whether or not
the violation is committed in the presence of the police officer,
In the event that an arrest is made under this section, the
defendant shall be taken without unnecessary delay before the

In that the defendant did telephone the victim at her place of employment, the Pit Stop Deli,
at approximately 1336 hours. In that the defendant did verbally harass and or threaten the
victim over the telephone. In that the defendant did place a second phone call to the business
in an attempt to speak with the victim. The defendant did speak with the owner of the business
and did make threats toward the victim through the owner. I:escalleet told the victim that
he should have stopped in on the previous night,and killed everyone with a shotgun. lescalleet
then called back,and told the owner he was on his way to kill everyone.

AND NOW, this ~<6fL day of February, 1996, upon
consideration of the Consent Agreement of the parties, the
following Order is entered:
1. The defendant, DANIEL RAY LESCALLEET, is enjoined from
physically abusing the plaintiff, APRIL ANN DAY, and from placing
her iu fear of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff, except written
communications,
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives.
4. The defendant is prohibited from entering the
plaintiff's place of employment.
S. The defendant is prohibited from removing, damaging,
destroying or selling any property owned by the plaintiff.
6. The defendant is ordered to stay away from the
plaintiff's residence located at 27 Chestnut Street, Mt. Holly
Springs, Cumberland County, Pennsylvania,
7. The defendant is ordered to stay away from any
residence the plaintiff may in tha future establish for herself.
8. The Court costs and fees are waived.
9. This Order shall remain in effect for a period of one
(1) year and can be extended beyond its original expiration date
if the Court Linds that the defendant has committed an act of
abuse or has engaged in a pattern or practice that indicates risk
of harm to the plaintiff on a continued basis. This Order shall
be enforceable in the same manner as the Court's prior Temporary
Protection Order entered in this case.
10. This Order may subject the defendant to: i) arrest
under 23 Pa. C.S. g6113; ii) a private criminal complaint under
23 Pa. C.S. g6113.1; iii) a charge of indirect criminal contempt
under 23 Pa. C.S. g6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
under 23 Pa. C.S. g6114.1, Resumption of co-residence on the
part of the plaintiff and defendant shall not nullify the
provisions of the court order.
11. The Pennsylvania State, Carlisle, and Ht. Holly Springs
Police Departments shall be provided with certified copies of
this Order by the plaintiff's attorney and may enforce this Order
by arrest for indirect criminal contempt without warrant upon
probable cause that this Order has been violated, whether or not
the violation is committed in the presence of the police officer.
In the event that an arrest is made under this section, the
defendant shall be taken without unnecessary delay before the

'[he defendant did violate the order issued under the Protection From Abuse Act in NO.96-936
Civil on the 28th day of February 1996 by the Honorable J. Wesley Oler, Jr.. Said order
directed the defendant not to place the victim APRIL ANN DAY, in fear of abuse or from
having any direct or indirect contact with the victim except written conrnunication.
In that the defendant did telephone the victim at her place of employment, the Pit Stop Deli,
at approximately 1336 hours. In that the defendant did verbally harass and or threaten the
victim over the telephone. In that the defendant did place a second phone call to the business
in an attempt to speak with the victim. The defendant did speak with the owner of the business
and did make threats toward the victim thr.ough the owner. I:escalleet told the victim that
should have stopped in on the previous night,and killed everyone with a shotgun. Lescalleet
then called back,and told the owner he was on hls way to kill everyone.

County courthouse, Carlisle, Pennsylvania.
The plaintiff may proceed without pre-payment of fees
pending a further order after the hearing.
The cumberland county Sheriff's Department shall attempt to
make service at the plaintiff's request and without pre-payment
of fees, but service may be accomplished under any applicable
rule of Civil Procedure.
This Order shall be docketed in the office of the
Prothonotary and forwarded to the Sheriff for service. The
Prothonotary shall not send a copy of this Order to the defendant
by mail.
The Pennsylvania state, Carlisle, and Mt. Holly springs
Police Departments shall be provided with certified copies of
this Order by the plaintiff's attorney. This Order shall be
enforced by any law enforcement agency where a violation occurs
by arrest for indirect criminal contempt without warrant upon
probable cause that this Order has been violated, whether or not
the violation is committed in the presence of the police officer.
In the event that an arrest is made, under this section, the
defendant shall be taken without unnecessary delay before the
court that issued the order. When that court is unavailable, the
defendant shall be taken before the appropriate district justice.

