4. Plaintiff is the holder of said Agreement and is entitled
to payment under the te~ms thereof.
5. Pursuant to the terms of the Agreement, Defendants were
required to maintain collision insurance on the Ford automobile
that was the subject of the Agreement and that insurance was to
name the Plaintiff as a co-insured.
6. The Defendants did obtain said insurance through American
States Insurance Company.
7, On or about January 21, 1994, Defendant Kenwood W. Losh,
Sr., was involved in art accident, which resulted in damage to the
vehicle covered under the terms of this Agreement in an amount in
excess of $5,000.00.
8. The Defendants made a claim through American States
Insurance Company for the damages to the vehicle covered by the
terms of this Agreement and American States Insurance Company
issued their check numbered 7251918 (a copy of which is attached
hereto and marked Exhibit "B") on February 9, 1994 in the amount of
$5,162.45.
9. Upon receipt of the aforesaid check, Defendant Kenwood W.
Lash, Sr., endorsed the check with his name and also with the name
of Ford Motor Credit of Camp Hill, and caused the check to be
negotiated.
10. Plaintiff believes and, therefore, avers that the
Defendant's did not, however, cause the repairs to be made to the
vehicle with the proceeds of the America~ States Insurance Company
check, but instead kept the funds for their own purposes.
11. In or about April, 1994, Defendants defaulted by failing
to make payments when and as due.
12. Defendants thereafter continued in default and on or
about November 10, 1994, Plaintiff caused the vehicle to be
repossessed and exposed for public sale pursuant to the terms of
the Agreement.
13. At the time of repossession or sale of the vehicle as
aforesaid, Defendants had a balance due under the terms of the
Agreement of $19,349.61.
14. After charges and credits under the terms of the
Agreement, and following the sale of the vehicle as aforesaid, the
outstanding balance due from Defendants to Plaintiff was $9,078.00,
plus interest at the contract rate of 14.900% per annum.
15. At the time of the sale of the vehicle at the public sale
as set forth above the vehicle was sold for $5,800.00, and
continued to have uninsured damage to it in an amount in excess of
$5,000.00, due to Defendants' failure to have the vehicle repaired.
16. Demand for payment has been made upon Defendants, but
Defendants have failed or refused to pay.
COUNT I - BREACH OF CONTRACT
17. Plaintiff incorporates, by reference thereto, Paragraphs
1 through 16 as though set forth fully hereunder.
WHEREFORE, Plaintiff seeks judgment against Defendants,
Kenwood W. Losh, Sr., and Susan K. Losh in the amount of $9,078.00,
plus interest and costs of suit.
COUNT II - FRAUD
18. plaintiff includes, by reference thereto, Paragraphs 1
through 16 of their Amended Complaint as set fully hereunder.
19. Defendants did not have plaintiff's permission to sign
their name to the insurance proceeds following the damages to the
vehicle in January of 1994.
20. Defendants did not use the proceeds from the insurance
claim to repair the vehicle as they were required to do under the
terms of the Agreement.
21. Plaintiff suffered a loss for the damage to the extent
that the repairs on the vehicle following the January, 1994,
accident were not made and the vehicle brought less at the time of
public sale than it should have if it would have been repaired.
22. Plaintiff suffered a loss to the extent that Defendants
did not make the repairs and did not turn over the funds from the
American States Insurance Company after signing Plaintiff's name to
the check.
WHEREFORE, plaintiff seeks judgment against Defendants,
Kenwood W.Losh, Sr., and Susan K. Losh in the amount of $9,078.00,
plus interest and costs of suit.

AND NOW, COMES the Plaintiff, Ford Motor Credit Company, by its
attorneys, Law Offices of Donald S. Mazzotta, P.C., and
respectfully presents its complaint in civil action against the
Defendants above-named upon a cause of action whereof the following
is a statement:
1. Ford Motor Credit Company is a corporation doing business
at P.O. Box 3187, Melvindale, MI, and is hereinafter referred to as
"Plaintiff."
2. Kenwood W. Losh, Sr. and Susan K. Losh are individuals
residing at 404 Crossroad School Road, Carlisle, Cumberland County,
Pennsylvania, and both are hereinafter collectively referred to as
