On or about February 19, 1996, the defendant came to the plaintiff's work and threatened her saying that it she got a "PFA" against him, he would kill her, himself, and everybody he cares about. The plaintiff's bo.. telephoned the police who told the defendant not to have any contact with the plaintiff. When the plaintiff left work and went to her car, the defendant screamed her name from across the lot and came at the plaintiff. Fearing for her safety, the plaintiff jumped into her car and left. The plaintiff obtained an immediate temporary Protection Order through District Justice Shulenberger which has been registered through the Cumberland County Court. b. On or about February 1B, 1996, the defendant came to the plaintiff's residence and when she did not answer the door, the defendant picked the lock, came into the residence, pushed the plaintiff forcefully into a chair, and slapped her in the face. The defendant then punched the plaintiff in the jaw causing immediate pain to both her ear and jaw, and pushed her against a wall causing bruising to her leg. c) On or about February 4, 1996, when the plaintiff refused to have sex with the defendant, he punched seve~al holes in the plaintiff's door, causing her to fear for her safety. The defendant then spit on the plaintiff, pushed her, and threw her to the floor. The defendant telephoned his brother and asked his brother to come pick him up before he killed the plaintiff. d) Since 1994, on approximately a weekly basis, the defendant has abused the plaintiff in ways including, but are not limited to, the following: slapping, punching, kicking, shoving, throwing, restraining her from leaving, and locking the plaintiff in rooms. 5. The plaintiff believes and therefore avers that she is in immediate and present danger of abuse from the defendant, and that she is in need of protection from such abuse. 6. The plaintiff desires that the defendant be prohibited from having any direct or indirect contact with the plaintiff, except by mail. 7. LESCALLEET, Defendant 96-0936 CIVIL TERM IN RE: GUILTY PLEA and SENTENCE ORDER OF COURT AND NOW, this 17th day of August, 1999, the Defendant, Daniel R. Lesca11eet, now appear.ing in court with the Public Defender for a trial on a charge of indirect criminal contempt arising out of an alleged violation of a Protection from Abuse Order, and the Defendant having tendered a plea of guilty to the offense pursuant to an agreement whereby the sentence of the Court would be one of probation and restitution for two incidents involving damage to a door to the Plaintiff's residence, ~nd the Plaintiff having indicated her agreement to this plea and sentence, and the Commonwealth in the person of William I. Gabig, Esquire, having agreed further that the Commonwealth will not file an additional indirect criminal contempt charge relating to non-payment in the past for damage to the door or for the incident most recently occurring involving damage to the door, and Plaintiff having further agreed that the Protection from Abuse Order dated October 13, 1998, should be amended to preclude contact between the Plaintiff and the Defendant and to exclude the Defendant from Plaintiff's residence, the Defendant's plea of guilty is accepted. .' The sentence of the Court is that tho Defendant pay the costs of prosecution and any other fees required under the Protection from Abuse Act, and make restitution in the amount of $510.00 to the Plaintiff for an initial incident involving damage to the door of her residence, and to make restitution for damage to the door occurring in a subsequent incident, and that he undergo a period of probation with supervision of six months conditioned upon his being and remaining on good behavior, including compliance with the Protection from Abuse Order in effect, and upon his compliance with all written directions of his probation officer.