The Court of Common Pleas of Cumberland County is required
by law to comply with the Americans with Disabilities Act of

betore the court.
a. On or about February 19, 1996, the defendant came
to the plaintiff's work and threatened her saying that
it she got a "PFA" against him, he would kill her,
himself, and everybody he cares about. The plaintiff's
bo.. telephoned the police who told the defendant not
to have any contact with the plaintiff. When the
plaintiff left work and went to her car, the defendant
screamed her name from across the lot and came at the
plaintiff. Fearing for her safety, the plaintiff
jumped into her car and left. The plaintiff obtained
an immediate temporary Protection Order through
District Justice Shulenberger which has been registered
through the Cumberland County Court.
b. On or about February 1B, 1996, the defendant came
to the plaintiff's residence and when she did not
answer the door, the defendant picked the lock, came
into the residence, pushed the plaintiff forcefully
into a chair, and slapped her in the face. The
defendant then punched the plaintiff in the jaw causing
immediate pain to both her ear and jaw, and pushed her
against a wall causing bruising to her leg.
c) On or about February 4, 1996, when the plaintiff
refused to have sex with the defendant, he punched
seve~al holes in the plaintiff's door, causing her to
fear for her safety. The defendant then spit on the
plaintiff, pushed her, and threw her to the floor. The
defendant telephoned his brother and asked his brother
to come pick him up before he killed the plaintiff.
d) Since 1994, on approximately a weekly basis, the
defendant has abused the plaintiff in ways including,
but are not limited to, the following: slapping,
punching, kicking, shoving, throwing, restraining her
from leaving, and locking the plaintiff in rooms.
5. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendant, and
that she is in need of protection from such abuse.
6. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff,
except by mail.
7. The plaintiff desires that the defendant be enjoined
from harassing and stalking the plaintiff, and from harassing the
plaintiff's relatives.
8. The plaintiff desires that the defendant be restrained
from entering her place of employment.
11. The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
by the plaintiff.

1. Ordering the defendant to retrain trom
abusing the plaintiff or placing her in fear of

harassing and stalking the plaintiff and from
harassing the plaintiff's relatives;

preliminary arraignment as the result of the execution of an
arrest warrant for an alleged violation of a Protection from
Abuse Order, and the Court having provided the information
required under Pennsylvania Rule of Criminal Procedure 140
pertaining to preliminary arraignments, and the Commonwealth

AND NOW, this 27th day of July, 1999, upon
consideration of the complaint for Indirect Criminal Contempt,
and the Defendant now appearing in court with his counsel, Ellen
K. Barry, Esquire, and the Commonwealth having appeared in the
person of William I. Gabig, Esquire, and having requested a
continuance of this case because the alleged victim in the case
has failed to appear for the trial, and there being a question
as to whether the victim was effectively subpoenaed (although
sh~ obviously was aware of the proceeding), and the Defendant
having not opposed a continuance, trial in this matter is
continued until Tuesday, August 17, 1999, at 8:30 a.m., at which
time the Defendant is directed to appear for the trial on
Indirect Criminal Contempt.

IN RE: GUILTY PLEA and SENTENCE
ORDER OF COURT
AND NOW, this 17th day of August, 1999, the
Defendant, Daniel R. Lesca11eet, now appear.ing in court with
the Public Defender for a trial on a charge of indirect
criminal contempt arising out of an alleged violation of a
Protection from Abuse Order, and the Defendant having tendered
a plea of guilty to the offense pursuant to an agreement
whereby the sentence of the Court would be one of probation and
restitution for two incidents involving damage to a door to the
Plaintiff's residence, ~nd the Plaintiff having indicated her
agreement to this plea and sentence, and the Commonwealth in
the person of William I. Gabig, Esquire, having agreed further
that the Commonwealth will not file an additional indirect
criminal contempt charge relating to non-payment in the past
for damage to the door or for the incident most recently
occurring involving damage to the door, and Plaintiff having
further agreed that the Protection from Abuse Order dated
October 13, 1998, should be amended to preclude contact between
the Plaintiff and the Defendant and to exclude the Defendant
from Plaintiff's residence, the Defendant's plea of guilty is
accepted.

The sentence of the Court is that tho Defendant pay
the costs of prosecution and any other fees required under the
Protection from Abuse Act, and make restitution in the amount
of $510.00 to the Plaintiff for an initial incident involving
damage to the door of her residence, and to make restitution
for damage to the door occurring in a subsequent incident, and
that he undergo a period of probation with supervision of six
months conditioned upon his being and remaining on good
behavior, including compliance with the Protection from Abuse
Order in effect, and upon his compliance with all written
directions of his probation officer.
