S. The premises subject to the Mortgage are descrlbed fully
Ln the legal description, attached hereto as Exhibit C.
6, Plaintiff has not dssLgned the Note or the Mortgage and is
the holder thereof.
7. The Defendants are in default with regard to the Mortgage
in that they have failed to pay when due the monthly installments
from September, 1995 to date.
8. Pursuant to the Homeowners Emergency Mortgage Assistance
Act of 1983, written notice of counseling was given to the
Defendants by regular and certified mail. A copy of the aforesaid
notice of counseling dated November 30, 1995 is attached hereto,
marked Exhibit D and incorporated herein by reference. Plaintiff
avers that the Defendants did not avail themselves of the opportu-
nity for counseling within thirty (30) days from the date of said
notice.
9. Pursuant to Act of January 30, 1974, P.L. No.6 (41 P.S.
101 et seq.l, written notice of intention to foreclose was given to
the Defendants on November 30, 1995 by certified and regular mail.
A copy of the aforesaid notice of intention to foreclose and post
office receipts are attached hereto, marked Exhibit E and
incorporated herein by reference.
