BEATTIE, filed a divorce action on February 21, 1996 alleging the irretrievable breakdown of the marriage. Defendant, Cindy L. Beattie, accepted service of the Divorce Complaint on March 12, 1996. Defendant, Cindy L. Beattie, has refused to file the consents necessary in reference to the no-fault provisions of the Divorce Law. 2. Plaintiff avers that, in addition to the irretrievable breakdown of the marriage pursuant to 3301(c) of the Divorce Code, the Defendant is at fault pursuant to the !! following provisions of the Divorce Code: 3301(a) 1: Committed willful and malicious desertion, and absence from the habitation of the injured and innocent spouse, without a reasonable cause, for the period of one or more years. :1 .
